They sent me an invoice that was generated but has no signature from the original creditor nor a signature from me. They also won't send me any information on their agreement with the original creditor to collect the debt on their behalf. I do not owe this debt. Consumer Complaint: XXXX XXXX XXXX manages XXXX Apartments. XXXX Apartments has sent my information to a collection agency called National Credit Systems , Inc . Since XX/XX/XXXX I have been receiving calls and letters from NCS requesting payment for something I never agreed to pay. I signed a lease with XXXX XX/XX/XXXX that ended on XX/XX/XXXX. As stated in the lease, the contract only automatically renewed on a month-to-month basis if neither if either party failed to give 60 days notice. I gave my 60-day notice and did not enter another agreement with XXXX Apartments. There was no new lease signed, I did not agree to any of the charges they tried to bill me for. When I received my first letter from NCS I informed them, through certified mail on XX/XX/XXXX, that I had no knowledge of the charges. I asked if they could validate them and provide a detailed explanation. I have receipts from that letter that my letter was received on XX/XX/XXXX. National Credit Systems ignored my requests and continued to ask for a payment in a letter dated XX/XX/XXXX. On XX/XX/XXXX I sent NCS another letter explaining to them that I think my rights had been violated by failing to validate a debt at my request and continuing to attempt to collect a disputed debt, both FDCPA violations. I asked them, again, to validate this debt. I specifically asked for them to provide me with the following : 1. Proof of right to own/collect this alleged debt 2. Balance claimed including all fees, interest and penalties 3. Contract bearing my personal signature 3. License proof to collect debts in my state To date they have yet to comply with my requests for validation. The lease they insist on providing me with expired with no new agreement on XX/XX/XXXX. XX/XX/XXXX, I fulfilled my final payment to XXXX Apartments and had a XXXX balance. XX/XX/XXXX, I received extra fees and charges ( I also disputed and was told by XXXX I should've done a walk through - XXXX was NOT doing walk throughs at the time due to covid ) I never agreed to and along with threats to my credit report. I am distressed that XXXX Apartments and National Credit Systems has continued to harass me, after I asked them not to contact me until they can validate this debt. They have now included this information in my credit profile and they have failed to maintain reasonable procedures in their operations to assure maximum possible accuracy in the information they report. At this point I feel this company and any claims for amounts owed is untrue and not properly investigated. Im very bothered by the months of harassment and disregard of my rights by National Credit Systems and XXXX Apartments. This company presented me with a new lease because they knew the old one had expired and when I declined to sign the new lease they knowingly used the expired one to harass and illegally collect from me. I would also like to note that I filed a complaint with NCS XXXX and XXXX Apartments XXXX. I'm not trying to submit double complaints to XXXX, however I am trying to file a complaint with the source of this matter, XXXX XXXX XXXX.

Consumer Complaint: I received this letter that is attached from National Credit Systems after sending a request for them to validate the alleged debt to them. They claim that they did not receive sufficient information to validate my " dispute '' or more so my debt validation letter. I have provided both my name and my address which should be more than enough for them to locate any file of an alleged debt that they may have in their system. They also stated that they are a third party debt collection agency and their efforts are solely on behalf of the current creditor, who has previously validated the alleged debt. Pursuant to 15 USC 1692g once a consumer notifies a debt collector in writing that they are disputing the alleged debt the debt collector must cease the collection of the alleged debt and obtain verification which should then be mailed to the consumer within 30 days. National Credit Systems has failed to do so. Under 15 USC 1692 a debt collector is defined as ANY person who uses ANY instrumentality of interstate commerce or the mail in any business the principle purpose of which is the collection of any debts, or who regularly collects or attempts to collect. This means that the original creditor that National Credit Systems has claimed they are collecting on behalf of is also a debt collector. TWO DEBT COLLECTORS CAN NOT HOLD THE SAME DEBT, THAT IS AN ACT OF CONSTRUCTIVE FRAUD. So, my question is who owns this alleged debt? Being that National Credit Systems is the one who is actively trying to collect on this alleged debt clearly means that they were responsible for answering and providing the following : 1. Signed agreement debtor has made with Debt Collector, or other verifiable proof Debtor has a contractual obligation to pay Debt Collector. 2. Was this debt assigned to a debt collector or purchased? 3. Amount that was paid if debt was purchased. 4. Date of original charge or delinquency Since they have failed to provide any of this information and they have clearly missed the 30 day mark that was granted to them for providing this information for this alleged date. As a consumer I am seeking the following remedies : 1. All references to this account be deleted and completely removed from my credit file. 2. A copy of such deletion request be mailed to me immediately

I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX , XXXX , and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C. 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. Finally, you are reporting the INQUIRIES that are the result of the same type of fraudulent activities. It must be noted that I did not apply for credit accounts with the below-listed companies and creditors, some of these are the result of attempts to open accounts, but the companies did not approve the accounts. Therefore, these inquiries must be deleted from within my credit file. You can not delete the fraudulently opened accounts without also deleting the fraudulent inquiries. It should be noted that an inquiry that was not made by me is not a factual record, just as a fraudulently opened account is not a factual record and not referred to the creditor to be disputed directly with them. The credit reporting agencies have attempted to address an inquiry as a factual record of file access, but if it was done through fraudulent means, it is not a factual record. As a consumer, I should not be required to dispute each fraudulent inquiry directly with each company. These inquiries are the result of fraudulent activity and therefore, inaccurate in which the credit reporting agencies or the creditors can not verify, meaning that these inquiries are unverifiable information and must be deleted from my credit files. 1. NTL CREDIT SYSTEMS bal. {$510.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted.
