Consumer Complaint: On XX/XX/XXXX I contacted National Credit Systems in regards to balance against my credit due I did not receive any notification validating the debt. I don't understand how I could be owing a debt of a place I did not stay and I would not owe a debt to any place I live at due to at the time I had section 8 housing where the housing authority paid 100 % of my rent. There is a difference of filling out an application for a place of residency and actually moving in. Even if you signed a lease but never took legal ownership of the place of residency due to finding another place else where then how could this be a debt that I owe. I have reached out to national credit system due to them not sending validation Statements in which if they did it was sent to the wrong address. Also in XX/XX/XXXX I called and spoke to XXXX rep and advised that they are not able to call me due to the cease letters sent to them and the fact that they are placing a debt on my credit report they are not the original creditor in which they are violating FCRA laws. Also on XX/XX/XXXX after I had the 3 bureaus sent a validation letter to national credit system they sent a debt postcard and also they placed an embarrassing stamp on note on a letter they sent. It also included publishing my name on a bad debt list which was not fair without proper validation sent.

Consumer Complaint: They do not have a legal contract with me. In the US law encyclopedia, American Jurisprudence, 73 Am Jur 2d. Sections 90-93 ; it says that one can not subrogate onto a contract that they were not originally on, did not have any interest to protect, and then claim successor in rights and interests. Thus, when an original credit sells the debt, they give up their rights to collect on the debt, BUT they do not give those same rights to the collection agency. The collection agency can not act as a substitute for the original creditor. Therefore they keep trying to collect a debt which is not theirs. They have nothing stating that this is there debt. Attempt of validation is not valid. They are not on the orginal contract. I did not receive validation.

When XXXX sold the debt they gave up their rights to collect on said debt, but they did not and can not give away those same rights to ANY collection agencies. Consumer Complaint: This is a complaint from my wife and I against National Credit Systems for their failure to provide requested information for alleged debt. National Credit Systems ( NCS ) has been reporting two open accounts against me ( {$3100.00} acct # XXXX & {$500.00} acct # XXXX ) and one for my wife ( {$3100.00} acct # XXXX ) that we do not recognize. NCS sent written notification of debt recovery based on initial 30 day validation on XX/XX/XXXX. On XX/XX/XXXX I responded ( based on legal advise ) with a written request for documentation, including the following : 1. debt amount clarification ( including fees and interest added ) ; 2. Name of creditor owed and notice of assignment or receipt of sale to 3rd party collection ; 3. Verification or copy of any judgment ; 4. Proof that you are licensed to collect this debt in Texas ; 5. Proof of last payment made on the account and any other documentation which tend to show validity. 6. If they do not own the debt I demand they send the request to the original creditor so they are aware. On XX/XX/XXXX I was contacted at my place of employment by NCS 's rep. and I informed them that no calls are acceptable please respond to me in writing. NCS called me at home and I asked for all calls to stop but NCS reps. continued to call my place of employment 2 other times in XX/XX/XXXX following my validation request. I again expressed that they should contact me in writing. On XX/XX/XXXX I reviewed my Credit report and noticed NCS had reported inaccurate information on both of our credit reports before validation. I received mail on XX/XX/XXXX from a old address, of NCS partial response to my XX/XX/XXXX validation request. NCS responded providing partial documents from original creditor and no verification that they own the debt or that it was transferred to them. No verification of break down of debt amount balance or accounting of payments. No proof of NCS license to collect debts in Texas. NCS 's failure to respond to a consumer 's good faith request for documentation makes it impossible for me to make an informed decision regarding alleged debt. This is a violation of USC 1692, and other federal acts which require lenders and debt collectors to act in good faith and refrain from unfair deceptive or abusive acts. Also, to have already reported alleged debt to any credit reporting agency or credit bureau, prior to validating the debt violates Fair Credit Reporting Act ( as stated in my XX/XX/XXXX validation request.
