Consumer Complaint: I contacted : NATIONAL CREDIT SYSTEM and an employee told me that I had to stop by the XXXX XXXX XXXX office. And resolve that charge of : {$410.00} with them and request a letter stating that said debt does not exist. The next day I went to said office and spoke with XXXX XXXX and she told me that they no longer have information on my payment history and there is no information in the systems. Since the company : XXXX XXXX took the computers and files, I asked her if I had the address and telephone numbers and I didn't have them. How is it possible that they are collecting a debt that I can not refute?

( a ) ( 5 ) Section States : No consumer reporting agency may make any consumer report containing any of the following items of information any other adverse item of information, other than records of convictions of crimes which antedates the report more than seven years. 15 USC 1681s-2 ( A ) ( 1 ) A Person shall not furnish any information relating to a consumer to any consuming reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate I HAVE NEVER given authorization nor permission to report to credit nor do i have an account with this agency! My rights has been violated and they are in violation according to the statutes mentioned above

Consumer Complaint: The charges on this account i am not legally responsible for. Per the original contract with the original creditor, westway garden apartments. I opted not to renew my lease when my lease ended, provided forwarding address which is still my current address for over 6 years now. XXXXXXXX XXXX never sent me a copy of the final walk thru or an invoice with a breakdown of charges or fees which were to be provided within 30 days or they were to return my deposit. Ive requested this information several times to no avail. Due to them failing to provide me with this per the terms of my lease contract i am not legally responsible for the collection. I dont have the slightest idea of what these charges are for. I finished out the entirety of my lease. I did not default on the contract, XXXX XXXX XXXX violated the terms of the contract. I know my rights and my credit has suffered for over 5 years because XXXX and XXXX wont remove it from my credit report. XXXX has actually removed it from my report but XXXX and XXXX refuse to.

Consumer Complaint: I called twice on Monday, XX/XX/XXXX. The first instance was at XXXX XXXX., in which I was trying to obtain information about the charge for {$430.00} that was opened XX/XX/XXXX. I was told they were hired by the original creditor ( XXXX XXXX XXXX XXXX ), which I know not to be true because they no longer exist as a landlord entity and haven't for a long time ; Also this charge just became active again. I was told they sent letters in the mail as an attempt to contact me, I never received any letter at any address I've updated with the post office. I asked to which address they sent the contact attempts, to which the agent replied " It doesn't matter '', I quickly replied " Of course it does if you say you made attempts to contact me '', to which she finally gave me an address. I asked what I could do to dispute this, she asked if I had any documentation of proof I did not owe payment, to which I replied that she could provide any proof of my liability to pay. She said " We can dispute this back and forth until we're both blue in the face but it won't matter '' and ended up hanging up on me. I called back five minutes later at XXXXXXXX XXXX., talked to the same lady, and asked if she could provide me with any and all signed documentation of proof of agreement to pay the stated amount of {$430.00}. She replied that she would send it to my email, I provided her with the correct spelling ( although they should have my information on file if they were truly hired by that landlord entity ), but I still have received no information or proof from National Credit Systems. Upon contacting the property she told me they sent the letters to, the current management told me they have never received mail there in my name nor had any documentation to provide as the property itself has been bought out by a completely different landlord entity. Due to the fact this is affecting my credit score, ability to find a home to rent, and ability to apply for loans, I disputed this on XXXX, XXXX, and XXXX as I have been provided with no proof of signed agreement to pay the {$430.00} even after requesting it.

Consumer Complaint: We occupied the townhome for two years XXXX XXXX. Every single rent payment was made on time, we took the utmost care of the place staying in close contact when repairs were needed and vacated with the exterior and interior in excellent order. The security deposit in place was {$3500.00}. We received a refund from XXXX of {$940.00} on XX/XX/XXXX after the landlord, inspected the property on XX/XX/XXXX. On XX/XX/XXXX, an additional {$50.00} check was disbursed to our name, once the landlord confirmed the garage door opener had indeed, been returned by us. Both checks were deposited into our account. Despite this reduced deposit at final accounting, the landlord reopened the account at the end of XXXX we received a demand letter for {$1700.00}. In the XX/XX/XXXX report by the landlord, XXXX % of the results are marked satisfactory. In the column for items the landlord marks action needed are considered normal wear and tear on the walls and baseboards. We had the unit cleaned by a professional service. Our maintenance service manager and a commercial painter spent time in the townhome patching walls touching up any cosmetic issues. The charges in the amount of {$1700.00} are not in line with the condition of the unit and the terms of the lease. Furthermore, these are unsubstantiated and baseless damage claims against our deposit should be reprehensible. A letter arrived from the debt collector on behalf of the landlord XX/XX/XXXX saying we had the opportunity to respond by XX/XX/XXXX in writing to dispute so I responded in writing on XX/XX/XXXX. On XX/XX/XXXX, we were sent to collections and the {$1700.00} is considered " valid. '' Please let us know should you like us to furnish documents and photos from our records for your review and consideration. We hope to resolve this matter promptly!

Consumer Complaint: Dear CFPB Complaints Department, I am writing to file a formal complaint against National Credit System for their relentless pursuit in attempting to collect a debt that is a direct consequence of identity theft. An individual, using my stolen identity, leased multiple apartments across the country simultaneously and failed to pay rent. Despite my efforts to provide National Credit System with evidence of this fraudulent activity, including a police report, FTC affidavit, proof of identity, proof of residency, and the multifaceted nature of the identity theft incident, they persist in their collection efforts. Their actions blatantly violate the Fair Credit Reporting Act ( FCRA ). The debt collector, National Credit System, has continually disregarded the evidence provided, which unequivocally proves that the debt in question is a result of identity theft. Their actions not only defy the FCRA, which explicitly mandates fair and accurate reporting, but they also ignore the multifaceted nature of this identity theft incident, which has resulted in multiple fraudulent leases across various locations. The following are the laws and regulations that National Credit System is violating under the FCRA : Failure to conduct a reasonable investigation into the disputed debt, as required under 611 ( a ) ( 1 ) ( A ) of the FCRA. Neglecting to cease collection attempts and reporting to credit agencies on a disputed account, as mandated by 611 ( a ) ( 2 ) ( B ) of the FCRA. Failing to comply with the FCRA 's requirement to verify the accuracy of the debt following a consumer 's dispute under 611 ( a ) ( 7 ). As a result of their persistent and unlawful actions, I demand the following immediate actions be taken by National Credit System : Cease all collection attempts related to the fraudulent debt associated with multiple leased apartments resulting from identity theft. Remove any and all mentions of this debt from my credit reports. Provide written confirmation that they have ceased collection efforts and taken necessary steps to remove this fraudulent debt from my credit history within 30 days. I am providing additional copies of the evidence supporting the multifaceted identity theft incident and the fraudulent nature of this debt. It is my expectation that the CFPB will promptly investigate this matter and take necessary actions to ensure that National Credit System adheres to the laws set forth by the FCRA.
