Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: A collection agency, National Credit Systems, is attempting to collect a debt in the amount of {$5800.00}. This debt was originally from XXXX XXXX in XXXX XXXX, SC. due to damage to a property by way of vandalism caused by a 3rd party in XXXX of 2020. To my knowledge, no attempt to collect this debt was made by XXXX XXXX before moving it to National Credit Systems. I was unaware of this debt until late XX/XX/2020. I had requested a hold on the account as soon as I was made aware of it while I attempted to work things out with Northwoods Townhomes but was not granted this. I attempted to reason with National Credit Systems, XXXX XXXX and XXXX XXXX, who is the owner of the property, that this debt is not mine according to the lease agreement drafted and approved by Northwoods townhomes and XXXX XXXX According to paragraph 12 of the lease agreement I can not be held liable for the damages if I am not found to have been negligent, those that did the damage were a part of my household, invitees or guests, or am found guilty of the act myself. None of which had been the case. After explaining this to National Credit Systems and requesting validation of the debt I was informed by the agent taking my call that the only verification necessary for National Credit Systems to continue with the collection was that XXXX XXXX still considered the debt mine despite my legal claim to the contrary. This agent also threatened that a negative mark would be presented to the major credit reporting companies if I did not pay this debt on or about the the end of XX/XX/2020. In early XXXX I verified that this negative mark had been presented. I have written letters formally disputing this debt to National Credit Systems, XXXX XXXX and XXXX XXXXl. Each of these companies have respectively told me that it is not their concern, out of their hands or outright ignored my request.

Issue: Communication tactics

Subissue: Frequent or repeated calls

Consumer Complaint: My account manager was so rude. His name is XXXX. Every time he picked up the phone he was always huffy and puffy, literally answered like he was tired of being there. Ive only spoken to him 3x and EVERY single time I called he has always been so rude. He doesnt offer any solutions nor does he have any compassion, not asking for him to break the law- asking for him to care about the people he collects from seeing they he gets a piece of commission from the people that pay. Got ta get rid of this dude or do better at training- I would have paid in full a long time ago but XXXX ; the fact that I have to pay with him- knowing he gets commission off what I owe. Hope he enjoys it! Please reach out to XXXX from national credit system, super nice guy, definitely want to ask for him.

Consumer Complaint: National Credit Systems continues to report that I have an outstanding balance with XXXX XXXX XXXX on my credit report for {$1500.00}. I have explained to this collection agency that I have not lived at that community for well over 6 years, and when I did, I left on good terms. I was on a month-to-month lease, gave a 60-day notice, and left the apartment in immaculate condition. They even refunded my security deposit. So there is no way this debt exists. The apartment community no longer exists either. It was torn down and replaced with another community years ago. On repeated occasions, I have written to the collection agency, and asked them for a detailed representation of the {$1500.00} in charges they claim I owe. However, my countless attempts to acquire this information have been ignored.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: I disputed the collection account ( National Credit Systems Inc. ) with XX/XX/XXXX in XX/XX/XXXX whereas XX/XX/XXXX said the debt was valid. I disagreed and contacted the debt collector ( National Credit System Inc. ) directly in writing on XX/XX/2020 demanding and under Federal Law they had 30 days to validate the debt and provide me the supporting documents from the original creditor. The debt collector did not provide me any supporting documents to validate the debt after 30 days thus the debt is no longer valid and doesn't exist. I forwarded the written request and provided evidence and documents that the debt collector did not response and requested XX/XX/XXXX remove the item and they refused. Because this item is impacting my ability to find affordable housing its urgent it is removed.

Consumer Complaint: I signed a rental agreement from XX/XX/XXXX until XX/XX/XXXX. I had numerous issues with this company from having strange men that supposedly were there to spray for bugs just walk into my home without knocking or announcing themselves. When this happened I requested to have someone contact me from corporate which never happened at this time i made it very clear that I would not be signing another lease. In XXXX I went to the leasing office again explained My current landlord would be sending over a rental verification because I was not renewing the lease and could they fax it back This was on XX/XX/XXXX. My new landlord advised that she never received the verification so I went back to the leasing office gave the young lady that sits by the door the documentation stating I would be out by XX/XX/XXXX. She stated she would resend the verification to my new landlord but of course they did not I had to go back and forth to this leasing office until XX/XX/XXXX and stand in front of the woman that claims to be a manager but is extremely nasty and watch her fax it while I stayed on the phone with my new landlord. AT this time I advised and asked do I need to do anything else with yall to make sure im in good standing with you all. She said I was all set just turn in my key which I did on XX/XX/XXXX. Mind u I moved out on XX/XX/XXXX and also paid the rent that was owed. Maintenance and everyone in that office was aware I was moving. I have copies of documents provided to me by the apartment complex showing where all payments were up to date as well as my current bank statements. I never once signed a new lease and my rent was XXXX and that simply doesn't add up to over XXXX dollars owed to them not when i have proof they were paid out. On top of that I never got my security deposit back either. I was told by others in the building that XXXX XXXX XXXX will just continue billing u each month even when they should not be which is obvious in my case because there was no damage no stains on the floor no holes in the wall or anything just an empty apartment when I turned my key in. I have made several attempts to call them since then and I get no response. I call and call and nothing. Even the collection agency that I realized they used to add this to my credit just sends u to voice-mail. This was the absolute worst experience dealing with these people

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: XXXX XXXX XXXX was trying to collect {$2100.00} for unpaid rent and damages and filed an eviction in XX/XX/XXXX. We went to court, which was in XX/XX/XXXX for the unpaid rent of {$730.00} and the court awarded them a total judgment of {$970.00}. Prior to court, XXXX XXXX sent a personal invoice for what they felt were total fees and tried to collect on damages, which there were none according to the judgment against me and XXXX XXXX collected on a Sure Deposit of {$2000.00} from XXXX XXXX XXXX XXXX and I believe this is the debt amount they sold to National Credit Systems which is incorrect. I have also attached the court document below showing the judgment owed.

Consumer Complaint: To whom it may concern : Please note that that this is not a refusal to pay off the account, but a notice sent as per the Fair Debt Collection practices Act, 15 USC 1692g Sec. 809 ( b ). The notice states that your claim is disputed and validation of the account is required. This notice is not a request for verification of the account or proof of my mailing address, but a request for validation made pursuant to the FDCPA laws. I humbly request that your agency/office sends me valid proof that I am legally obligated to pay you. Please provide me with the below mentioned things : * The amount you claim I owe you * Explain and show me how you have computed the amount * Send me the copies of any documents that prove I agreed to pay the alleged amount * Identify the original creditor * Confirm that the account has not crossed the SOL period * Prove that you're a licensed debt collector XXXX Show me your license numbers and registered agent. I would like to inform you that in case your agency has reported invalidated account information to any of the 3 main Credit Bureau 's such as XXXX XXXX XXXX then it will be regarded as a fraudulent action under both the federal and state laws. Due to this reason, if any negative item is reported to any of my credit reports by your agency or the agency that you represent, then I will be compelled to take legal steps against you for the below mentioned reasons : * Violation of the FCRA * Violation of the FDCPA * Defamation of character If your agency can provide me with the requested documents, I will need minimum 30 days to investigate this information, and during this period of time, all collection activities must be stopped. I would like to further inform you that if any action is taken ( during the validation period ) which could be regarded as detrimental to any of my credit reports, then I will seek advice from my attorney for lawsuit. This includes listing any information on a credit report that could be incorrect or invalidated, or confirming an account as correct when in fact there is no provided proof that it is. If your agency/company fails to respond to this debt validation request within a period of 30 days from the date of your receipt, then the account information must be completely deleted from my credit report, and a copy of such deletion request should be sent to me at once. I would also like to request, in writing, that no calls should be made by your agency or company at my residence or work place. If your agency attempts to make unlimited or computer generated calls to me or any third parties, then it will be considered harassment, and I will have no option but to file lawsuit. All future communications with me should be done in writing and sent to the address mentioned in this letter. It would be advisable that you assure that your records are in order before I am forced to take legal action. This is an attempt to correct your records, any information obtained shall be used for that purpose. Sincerely, XXXX XXXX

Consumer Complaint: Sent in documentation to show proof of a balance I know is owed to the original creditor XXXX XXXX. National Credit System first failed to verify the debt within 30 days from the date of the original letter was issued to the XXXX XXXX XXXX XXXX XXXX XXXX, XXXX. that was provided then National Credit System failed to verify the debt again with 15 days from the date of the original addressed to National Credit System. National Credit System keeps saying the debt has been verified ; however, after further investigation, it was determined that XXXX XXXX is no longer managed by XXXX XXXX, they are no longer in possession of my previous apartment file, and are unable to properly determine what amount is owed due to being brought out by a brand new company and hiring a new team of property management. Due to this matter the collection company National Credit System is trying to force me to pay on a debt that is falsely owed after I sent in verified documentation and is failing to do the right thing under the Fair Credit Reporting Act.
