Consumer Complaint: This company ( national credit system ) which I hold No Contract with nor have received services from is a 3rd party agency who has no right to collect anything from the alleged debtor since there is no way they can prove they were on any original contract. 73 Amjur, 2nd, Section 90. You have no right to subrogate ( substitute ) yourself into a contract. Whether it be by purchase, assignment, transfer, or trade. If you bought the debt you did it on your own behalf. Not at the request of any alleged debtor, and therefore are a stranger to the transaction ( voluntary payee ). Reporting of this debt is a violation of the FCRA and the FDCPA. Ive conducted some research on this company and in the state of Arizona this company is not Licensed, Bonded, and does not have a Certificate of Authority to collect in the state of Arizona. This is against the state and federal laws. According to the FDCPA : Under the Act, a debt collector communicating with persons other than the consumer for the purpose of acquiring location information about the consumer shall not : use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt ; 28. The Arizona Department of Financial Institutions ( AZDFI ) is statutorily charged with the licensing, supervision and regulation of state-chartered financial institutions and enterprises. They are in Breach of Contract by violating the Arbitration Clause. Once a company charges off the account and sends it to a collection company they are in breach of their own contract. This is against the FCRA.

Consumer Complaint: i signed a year lease with XXXX property management company i began having issues with the house i lived in i advised the rental company several times of the issues. 1st issue was the basement flooded do to a crack in the foundation of the house the property management company had several companies come out to get estimates to repair but no repair was done in a timely fashion the basement ended up flooding causing damage to my belongings i filed a insurance claim through my renters insurance they denied claim stating that flood damage was not covered but owners could possibly have coverage for that. I then contacted XXXX and informed them sent then denial from renters insurance and pictures of damaged items totaling around XXXX dollars. They then had maintenance come out in cheaply repair the wall. this happen in XXXX XXXX my second issue was the air conditioning unit going out in them not repairing it for over a month i have XXXX children that were in the house with me when temperature got almost 100 degrees outside. my 3rd issue was the mold growing in the basement where they were notified by the health department to make repairs within 30 days in they failed to do so. they company is trying to collect over XXXX dollars in back rent they say is owed to them but took my deposit were there is no where in the lease that says my deposit will be fortified for unpaid rent they should have applied it to the unpaid rent they say was owed. I then in XX/XX/XXXX get a call from a collection agency called national credit systems demanding money and being very rude and unprofessional every time they called i informed them of me having a attorney because a rent escrow case was filed before our lease was up and they still continued to call and advise me of debt owed. i need this debt to be removed from my credit and also the joint persons credit that is on the lease with me. i have tried to reach out to XXXX plenty of times and they are always given me the run around about why i was charged for XXXX rent when the lease ended XX/XX/XXXX and we moved out before XX/XX/XXXX.

Consumer Complaint: In XXXX my roommates and I found the property XXXX XXXX XXXX, managed by the company XXXX, online and as I am the only one of the four of us in the same state as the property I took two days and rented a hotel to see it in person. In order to view the apartment/townhome, we had to fill out a lease and put down the {$100.00} application fee as well as a {$350.00} deposit. When I arrived it was to find XXXX XXXX XXXX was not the clean and safe community advertised ; the streets were in disrepair, the garbage was overflowing onto the street and people 's possessions appeared to have been thrown out on the lawn. When we inspected the apartment itself not only was it outdated, there were cracks in windows and patio pavement, part of the stair railing missing, and old carpet in a filthy condition. As this was not at all what we'd been led to believe we were paying for I asked for our money returned. First with the community office, where they were very confrontational and when it became clear we could not reach an agreement I then contacted my credit card company to file a dispute. My credit card company refunded the money and XXXX agreed to send a check back. I informed the XXXX 's office multiple times that I would not open any mail or check addressed to the other three people on the lease as they do not live with me but the company sent a check addressed to the four of us to my address anyway., this was around XX/XX/XXXX. I sent it back. Recently, as of XXXX, I received a letter and three other letters addressed again to people who I'd informed the management at XXXX XXXX XXXX multiple times do not live with me. The letters were from a collection agency and the one addressed to me stated I owe XXXX XXXX XXXX {$400.00}. I can confirm they also requested the same amount from my potential roommates. After being promised a return of our money they are now requesting through a debt collecting company that we pay {$400.00} each ; and will damage our individual credit scores if not paid. I attempted to contact the debt collecting company, XXXX XXXX XXXX, and spoke with a representative who not only refused to transfer my call to a supervisor but hung up on me. I then attempted to call the Corporate Office for XXXX at XXXX and have yet to receive a call back after leaving a message about the situation. The application fee was {$100.00} if that is what they are requesting we pay, not {$400.00} each. I can only assume this is some sort of petty scam for extra money, the consequences of which are going to have a negative effect on my credit. I will also be contacting the XXXX XXXX XXXX on this matter.

Consumer Complaint: I disputed the apartment collection through the credit bureaus on XX/XX/XXXX, then again XX/XX/XXXX, plus I mailed NCS a debt verification letter, which was never answered? I do not believe the balance amount is correct. I asked for a itemized breakdown of all costs that add up to {$2900.00} Plus according to Ky. Rev. Stat. Ann. 383.670, I would like to know what steps were taken to re-rent the unit to limit my exposure to additional rent costs?
