Issue: Written notification about debt
Subissue: Didn't receive notice of right to dispute
Consumer Complaint: Good day, My name is XXXX XXXX, my family and I when we were first moving to XXXX we signed a lease to move in to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, TX XXXX in late XX/XX/XXXX but we did not find the place to be comfortable mostly there was a constant smell of smoke at night so I decided to move out as I'm a XXXX XXXX and was already not feeling well. I also was hospitalized in XX/XX/XXXX due to XXXX XXXX and had an XXXX done at the XXXX XXXX XXXX on XXXX, XXXX TX. I described my XXXX XXXX problem and the continuous smoke through the XXXX XXXX XXXX vent at night and requested to terminate and leave their apartment. At that time I asked them about any extra fees or charges and discussed lease agreement says it will be {$800.00} something charges on my lease pg 9 but the XXXX XXXX property Supervisor informed me that it will not be an issue as long as I move out of their apt in 4 days which I did. I left their apt in 4 day time frame and did not damage anything. Nothing no information on the early termination charges are placed by the XXXX XXXX XXXX and I have communicated with them in XXXX in the time I left as to collect my postal mail. I left in good terms with the XXXX XXXX XXXX and they never asked me for any additional payments. I'm not sure where this collection company National Credit Systems has reported a collection debt in my name and it is reported on my credit file. I never received any info on this until when in late XX/XX/XXXX and early XX/XX/XXXX through my daughter loan officer. My daughter was trying to get loan approval and asked me to be her cosigner but the loan officer informed that I have a collection charges in my name. I never was aware of this or contacted by either the collection company National Credit Systems or XXXX XXXX XXXX while these charges have been posted since XX/XX/XXXX. It is not fair to me. It is not just impacting my score but I can not help my daughters out with either their loan applications or even signing for utility company such as XXXX as even that my daughter had to do for me as she has a good credit. I need help in getting rid of this false collection charge by the company National Credit Systems. If there was an early termination per lease agreement then XXXX XXXX XXXX should have given me that correct info and my financial responsibility at that time when I was vacating specially when I did inquire and expressed my financial obligation. If they never provided me with that info or any requests to pay the early termination charges at that time then why is this National Credit systems unnecessarily claiming such charges on my name, makes no sense. I would have never known anything if my daughter loan officer didn't give us the info including the collection company info. Please guide me and provide some assistance. Thank you.

Consumer Complaint: On XX/XX/2020, I sent a debt validation letter to National Credit Systems Demanding that they provide me with debt validating documents. The company did not provide me with any documents with my signature validating the debt. I was not provided the contract between the original creditor and me that states that if I defaulted on the alleged debt I would be indebted to National Credit systems. They are not licensed to collect debt in Louisiana. I was not notified before they falsely reported the XXXX collection account to the credit bureaus. Also, I never spoke with the company and they were illegally drafting 100 plus dollars from my account from XXXX XXXX XXXX 2020. I never authorized those payments and I was able to recoup those funds via my bank. I also attempted to sue them in XXXX County Justice, since the company said the collection occurred there, however they refused to show up to court. I will not stop until this account is removed.

Subissue: Public record information inaccurate
Consumer Complaint: In XXXX 2020 I pulled my credit report and noticed that a collection account was listed as National Credit Systems. The account listed XXXX XXXX as the original creditor. I contacted XXXX XXXX in regard to the account and the office manager says they no longer have my information because it had been transferred over to National Credit Systems. I reached out to National Credit Systems and they located the account. I asked for information concerning the debt to be sent to me via mail. I never received anything from them at all! The gentleman I spoke with was Mr. XXXX. He asked me to get on a payment plan and I told him that I needed to see the documents first. He said they could offer me a payment plan at {$100.00} per month. I told him that was impossible because I couldnt afford it. He told me the documents would be mailed out that week. That was close to one year ago and I still havent received anything from them. I reached out to them again about 2 weeks later to find out what happened with the paperwork. I was told the documents would be sent out that week. I was told I could set up a payment plan to avoid further legal action. I was afraid I would be sued, and I have a XXXX and cant afford any type of legal defense, garnishment etc. so out of fear I made an initial payment of {$75.00}. I told them that was all I could afford and honestly I still wasnt sure if I was supposed to pay them. I just wanted to get everything straightened out. Mr. XXXX did ask what I could afford to pay and I told them I cant get on a plan but I could try to pay something when I had extra money. I asked if they had a website and I was told I would have to call and give my card information over the phone each month. I also called back and made an additional {$50.00} payment the following month. I called another month later to make payment even though I still hadnt received anything from them confirming/validating the debt. I asked to speak with Mr. XXXX and I was told that National Credit Systems no longer handled my debt and that I would need to contact Attorney XXXX XXXX. I immediately called them. I requested information concerning the debt and up to this point I have never received anything from them. I requested this information and even disputed with the credit bureaus. The lady I was transferred to at XXXX XXXX says she is handling my case and I would have to deal with her. She told me that I need to get on the {$100.00} per month payment plan to avoid legal action and garnishment. I told her I couldnt afford it and that I only had a few dollars to spare. I did tell her that I would pay what I could when I had extra money as long as they could prove the debt was mine. I never received anything from them even after I mailed in a few payments. I thought they were waiting on me to make a payment before they sent out paper work. She told me they didnt have a website that would allow me to make payments online and that was lie. I was mailing payments in at the post office when I could have gotten online. She also says that I needed to make the payments to Attorney XXXX XXXX and not to National Credit Systems which is listed on my report. I asked why I needed to send payments to him if hes not the company listed on my report. I never received a clear answer I just did what I was told to avoid garnishment or being sued. Please help me! I want this off of my report. I started searching for answers and I see so many complaints on the XXXX website that this attorneys office is doing this same thing to others. It seems as if they are using National Credit Systems name to collect money for the attorneys office. Im not sure if im being scammed or not. Please help.
