Consumer Complaint: I am disputing the move out fees and the damage the XXXX XXXX ( XXXX XXXX XXXX XXXX ) did to my person and my credit report through the collections agency National Credit Systems and The XXXX XXXX XXXX XXXX XXXX. I started a sublease at University XXXX, XXXXXXXX XXXX in XX/XX/XXXX to XX/XX/XXXX. I decided due to convenience to renew and lease again with University XXXX on XX/XX/XXXX through XX/XX/XXXX. In this period they did renovations and changed old furnitures for new ones. They changed the carpet for two of the rooms in the apartment XXXX but not my room since they said I was in a sublease. They sent me a move out statement and each and every item I was not responsible for ( including carpet replacement, ironic? ). I left the apartment in better conditions that what I received it and I have dozens of pictures from the move in and move out. I can provide proof. I sent multiple emails to the then resident manager XXXX XXXX and XXXX XXXX with no response and resolution ( they just straight ignored me ). I went to the office several times and was never able to speak to them. They did not consider the move-in condition form I submitted and charged me all cleaning, painting, carpet, mattress replacement ( the mattress was in the room ). I left my room in good conditions except for normal wear and tear. Btw, the apartment was infested with roaches when I moved in. Recently, I needed the account XXXX to be removed from my credit report. I tried contacting again XXXX XXXX XXXX but the managers were not able to speak to me since they were in a meeting. I had to resolve the matter with XXXX XXXX. Provided are the emails and pictures as proof. You have a pdf with all my proof. Okay, I have provided all the proof requested from you. Now I request proof that I owe this. Because you pretend to charge me for this. Please provide all the pictures ( not my pictures ) of the move-out that you are attributing me this charge. Please provide me the inspection that was completed at my move-out since I never saw that report. There is an inspection done per the statement you provided in XXXX XXXX, XXXX ( two years after I moved out ). I have a clean credit and you pretend to mess this up. This is not how you do it. I request reimbursement or refund for the {$720.00} I had to pay due to every management ignoring my requests, apologies from the company and complete deletion of the account from the three credit reporting agencies and from my credit report.

Issue: Written notification about debt
Subissue: Didn't receive notice of right to dispute
Consumer Complaint: I received a letter from the National Credit System INC, regarding a debt of {$4300.00} from XXXX XXXX XXXX. The debt is in reference to 4 months of rent free living for a year long lease. I moved into XXXX XXXX at the end of XXXX XX/XX/XXXX. They misrepresented them as XXXX XXXX. The agent that worked with me was XXXX XXXX from XXXX XXXX XXXX Upon moving in it was clear that the apartments were section 8 housing and not XXXX. On XX/XX/XXXX, I was threatened and assaulted in the XXXX XXXX XXXX private parking garage by another tenant. I called 911 and filed a police report. On XX/XX/XXXX my father and I went to meet with the management of the building, meeting with XXXX XXXX. I explained what happened and how I was scared for my safety. There was no action taken on the management side. Management refused to follow lease protocol against the offending tenant. With no action being taken I was required to move out for my safety. I was aware that I would lose my deposit. After moving out I received an email from the management on XX/XX/XXXX, requesting payment for the concession rental incentive. I responded by disputing their claims. I did not hear anything back from them. I was shocked to have received a letter in the mail from a collections agency more than a year later. I thought this matter was resolved as I provided proof that management was negligent of my safety and moving was not by my wrong. I also got no notice to have the ability to contest this matter until this collection letter.

Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: I went to apply for an apartment and was denied due to my credit. I checked my credit online and discovered that I had a collections on it from NATIONAL CREDIT SYSTEM for {$8300.00} that was opened on XX/XX/2019 on behalf of XXXX XXXX XXXX XXXX. I called to inquire and was told that this was for an apartment complex and that I owed the money for rent. I never lived at this apartment and have no knowledge of this debt. I provided proof to the apartment complex that I did not live there by providing them with payment history from the apartment where I did actually reside during that time period. I have a perfect payment history with all of the apartment complexes that I have resided at. I do not know where this debt came from. The apartment complex said they could not help me as the debt had been turned over to a collections ageny ( National Credit System ) I subsequently sent a certified letter to National Credit System asking for proof that I owed this debt and also sent them proof of where I was residing during that time period informing them that this was not my debt. It is my understanding that by law, they have to provide proof that I owe the money. They have not responded to my request and it has been nearly 60 days. I also tried to dispute this on my credit with each of the 3 credit bureaus but so far only XXXX has removed the collection. I need to get this off my credit and am hoping you can help!

Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: National Credit System has violated my consumer rights by continuing to furnish data to the consumer reporting agencies regarding an alleged debt as if they are the original creditor. They haven't been able to provide sufficient debt validation information to show they are the original creditor and the debt hasn't been validated by myself. The term creditor means any person who offers or extends credit creating a debt or to whom a debt is owed, but such term does not include any person to the extent that he receives an assignment or transfer of a debt in default solely for the purpose of facilitating collection of such debt for another. According to 15 USC 1692J It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. b ) Any person who violates this section shall be liable to the same extent and in the same manner as a debt collector is liable under section 1692k of this title for failure to comply with a provision of this subchapter. According to 15USC 1692g National Credit System has failed to provide all of the information required in the law below as well. If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. Collection activities and communications that do not otherwise violate this subchapter may continue during the 30-day period referred to in subsection ( a ) unless the consumer has notified the debt collector in writing that the debt, or any portion of the debt, is disputed or that the consumer requests the name and address of the original creditor. Any collection activities and communication during the 30-day period may not overshadow or be inconsistent with the disclosure of the consumers right to dispute the debt or request the name and address of the original creditor. According to Texas Finance Code Sec. 393.202 the collection agency has repeatedly violated the code below by utilizing the stall tactic in their response letters without providing any validation of the alleged debt. d ) If the third-party debt collector states that there has not been sufficient time to complete an investigation, the third-party debt collector shall immediately : ( 1 ) change the item in the relevant file as requested by the individual ; ( 2 ) send to each person who previously received the report containing the information a notice that is equivalent to a notice under Subsection ( c ) and a copy of the changed report; and ( 3 ) cease collection efforts. ( e ) On completion by the third-party debt collector of the investigation, the third-party debt collector shall inform the individual of the determination of whether the item is accurate or inaccurate. If the third-party debt collector determines that the information was accurate, the third-party debt collector may again report that information and resume collection efforts.

Consumer Complaint: XX/XX/XXXX, I paid {$89.00} to XXXX XXXXXXXX XXXX per XXXX XXXX for prorated rent due to move out. XXXX XXXX was provided notice that I was moving from the premises on XX/XX/XXXX. XXXX XXXX submitted a document to National Credit Systems claiming that I owe for a prorated amount of {$45.00} and an additional {$370.00} for XXXX rent. They had taken my security deposit of {$280.00} and added a 2 % interest rate from XX/XX/XXXX - XX/XX/XXXX of {$22.00}. Which results in a {$100.00} account balance. At no point is the {$89.00} taken into consideration, much less the fact that I moved out on XX/XX/XXXX, not XX/XX/XXXX. Furthermore, the ledger is not signed by XXXX XXXX, the XXXX responsible for submitting the debt and the rent amount listed is incorrect. I reached out to XXXX XXXX Systems and requested they validate the debt. They claimed they would validate it, but never got back with me in those regards. Attached will be the documents to support my claim for the dispute.

Consumer Complaint: National credit systems contacted me about {$900.00} debt. This was claimed to be owed to an apartment I moved out of on XXXX XX/XX/2020 The first time I ever learnt of this debt was when my credit score was going down late 2020 and eventually saw it was an entry by XXXX XXXX. Now National credit systems have put the same debt on my credit reports as XXXX XXXX after the debt was deleted. I wrote XXXX XXXX and I did not get any response. I wrote then to you, CFBP reference number is XXXX. You could not contact them either.XXXX and XXXX eventually deleted the entry. However National credit union has put it on all 3 credit bureaus. I disputed the charges. They claim I moved out on XXXX, I how ever moved on the XXXX. I did not get any communication from this apartment even after I saw the derogatory input on my credit report. If a landlord does not contact me after 30 days of moving out, I dont see how I am responsible and the charges are even frivolous. The notice sent by National credit systems says they will send the debt to collections in 15 days, however it is about 18 months later. This is just crazy that a collections agency is allowed to post what they want on my credit report.

Consumer Complaint: I sent a letter to National Credit Systems regarding a duplicate reporting error and asked for them to verify the debt with me. I sent this letter XX/XX/2021 by USPS. I have heard nothing from the company. They have made no attempt to contact me via mail, email, or telephone. Since it has been well over 30 days, I believe the account should be closed in order to avoid unfair credit reporting. The duplicate reporting of the same account adversely affected my scores for years and showed I owed more money in collections than I actually did. This cost me countless housing and vehicle financing opportunities.

Consumer Complaint: For several months, i've relentlessly tried to get inaccuracies removed from my credit so that my children and i would have access to the basic necessities. Ive had some success as evidenced by the exhibits attached ; however the deliberate consumer abuse unfortunately continues. These companies ' negligence has caused such harm and distress to myself and my XXXX minor children. There are Acts put in place to protect the consumer ; and willingly and knowingly violating the laws have monetary, civil, and sometimes even criminal liability. National Credit Systems, after failing to ADEQUATELY and LAWFULLY validate any alleged debt, slightly followed protocol by the removal of this inaccurate and derogatory account from the XXXX consumer credit report. Sadly, they've knowingly committed fraud and inflicted harm by continuing to report this inaccurate account ( National Credit System Acct # XXXX ) to XXXX as " verified '' ; all while essentially admitting to the inaccuracy and fraud by the deletion from the other previously mentioned Bureau ( XXXX ). Please help me to understand how this account can be verified with one Bureau and be deleted/removed by another. Are other Bureaus, such as XXXX, held to a higher level of integrity and accountability than XXXX? Why is XXXX willing to assist these fraudulent companies in harming the consumer? What is the use of the Fair Credit Reporting Act or the Fair Debt Collection Practices Act, if it is not abided by ALL in commerce? What is the future of commerce if consumers are purposely oppressed by the entities designated to protect them? What is the future of commerce when criminals get to hide behind fictitious entities and bleed the natural person of their XXXX given rights. As I type this complaint, one of many, I literally have XXXX weeks to vacate an extended vacation home but am unable to, due to the inaccuracies on the consumer report causing the adverse action during the application process with leasing companies. This inaccuracy and fraudulent, unruly behavior on the behalf of the companies attached to this complaint ; has done far more than damage my credit worthiness, or my slander my reputation in commerce- these excessive and perpetual violations have ultimately infringed on my life, my liberty, and my ability to obtain even a rental property to call home for more than a couple of months. I need these inaccuracies PERMANENTLY and IMMEDIATELY deleted and blocked from ALL consumer credit reporting companies and bureaus, this includes XXXX, Corelogic and all other adjacent reporting companies which XXXX furnishes with this inaccurate information.
