Consumer Complaint: On XX/XX/2019 at XXXX I was contacted by a XXXX man named XXXX claiming to be part of National Credit Systems , Inc . He told me some information about me like the last four of my SSN, my car make and color, my security deposit amount at my previous apartment, and my previous address. He then said I had an outstanding balance of {$890.00} still owed to my apartment complex I had moved out of at the end of XXXX. I had settled this balance with my apartment company previously and my check for the amount he stated minus deductions made by the apartment manager had been cashed already. The man tried to get me to give my credit card information over the phone to pay for my outstanding debt, which would supposedly help me avoid a hit on my credit report. After hanging up and calling my former landlord, I have no outstanding debt to them and they reported to me they never filed for collections or bad credit against me.

Consumer Complaint: I have been moved from XXXX XXXX for 7 months now. Lease ended XXXX of XXXX. In XXXX I had already moved on to new apartments and never heard anything back about a deposit or anything. I contacted the assistant manager of the complex and asked about my deposit and I was assured that I would receive something back in 45 days and never heard anything back so I let it go although Florida law states the consumer has 60 days to get their deposit back or at least notification of why they are not. All bills were paid before moving out and a cashier 's check was given to cover the last month 's rent since it showing the wrong amount in the payment portal. So there should have been a balance of XXXX. 6 months later, at the end of XXXX around the XXXX, this year I get a notification from XXXX XXXX that I have been put into collections through National Credit Systems by XXXX XXXX for XXXX dollars. Never received any notice of any payments owed or anything about me about to be put in collections by this agency also. My credit took a 79 point drop and I have never had any derogatory marks or problems in the past or problems fulfilling payments. I filed disputes with both XXXX and XXXX and they claim the dispute was closed because this National Credit System company proved that I was me ( Which was never an issue ) and that they supposedly proved they sent me something ( Never received any mail from them or phone calls ) ; so I assume they typed up documentation and sent it to the credit bureaus with false information that never made it's way to me. I have evidence of them lying about a date which I will attach later and have edited out address to cover personal info as prompted in case this is posted. After getting this result I spoke with an XXXX representative who then suggested me to contact the company which I didn't understand why because this company is trying to get money from people so of course they would not work with me. I tried to contact them on XX/XX/XXXX but they were closed so I called on XX/XX/XXXX and left a message and then received a call back from a manager who then transferred me to a representative ( XXXX XXXX ). I explained the situation about how I never even received notification of this supposed debt from the apartments or the collection agency and I do not agree with these charges or collection. She spoke with attitude and said that they sent me something in the mail and called me. She then read me my address and phone number and I was able to confirm that information was correct so there should have been no problems with me receiving it if they sent it. She then proceeded to tell me that I could just take them to court to solve it or basically pay the balance. She also asked me if I wanted to be sent the notice in the mail and I told her she could send it if she wanted to but it still was never sent to me prior nor was I notified by phone and I said that my XXXX XXXX calls and records can be pulled if needed to prove they never called me. ( If they called me like they are claiming they could have even left a voicemail to prove ) Yesterday on XX/XX/XXXX the same day all of this conversation happened I receive the expedited letter in the mail. It is evident that this was sent to cover the collection company 's behind because the date on the letter was changed to XX/XX/XXXX which I don't understand why that date would matter as it has no significance to the issue and still does not meet the 60 day mark addressed in the Florida law. i have been wrongfully put into collections and was not even given the opportunity to know beforehand or dispute with the company and then when I tried to address the issue with the company I get met with disrespect, deception, and attitude.

The company refuses to take this off my report even though I do have a receipt in hand from my apartment complex showing I did pay the specified amount of {$260.00} on Move Out. This should have never been put on my credit report, and having an receipt should be enough to remove the collection from my report.

They have had change in managers and director the last two years i was there due to money stealing and bad conduct. I also went to XXXX XXXX spoke with agent who stated she was able to confirm debt due to nothing in system for damages and rent was owe from previous year for two months. I stated if i owe balance which is back rent and no pymt plan was set up and if so why would renew lease and i would be able to stay months after to a current year. I also seen reapir man that showed me apartment and nothing has changed or damaged and i sent thise pictuse to national credit ms . XXXX. Second my son was pick up on mistaken identity and lock up. Just finish school and worked at XXXX XXXX was gone for two weeks. They put camera to monitor area and would give police taoe to show my son just walking into complex at time of crime and nowhere by crime. Someone was killed outside my door. also they gave letter stating how they was gone rebuild patking area and we would have to relocate.. So i moved my family. I have been gone over 2 years why wouldnt if owe i should have been notified sooner. But in order for me to move in home im in i had a walk through so they can see how you live. If that didnt pass and damage of property i would be in home im in now.

Consumer Complaint: Summary : XXXX XXXX ( my former Landlord ) and National Credit Systems ( a collections agency ) are falsely reporting to the credit reporting agencies that I owe a balance of {$10000.00} I have disputed this allegation to XXXX XXXX, National Credit Systems, and the Law Office of XXXX XXXX XXXX ( a second collections agency hired by XXXX XXXX ) but my dispute has been ignored. I also disputed this false debt with XXXX who deleted this collections account in its entirety from my XXXX credit report following an investigation based on the materials I provided to them. XXXX and XXXX have refused to conduct an independent investigation, instead they are relying on the false claims of XXXX XXXX and its agents. Full Account : I do not owe any amount to XXXX XXXX, the original creditor on this collections account and my former landlord. By way of background, XXXX XXXX and I entered into a lease agreement with XXXX XXXX on XX/XX/XXXX ( Lease Contract ) for the rental of a two-bedroom apartment in downtown XXXX XXXX, CA. In XXXX XXXX, XXXX XXXX breached a material provision of the Lease Contract by unilaterally reclaiming one of our expressly contracted-for parking spots during the lease period. We informed XXXX XXXX management, in writing, that its decision was in violation of the terms of the parties Lease Contract, but to no avail. In the face of this wrongful conduct, which under the circumstances had a significant and adverse impact on our rights and personal security, we made the decision to make other housing arrangements. We provided 30-days written notice of our intent to vacate the premises, and we vacated the premises in accordance with our legal obligations on XX/XX/XXXX. We satisfied all of our rent and related financial obligations through the move-out date, as acknowledged by XXXX XXXX in its final move out statement. What National Credit Systems/XXXX XXXX refer to in the credit reporting as the balance owed is the remaining amount of a 2 month concession return, such concession being a one-time credit off of the rent, which they claim is recoverable under the terms of the Lease Contract. This claim has never been substantiated and is totally bogus for several reasons. First, the return of the concession credit, extended to XXXX XXXX and me as an inducement to enter into the Lease Contract for the two-bedroom unit, is not owed to XXXX XXXX because it breached the Lease Contract by unilaterally, and over our objection, taking back one of the two parking spots we expressly negotiated for and then reduced to writing in a written addendum to the Lease Contract. XXXX XXXX can not void or unduly restrict our bargained-for rights under the Lease Contract by reclaiming a parking spot, and then effectively demand that we stay and pay rent through the entirety of the lease term or leave subject to the threat of claims for damages and penalties, as well as intimidation through the false claims published to third party creditors by means of your credit agency. Second, the language of the Lease Contract itself undercuts National Credit Systems/XXXX position that it has any legal right to the return of a past rent concession. Paragraph 31, under the heading Default by Resident states, in pertinent part, If you default and move out early, you will pay us any amounts stated to be rental discounts in paragraph 10, in addition to other sums due. However, we did not default ( as previously explained ) and paragraph 10 of the Lease Contract is totally silent on this particular issue. The Lease Addendum for Rent Concession or Other Rent Discount, attached to the Lease Contract, does not extend to XXXX any broader rights to recoup the value of the concession credit. We have repeatedly notified XXXX XXXX and its agents that we do not owe them any amount and have supplied the bases for such position, but that, to the contrary, they are unlawfully withholding part of our security deposit for the apartment. Besides ignoring our supplied bases and our requests that they return the money they owe us, we have received nothing more than threats to our financial security if their demands are not met. National Credit Systems, the collection agency, has ignored my communications and ignored their requirement to provide proof of debt validation under the Federal Debt Collection Practices Act ( FDCPA ). In early XX/XX/XXXX, I received my first letter from National Credit Systems, demanding that I pay the amount of {$10000.00} without any explanation of the amount owed. This amount is greater than the prior itemized amounts provided by XXXX XXXX and its principal XXXX. I contacted National Credit Systems by phone on XX/XX/XXXX to explain that I do not owe any amount. Following that phone call, I mailed a certified letter to National Credit Systems providing written notification that I dispute the entirety of the alleged amount owed. National Credit XXXX received my letter on XX/XX/XXXX and proceeded to ignore my letter, reported my account to the credit bureaus, and continued sending me additional letters demanding payment, all in violation of their FDCPA requirement to cease collection of the debt until they obtain a verification of the debt or a copy of the judgment ( which does not exist ) and mail me a copy of such verification or judgment.
