Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: In XX/XX/XXXX, I requested proof of debt responsibility from the company National Credit Systems via phone. I requested to obtain original papers signed by myself that I owe a company called National Credit Systems or any affiliates and 3rd parties. National Credit Systems sent me papers via USPS that are visibly scanned and copied papers. According to the Law, copies are not sufficient proof that I am responsible for this debt or that I am responsible for this debt. To conclude, National Credit Systems will not provide to me original paperwork, signed by me. In addition, " National Credit Systems '' continues to reappear on my credit as a " new account '' every year, for the last 6 consecutive years. Collection agent from National Credit Systems, Miss XXXX, stated to me via phone in XXXX XXXX, that the removal time frame starts over when a debt is transferred and or sold to a new collection agency as well as after any and all disputes for this collection account made by me or any person 's. Miss XXXX stated via phone, this debt will remain on my ( XXXX XXXX ) credit report " forever '', and keep starting over as if it were from day # 1. National Credit Systems originally appeared on my credit as a debt from XX/XX/XXXX, in the beginning of XX/XX/XXXX. Over the years, the dates have changed many times as to when the account was originally opened .Currently my credit report States ( beneath the name National Credit Systems ) " opened '' XX/XX/XXXX. All of it seems invalid and not sufficient to be on my credit or that I am in fact responsible for this debt of {$4200.00} to National Credit Systems or their affiliates. Miss XXXX stated that her computer shows I am responsible for a debt of {$4700.00} but on my credit it states a different amount in which does not make any financial sense.

Issue: Took or threatened to take negative or legal action

Subissue: Threatened or suggested your credit would be damaged

Consumer Complaint: I and my family stayed at the XXXX at XXXX XXXX apartment at XXXX ( currently named as XXXX XXXX at XXXX with address - XXXX XXXX XXXX, XXXX, XXXX ) for around a year until XX/XX/2017. Throughout our stay, there were many maintenance issues and the management did not fix many of them. The reason given was - non-availability of contractors, could not be fixed and they don't want to spend on a unit that they are planning to renovate completely. We repeatedly complained and moved out since it was not bearable. The apartment management agreed for an early release ( 15 days before lease end period ) and the move-out notice clearly states that we are moving out due to maintenance issues. I have attached the following documents that prove the above-mentioned facts Move-Out-Notice : Clearly stating the apartment management agreeing to allow us to move our earlier than the lease end period since the maintenance issue can not be fixed Signed by XXXX XXXX XXXX representing the apartment management e-mail correspondence with apartment management that mentions the maintenance issues and the fact that they were not fixing. Move-Out statement : To show that the amount demanded by the apartment management and the collection agency ( NCS ) is not the same. The apartment management sent a demand notice claiming the unresolved maintenance issues as damages. We responded thru our attorney with the above facts for the demand notice sent by the apartment management. We were ready to pay the utilities bill that was legitimate. However, the apartment management did not respond and transferred our account to collection agency National Credit Systems ( NCS ). NCS communicated with us and demanded a sum that is more than what was demanded by apartment management ( the apartment management demanded {$1500.00} while NCS demanded {$2300.00} ). NCS did not go the legal route and opted to damage our credit report presumably because of the strong evidence we have against the apartment management. Our effort to negotiate with NCS for a reasonable settlement were not accepted by NCS.

Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: I have been trying to work with National Credit Systems for months now in regard to a property debt with XXXX XXXX. The amount is {$4400.00}. I have specifically worked with XXXX, ( Main representative ) XXXX ( Supervisor ) and been forwarded to two of the " managers '' XXXX and XXXX. Unfortunately, I have had a terrible experience working with National Credit Systems. I began working with them in late XXXX, early XXXX to resolve the alleged account with them. My first step to resolving this account was to ask them if I could settle. I asked if they could please ask the account holder if we could settle with that amount of {$1800.00}. XXXX immediately responded, " NO! '' " Our client would not take that amount, I know it. '' She refused to allow me to ask for the settlement. So, I asked for a copy of whatever evidence was provided to open this account. The shreds of evidence provided were a lease and a handwritten move-out inspection form with a bunch of random charges on it. There were many discrepancies on the form and I had opposing evidence to prove it was not correct. During this time : XXXX would also tell me the documented evidence would be sent and it, in fact, wouldn't be. I would call in weekly to let them know I did not receive any documents from them. These weekly calls would be fruitless and XXXX would keep me on the phone for an estimated 45-1.3 hours. Both times requested, the " evidence '' was sent over a month later and both times, the same documents were sent. ( Lease and Move-out form ) I also asked who the account holder was so I could do my own research and hopefully, a resolution. National Credit Systems told me the XXXX account was under XXXX XXXX XXXX. I called XXXX XXXX XXXX and spoke with the regional account manager, XXXX. She assured me that the account was not active. And explained XXXX was removed as the property management company when XXXX XXXX purchased XXXX. She also let me know that XXXX assumed all of the debts against XXXX and paid all accounts. I then contacted XXXX XXXX just in case they could help me resolve the account and spoke with the regional manager, XXXX. XXXX explained the XXXX XXXX was purchased and that XXXX had also purchased and closed all of XXXX 's previous debts. Everything prior to the XXXX 's purchase was done and gone. There is not even any record of previous tenants, she said. ( I left the unit in XXXX. XXXX purchased XXXX in XX/XX/XXXX ) I called to let National Credit Systems and informed them of what I have learned. I also asked that they please put the account in dispute because the account is paid and closed according to XXXX XXXX XXXX and the new XXXX owners, XXXX XXXX. After clueless debates over the information I just presented, XXXX and XXXX agreed they would put the account in dispute. But when I contacted the credit bureau to ensure it infact was, I was told the account was not in dispute. My most recent attempts to communicate and come to a resolution with National Credit Systems have become even more cringe-worthy than before. When I told them that the credit bureaus said the account was not in dispute, XXXX became very heated. She told me they have to finish their investigation to see who owns the debt. She said that XXXX has not been responding to them but, they can't close it and remove it off my record until they find out who owns the debt. When probed how long the investigation could take, XXXX said " 2 months, 4 months, maybe 12 we don't know. '' I asked how they perform an investigation and she said she does not know. I have been trying to get this resolved for months now and I am unable to rent due to this property charge! I want this account removed from my credit. It was a fraudulent charge with no evidence or proof from the beginning and the account has since been paid and closed.

Issue: Written notification about debt

Subissue: Didn't receive notice of right to dispute

Consumer Complaint: Received a letter from XXXX XXXX XXXX in XX/XX/XXXX regarding an invoice stating we owed money. Contacted the company immediately upon receipt and was told by them they they did not have to provide any information to validate debt ( which they have to provide under the FDCPA ). I disputed the debt as I didn't know what it was for. I have made several attempts over the last two years to have this removed and company refuses to do so, despite not wanting to follow the law regarding debt collection practices. I pulled my credit report this year, and noticed that the debt had been sold to a debt collector National Credit Systems in XX/XX/XXXX. Despite them accruing the debt at that time, I have not received any letter from them to verify the debt. I attempted to dispute the debt through CRA due to the failure to provide proof of validation of the debt and they continue to fight it, but also refuse to follow the law.
