Consumer Complaint: We submitted a short sale request to XXXX and the short sale was approved on XXXX/XXXX/2016. The approval was good until XXXX/XXXX/2016 but we were told to close by XXXX/XXXX/2016 ( a Sunday ) or the loan would be service transferred. We submitted the recorded documents to XXXX on Monday XX/XX/XXXX2016 as is required and was told that the loan had been serviced transferred on Tuesday XXXX/XXXX/2016 AFTER XXXX had received the funds and the recording documents. The representative let us know that they had sent the short sale funds as well as all related documents to Nationstar. ( Final XXXX & XXXX XXXX Deed attached ) We contacted Nationstar and was told that we would have to wait until the loan had been " boarded '' before they could let us know the disposition. In the meantime, I had moved out of my property on XXXX XXXX, 2016 as required by the purchase contract. Nationstar has received the short sale funds and my realtor has been in contact with them and has sent them every document that they have requested. On XXXX XXXX, 2016 we received an approval letter from Nationstar with a request to have additional paperwork signed and notarized. ( attached ) These documents were immediately sent back to Nationstar that afternoon. As of yesterday my Realtor was told that the file was in the closing department and we should have word that day. My Realtor has been calling and emailing all day and there has been no response from Nationstar. The transaction closed on XX/XX/XXXX,2016 and XXXX service transferred this loan even though they were aware that we were closing. Nationstar has in its possession the short sale agreement, the recording documents and the money. This is unfair! I am living in a motel because I ca n't move forward until this transaction is finished. I need help with Nationstar, they gave their short sale approval but are making us wait for a transaction completion letter. HELP!

Consumer Complaint: My father died. I am the XXXX of his estate. I was told by the primary mortgage company ( Nationstar ) that if we did a Deed in Lieu of Foreclosure they would negotiate with the second mortgage ( XXXX ) on my Dad 's home so that it could be taken back on the Deed in Lieu. I was also told it would take XXXX days to complete. I sent in the paperwork. I waited. I called about a half a dozen times over a XXXX month period and left messages with the person who was suppose to be in charge of the account XXXX XXXX person 's name was XXXX, and I can not remember the other name XXXX. I did not get a call back. After XXXX months I got a letter in the mail stating that the Deed in XXXX had been denied for " Non-response from borrower ''. I called again and spoke with someone in the same department as XXXX, which I thought was the Deed in XXXX department since they sent a letter stating she was my account representative. They told me to refill out the paperwork I had already submitted. I asked why it was denied and was told that it looked like they needed additional paperwork. I asked why that was not sent or no one tried to call to request that paperwork since they had my phone number, mailing address, and email address. The man I was talking with said that he did not know why contact was not attempted, but I needed to fill that out and get it back to them. The next day someone from the department that tries to stop foreclosures called me. I told them I was working with the Deed in XXXX department and was getting paperwork together. He said that I did not need any of the additional paperwork, but needed to fill out the original paperwork that I had already submitted. So I did that. I called back a day or XXXX later ( Still thinking that XXXX is my Deed in Lieu contact since I have never gotten anything with anyone else 's name on it or a call from anyone else ) to check on my Deed in Lieu. I was told by a man named XXXX that it was denied because XXXX refused to negotiate with Nationstar. He also said - for the first time from anyone at Nationstar - that I was responsible for negotiating with XXXX myself. I had never head that from Nationstar before, and I knew XXXX was perfectly happy to negotiate. I called my contact at XXXX, XXXX. He said that Nationstar had not called him and that he needed paperwork stating that Nationstar was the first servicer and was considering a Deed in XXXX. I called Nationstar back and was told by someone named XXXX XXXX in the Deed in XXXX department ) that he would not provide anything for me, and I needed to negotiate on my own. After sometime on the phone I asked if he would speak with XXXX while I was on the phone. He said yes, if I could get them both on the phone at once. I was standing in Target when he called me so I did not have XXXX 's number to call him then. I called XXXX when getting home and tried back XXXX. XXXX and I left him a message. I have not heard back from XXXX since. He did send an email showing the lien and a judgement on the house that he said I would need to have removed. He also freely admitted that he never tried to call me through any of the Deed in XXXX proceedings and that he had only tried to contact my XXXX dead ) father. I asked why when they had had his death certificate, my administratrix documents, and all of my contact information for well over a year. He could not give me an explanation. It has been frustrating to get misinformation at EVERY call with Nationstar. I have been trying in good faith to let them know that there is no money in the estate and have done everything they have asked to get this deed in lieu done. I even sent them the key to the house and a letter with XXXX potential buyers for the property.

Consumer Complaint: My original mortgage was with XXXX bank. In XXXX, rec 'd my annual escrow statement indicating I have shortage. If I paid the shortage in full, my new mortgage would {$1600.00}. I paid the escrow shortage of {$530.00} in full. The payment was rec 'd and posted to my account n XXXX XXXX. XXXX XXXX, I rec 'd a letter from XXXX telling me my mortgage was reassigned to Nationstar Mortgage as of XXXX XXXX, XXXX. I never rec 'd a statement from Nationstar for the XXXX mortgage but I proceeded to send a check for {$1700.00} to Nationstar.LateXXXX, I rec 'd a statement from Nationstar stating my XXXX mortgage payment would be {$1700.00} because I failed to pay the full mortgage amount in XXXX which was {$1700.00}. I called Naionstar on XXXX XXXX and was told they did not have the escrow amount I paid in their system. They would do an account analysis and call me back. I called XXXX the same day to confirm the payment and the new monthly amount of {$1600.00}. They also sent me a payment history showing the receipt and posting of the escrow. I contacted FTC on XXXX XXXX and they recommend that I file a complaint online. The file # is XXXX XXXX XXXX, I rec 'd a call from Nationstar rep XXXX XXXX XXXX XXXX who stated after reviewing my account they notice I have a surplus of {$380.00} in my escrow. A check for {$380.00} will be sent to me. Then she explained that Nationstar recacluated my " predicted escrow for XXXX '' and my new mortgage amount should be {$1700.00}. They anticipate my taxes and insurance will increase. I asked why are they sending me a check for {$380.00} if they anticipate my escrow will increase? XXXX stated she does not know why they are sending me a check. She offered me an option to lower my mortgage but would need my approval. When I asked her what the option was, she stated she can not tell me until I authorize the change. I asked for the option in writing and was told, she ca n't unless I authorize the option but what she would send me is an account statement. Later I called Nationstar and spoke with XXXX XXXX in the escrow dept. She explained why my mortgage is being increased again. She emailed me a copy of the account statement for new mortgage amount of {$1700.00}. At this point, I said I would review the statement and likely pay the new mortgage amount of {$1700.00}. XXXX then told me I have a balance due from XXXX and XXXX because I did not make a payment for {$1700.00}. I paid {$1700.00} in XXXX and {$1600.00} ( what it should have been ) in XXXX. I was never informed prior to XXXX XXXX that my mortgage was going from {$1600.00} to {$1700.00}. Later I checked the web and found a site called Nationstar Complaints. The stories that is on the web site mentions how Nationstar uses small excuses to foreclose on properties. There are over XXXX complaints and each XXXX states the same ; how Nationstar increase their mortgage with no prior notification and when the mortgage owners fail to pay the balance due, they would not accept any mortgage payments from them. After a few month, the property would go into foreclosure. I plan to monitor my statement very carefully for the next two years ( that is all I have left on my mortgage ) and considering getting a Home Equity Line of Credit so I can pay this mortgage. I do not plan on losing my house nor end up with the same problem as others. But I feel that Nationstar Mortgage should be investigate for mortgage fraud and unscrupulous actions.

Consumer Complaint: On XXXX XXXX, 2016, I mailed Registered Mail ( # XXXX ) to Nationstar Mortgage and it was received and sign for on XXXX XXXX, by XXXX XXXX XXXX. A STATE CERTIFIED BOND ASSIGNMENT was enclosed for the amount {$230000.00} to payoff the loan, with the payoff statement. Nationstar Mortgage acknowledged that payment was received and the account was never credited and closed. Nationstar Mortgage have not sent my Bond Payment back to me, the account should have been adjusted to SATISFACTION IN FULL., to this day, it is not. I would like to have my money back or adjust the account and closed it. UCC XXXX, states if a tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument and the tender is refused, the debt is discharged. Please investigate, there is some fraud taking place.

Consumer Complaint: My husband and I closed on our home/VA Loan XX/XX/XXXX and paid our required funding fee of {$3400.00}. His Veteran XXXX claim was still pending at that time but was approved shortly after our closing date, at XXXX. This level of XXXX constitutes waiver of the funding fee and because his XXXX claim was opened and in process prior to our loan closing, we are entitled to a refund of the funding fee. We began our process to obtain the refund XX/XX/XXXX. We have contacted our local VA Regional Office, our original lender, XXXX, and Nationstar Mortgage, the final servicer to which the loan was sold. Research case XXXX was opened with Nationstar. The XXXX Regional VA office has repeatedly told us the lender must submit for the refund via a secure gov't website. Nationstar has repeatedly told us to reach out to the VA to obtain the refund. After countless phone calls and hours spent on hold with the VA and our lender, I was told to send Nationstar our Settlement Statement for the home loan showing the {$3400.00} funding fee payment as well as the VA Benefits Summary/Certificate of Eligibility. I again faxed this under the cover of XXXX and also emailed their research dept. I received response on XX/XX/XXXX from their research dept, that we were to contact the VA Office-the same incorrect response they have given multiple times. I responded to this email with detailed instructions and the link to the FAQs regarding the process that I was able to find online ( XXXX ) clearly asking them to reference Sections XXXX and XXXX for the request process to be followed by lenders and Section I which discusses how a lender can register their lender ID in the system, get their PIN, etc. if that company is not already registered. This is the process they need to use to request our funding fee refund be paid to them by the VA at which point they can apply it to our principal. I then received another response from the Research Dept on XX/XX/XXXX in which they asked me to reference their prior response on XX/XX/XXXX-that we needed to contact the VA for the refund. As the link above clearly shows, the veteran does not request the refund. It must be done by the lender because it was paid as part of our loan closing.

Consumer Complaint: I am working with the borrower on a short sale with Nationstar Mortgage. The lender is pushing the short sale into an auction site called XXXX but utilizing this site has been very stressful for the seller. He is an elderly man with health issues, he and his family have been continuously harassed by people, brokers and lawyers but Nationstar refused to bypass the auction. There is already a buyer involved and there is a legitimate offer on the table which we are trying to have reviewed. This auction site is very inconvenient and is technically not an investor guideline to review short sales.

Consumer Complaint: XXXX sold my loan to Nationstar while I was in a modification. After 5 years, as per mod agreements, interest rate was to go from3 % to 4 % for a year, then 4.5 % until term. The payments at 4 % would be too much for me because of lost income and other events. XX/XX/XXXX I applied for another modification with Nationstar. It was approved, but I would n't know the terms until finished with the trial payments. Every month or so I will be assigned a new " loan specialist '' to help with my issues, but to date, never once spoke to the person assigned to me. every phone call I made meant I had to start over and every person I spoke with offered a different version. I was told by Nationstar staff not to worry about XX/XX/XXXX payment of {$5200.00}, to start XX/XX/XXXX with the trial payment of {$3600.00}. I paid on time all the 3 trial payments. Before that, I had never been late. XX/XX/XXXX, I was reported delinquent to the credit bureaux. My credit score went from XXXX to XXXX. I contacted Nationstar. They retracted it but never sent me documentation. Some of their staff told me they did n't report me. But again they reported me XX/XX/XXXX. My 2nd issue, I have n't been able to sign the mod agreement because they added my husband 's name to the loan. We are not legally divorced, but his name has never been on the mortgage and I am unable to locate him. I 've always held the mortgage alone and prior mod with XXXX had not been an issue. His name is on the deed. I was told by Nationstar it has to do with regulations from the town I reside in ( XXXX XXXX XXXX , NY ) I went to the town and was told that is not so. Any insight on this issue? All alone the 've been dealing with me and me alone. My credit score now is so low that I can ' even think of refinancing, because I do n't think Nationstar deserves my business. Also, the new terms of the loan is for 40 years when I only had 10 years left. I am XXXX now. I ca n't get them to write that there will be no pre payment penalty. I feel so lost now.
