Consumer Complaint: In XXXX of XXXX, my bankruptcy was discharged with M & T having been notified by the courts. I have been in continual communication with M & T and was assured that I was not to make payments until notified by them. Every time I spoke with M & T I requested the mailing address be updated to the property address. The first request was in XX/XX/XXXX this was completed on XX/XX/XXXX. Correct address XXXX XXXX XXXX XXXX, XXXX , KS XXXX. Since I was never notified the account had been moved from bankruptcy back to a regular account the payments were late. I was notified on XX/XX/XXXX, that a fraudulent Cease & Desist was put on the account in XXXX and that is why they were unable to call and follow up on the change in status. I have been in contact with M & T since XX/XX/XXXX to have my credit report updated and the late payments removed. On XX/XX/XXXX XXXX XXXX informed me the credit dispute had been closed without anyone contacting me to verify the information the customer service representative had entered was correct.

On XX/XX/year> I deposited {$1100.00} USD ( Cash ) into my personal account with M & T Bank, I was notified my account was on hold after my cash deposit. I have a few activity on this account. The bank is not communicating the reason for the hold, nor with the bank release my funds.

Consumer Complaint: I had started a loan Application with M & T Bank on XX/XX/23. On this date, I had spoken with XXXX XXXX, a mortgage officer at M & T. On the very first call, within the first few minutes I had mentioned the house NEEDED a roof and asked if this would be able to be tied into the mortgage, he said he's not sure and we'll see what we can do. By the end of this ~hour long call, after I've given him all of my information I can, I follow up on the roof. He responds " what roof '' ... The first sign of issues. He ends up saying that we can see what we can do, and that we can move forward for now. I had given all of my financial information, bank accounts, active payments, loans, etc. From the start XXXX had misconstrued this information, however I did not find this out until later down the line. At this point XXXX told me I should go forward with getting an inspection for the house, and I had scheduled with a third party to get this done. Over the next few weeks, the roof was a topic of discussion I kept bringing up, as I knew it was a major part of the decision for them to approve the mortgage. Through the entire process he kept just reassuring me that " we'll figure it out ''. At this point I had gotten to underwriting. While working with them he had reached out to me to get some clarification on my income and other information, and at this point I found out he was " crossing off '' my car payment since the beginning, and that was inflating the view of what I could afford. Additionally, while it was at underwriting, i was mistakenly sent a message by XXXX that was meant to be internal to M & T, and it stated that the " {$5000.00} grant '' was not eligible, and that the bank would have to " cure '' it. Once again, showing that XXXX was not following due diligence for this process. Overall it is my strong belief that if XXXX had appropriately reviewed my information and the situation, and that if the team at M & T actually reviewed these calls and processes, that it would be seen that I should have never been told to move forward with inspection, as the house would not have fit within the DTI ratio from the start. The manager I have spoken to that was reviewing my case did not know what I was referring to when we discussed it, showing that he had not efficiently reviewed my case, and only referenced it not being something they would refund as it's a " third party expense ''.

Consumer Complaint: I previously made a cfpb complaint about overdraft fees charged to me when I have not authorized overdraft payments. Please see cfpb complaint # XXXX and the feedback I provided for more details. In their response, M & T Bank claims that I authorized overdraft payments. ( See the document " XXXX XXXX XXXX Resolution Package '', page XXXX ) However, the information I simply obtained through the M & T website for my account shows that I did not authorize overdraft selections and that this choice was made long before the overdraft charges. ( See the document " M & T Overdraft Selection '' ). This is the only selection regarding overdraft fees that is accessible through their website.

Consumer Complaint: I processed my monthly payment with additional payment attached to it. When I applied the additional payment it auto-enrolled me in auto pay. I did not want to be included in auto pay, and it subsequently cancelled my processed payment. It did not alert me of this cancellation, and I was never notified for 30 days that my payment had never processed. It was reported to the credit agencies even though I paid it immediately upon being contacted. I explained to the support team what transpired and the confirmed they say the additional payment and transaction on the site. They agreeded they were aware of the automatic enrollment in auto pay even though that is not what should happen. They refused to fix this or work with me. They told me to report it to the credit bureau which I did and then they failed to fix it with the credit bureau. I have made every payment on time. Before and after that. It has effected my refinance options and credit score significantly negatively impacting my life with hiked interest rates for other financed things. I am pleading that these things get resolved as I am not deserving of this demerit. Thank you.

Consumer Complaint: I deposited insurance proceeds from XXXX to my checking account on XX/XX/24 in the amount of {$100000.00}. On XX/XX/24, the funds became available and were immediately used to pay off medical loans. On XX/XX/24, M & T removed the funds from my account leaving a significant negative balance. I contacted both M & T and XXXX right away. After nearly XXXX solid days on the phone with both entities, including conference calls between the two, we are at an impasse. M & T is saying they received instructions to return the funds to XXXX XXXX ( XXXX 's bank ) because there was a stop payment issued. XXXX investigated this thoroughly with XXXX, who is saying there was no stop payment or request for return of the funds. M & T refused to provide any specific information as to who requested that the funds be returned, so we can't even go back to XXXX or XXXX to follow up with that particular person. Both entities are pointing the finger at the other. Both entities are saying they do not have my funds, and neither entity is taking any steps to return the funds to me. In the meantime, I am out {$100000.00}. The money I had in the account to pay monthly bills has now been overtaken by this huge negative balance. It's now a week that my money is gone. I am desperate for some immediate relief.

Consumer Complaint: I must bring to your attention that the mortgage servicer M & T Bank has failed to follow the Real Estate Settlement Procedures Act ( RESPA ) by not notifying the borrower of the negative escrow balance that initially occurred in XX/XX/XXXX, and failed a second time in XX/XX/XXXX, failed a third time in XX/XX/XXXX, and subsequently failed a fourth time in XXXX of XXXX. It was not until the escrow account had been allowed to reach a negative value of nearly {$7000.00} in XX/XX/XXXX that M & T Bank contacted the borrower regarding the shortage. Due to this repeated failure to comply with RESPA, the borrower no longer has faith in the servicer 's ability to promptly and effectively manage the escrow. Additionally, a direct consequence of this negligence has resulted in the borrower 's mortgage payment doubling, causing extreme financial strain and hardship. Failure to comply with the Real Estate Settlement Procedures Act ( RESPA ) can result in various penalties and consequences. Some of the results of non-compliance with RESPA include : Penalties and Fines : Companies that violate RESPA can be fined as much as a few XXXX XXXX dollars in damages Civil Liability : Violators may be subject to civil liability of up to three times the amount they were paid and any attorney 's fees Criminal Liability : In some cases, a violation of RESPA can include jail time of up to 1 year Enforcement by CFPB : The Consumer Financial Protection Bureau ( CFPB ) is responsible for enforcing RESPA This is a vehement example of predatory behavior by a mortgage servicer that should not be allowed.
