Consumer Complaint: After my divorce in XXXX I purchased a house for approximately {$450000.00}. As a single mom with no child support or alimony, I was soon unable to make my monthly payments. I ultimately deeded the house in lieu of foreclosure to Nationstar during XXXX, XXXX. At that time the mortgage was {$340000.00}. I received a XXXX in XXXX, XXXX for the XXXX tax year indicating that the fair market value of the property was {$360000.00}. The Commonwealth of Massachusetts considers cacelled debt as income. Even though I gave Nationstar my home in exchange for cancelling the mortgaged, I 'm being taxed on {$340000.00} as income, and have to come up with over {$18000.00}. I am a single mom with XXXX kids in college and rent my home. I 've called Nationstar approximately 7 times during the past 3 weeks, and have emailed them. I 've asked them, in accordance with my accountant 's recommendation, to issue a corrected XXXX. They do not respond to my messages. This is an enormous financial burden and causing terrible XXXX for me and my children. I 'm concerned about Nationstar 's apparent disregard for this situation.

Consumer Complaint: On XX/XX/XXXX I sent in a cashier 's check to Nationstar for my regular monthly payment in the amount of {$1300.00} ; Evidently that check was sent to the corporate address instead of their overnight address. I was informed of that and due to the fact that I did not want to be late on my mortgage payment, when the representative that I spoke to on XX/XX/XXXX ( Name XXXX ; Ext : XXXX ) suggested that I send in another payment I did so on the same day. XXXX also mentioned that there 's a possibility that the check might get returned back to me or that it would just be sent to the correct department for processing, She said that whichever payment is processed first will be applied for XX/XX/XXXX, the other will be applied for XX/XX/XXXX. The second check I sent in XX/XX/XXXX was in the amount of {$1300.00}. The check was sent on XX/XX/XXXX and received on XX/XX/XXXX, It was cashed on XX/XX/XXXX and was posted to the account for the XX/XX/XXXX payment. The first initial check which was sent on XX/XX/XXXX, received on XX/XX/XXXX and cashed on XX/XX/XXXX ( which we later found out when Nationstar asked for proof from our bank ) was never posted to the account. We have contacted Nationstar about this matter about 24 times through email and phone since XX/XX/XXXX, might be more, I lost count after my 20th call ; They have yet to take this matter seriously. I have gone through at least 8 research request that was submitted for them to look into it and apply my missing payment, but none of these requests worked. Every single time I submitted one, I would get just a little bit of hope but to no avail. I have faxed them all of the documents that they have ever asked for on every occasion that a new research request would be submitted and I have also emailed them those documents. I believe that the employees are not taking their time to do their job correctly. They mentioned that everything is correct on the account and that the missing payment was applied toward the mortgage. I have looked at the statements and that first check that Nationstar cashed is nowhere to be found on there. And its also funny that one of their representative told me that I should be happy that I 'm not behind on my payments and to just be happy and let it go and continue to make my payments. I just want Nationstar to post the payment as it should be, and if they refuse to do that, they will have to give me my money back. Just in case Nationstar try to say that one of the payments that are posted on that statement is the payment that I 'm disputing. I need to add that I made 2 payments XX/XX/XXXX in the same amount of the check that I 'm disputing. The account was current at the time that I sent in that payment that I 'm disputing, therefor there is no if and or buts it should be posted.

Consumer Complaint: Wrongful Foreclosure was initiated by Nation Star Mortgage and XXXX XXXX XXXX XXXX XXXX by recording a Notice of Default To Sell under Deed of Trust. The Lender, Trustee failed to follow State of Nevada statutory requirements or procedures in good faith. The Lender, Trustee did not notify or send any foreclosure documents of Notice of Default nor a foreclosure Mediation enrollment form by regular mail, registered mail or certified mail to the property owner, borrowers address, after the recording and mailing described above per Nevada legislative all homeowners in default " SHALL '' be notified and become eligible for the Mediation program with proper notice. Lender, Trustee is using their shady deceptive aggressive debt collection tactics of non-compliance with notifications to illegally foreclose. Section XXXX thru XXXX of the Nevada Revised Statues specifies procedures that must be followed for non-judicial foreclosures. A Lender, Trustee sale may be set aside for lack of substantial compliance with any of the requirements of XXXX Nev. Re. Stat. XXXX ( XXXX ) ( a ) ( b ) ( c ), damages may be awarded if the foreclosing party has failed to comply with specified waiting periods or with notice and recording requirements specified in XXXX, were improper. Borrower has had previous mediation 's over the years and was issued from the State of Nevada Supreme Court Foreclosure Mediation Program a Certificate of No Foreclosure, Will Be Issued for the property, every time we went to mediation. Lender, Trustee never recorded a Rescission of Declaration of Default and demand for sale notice. Lender, Trustee is constantly and consistently recording Notice of Default to Sell Under Deed of Trust and Affidavit of Authority to exercise the power of sale is erroneous, false, fictitious, and fraudulent documents. There is suspected Robo-Signed assignments and documents via XXXX, XXXX, XXXX , XXXX, etc.. Who have literally destroyed the entire financial banking industry with their bogus fraudulent assignments. Thus recording requirements were not met. We have spoken with and have email correspondence with XXXX, who has stated they do not own the loan and have no say in any disposition of the loan or modifications. Loan Modifications were denied ( 6 ) times over the years. The Lender, Trustee, beneficiary have no standing, nor is the correct party in interest to seek or bring a foreclosure action. The reason they have lost at mediations. They have no authority to enforce any loan if any exist, due to Breach of Contract. This foreclosure is initiated after the Statue of Limitations has expired seven years in Nevada XXXX XXXX.The Lender, Trustee claim is invalid and not entitled to foreclose. They have clouded the owners, grantors Chain of Title by repeatedly recording a wrongful Notice of Default and Election to Sell Under the Deed of Trust. Requesting SANCTIONS against Nation Star Mortgage and XXXX XXXX XXXX XXXX XXXX. XXXX XXXX ( XXXX ) ( XXXX ), for unfair lending practices.

Consumer Complaint: Nationstar Mortgage is running a foreclosure scam. They ran an escrow analysis in XXXX 2015 with an annual tax amount that was almost XXXX my actual tax bill. My county treasurer has contacted them on several occasions in writing via fax, etc including a 3 way call while I was on the line to correct this amount. The escrow department at Nationstar has assured me several times that he problem will be solved within 5-7 business days. Meanwhile, they call me constantly at work on my celular phone with an automated dialer and with an automated message to tell me that my account is delinquent. I make payments every month, but can not afford to continue making double payments due to their escrow error. They are also reporting to the credit bureau that I am delinquent and therefore I can not acheive refinance with any other company. They are now sending foreclosure notices. When I call to speak with the escrow department, they repeatedly place me on hold and then disconnect me after over 30 minutes on hold.

Consumer Complaint: I have been in a XXXX Short Sale review since last XXXX 2015. I unfortunately had to request a short sale as the modification payment coupled with loss of income made it necessary to sell our home. I received an offer on our home in XXXX of 2015 for $ XXXX, and it was submitted to the bank. Then we received notice that we had to sell via an online bidding with Nationstar. The bidding pricing range was $ XXXX to $ XXXX This occurred on XXXX/XXXX/2015. This process was supposed to have been done to expedite and ensure the home was sold at market value. Another reason we did not get as much traffic was because a lot of buyers did not want to pay for the 5 % buyers premium added to the purchase price. So in XXXX a bid offer was accepted bumping the offer we received in XXXX. Per XXXX guidelines we are supposed to have been given a reply within 30 days. We are now in XXXX and we are still waiting for approval. It has been about 2 1/2 weeks now that we have been waiting for PMI approval. How does this make sense to have the bidding to expedite the process and we are still waiting for an approval. From what I also understand, we should have received a Short Sale Notice, but we have not. I also have people coming to the house saying we are going into foreclosure sale because the foreclosure sale notice is published. This is very stressful and this is why with these lengthy processes and delays we lose buyers or as a homeowner we are mortified by the looming prospect of having our home foreclosed. Again, if the original offer was within the range, why did n't the bank just accept instead of accepting a higher bid, and then having to lower it? With such a long delay, it also makes it difficult to search for a new home to rent because we ca n't really commit and leave the home vacant. All of these situations make it for a very stressful way to live which also causes health concerns. Please assist us in expediting the process so that we may have a dignified closing.
