Consumer Complaint: Since XX/XX/XXXX. I have sent almost 7 Complaints ( disputes ) as they identify them with calls from insurance companies and emails to fix the dispute but promises without action. My name and my nephew have the same first and last name but different Middle names, Dates of birth, SS #, Driver 's licenses, etc... my nephew had 2 car accidents. XXXX in XXXX and XXXX in XXXX. They have added those 2 claims ( accident ) to my personal report. I have stated that the information is incorrect information on my report. they claim it on the insurance companies who reported the claims. I followed up with the insurance companies who sent them email after email and explained in detail the confusion between the names but without any action from the credit report company. The main problem is that they don't respect the time. They make you wait to answer the dispute for almost 35 days. That is in total 8 months now without any results. I am a XXXX person and really don't have the time to wait for half an hour every time you call them for a security check with operators from foreign countries and don't know what are they doing??? it is really petty to see such a company handle credit reports for millions of people with such responses ....

Consumer Complaint: XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX 15 U.S. Code $ 1681c-2 a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt. It has been 30 days and you are in VIOLATION of this law because I am a victim of identity theft!! Please delete these items IMMEDIATELY! These accounts should not be furnished on my consumer report as they are in VIOLATION!!! Under, 15 U.S Code 1681b - Permissible purposes of consumer reports ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the WRITTEN INSTRUCTION of the consumer to whom it relates. I NEVER gave any consumer reporting agency WRITTEN CONSENT to report anything on my consumer report which violates my rights as a federal protected consumer. NO CONSENT IS IDENTITY THEFT. As a consumer I am demanding the deletion of the accounts listed IMMEDIATELY! I got denied a house due to information on my report I have not supplied proof under the doctrine of estoppel by silence, Engelhardt v. Gravens ( mo ) 281 SW 715,719, I presume that no proof of the alleged debt, nor therefore any such debt, in fact therefore exists

The civil liability law under which I will sue is clearly here. 15 U.S. Code 1681 ( a ) ( 4 ) - Congressional findings and statement of purpose ( Consumer Right to Privacy ) ( a ) Accuracy and fairness of credit reporting The Congress make the following findings : ( 4 ) There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and respect for the consumers right to privacy. Failure to Comply or delete these items 15 U.S. Code 1681n - Civil liability for willful noncompliance ( a ) In general Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) ( A ) any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00} ; 15 U.S. Code 1681o Civil liability for negligent noncompliance- ( a ) In general Any person who is negligent in failing to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) any actual damages sustained by the consumer as a result of the failure ; and ( 2 ) in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorneys fees as determined by the court. Under 15 US Code 1681a ( 4 ) as a consumer, I have the right to privacy and this bankruptcy must be deleted from my consumer report or I will seek monetary damages in small claims court in my city and state. Also, I already sent this letter to the Consumer Financial Protection Bureau, Attorney Generals Office, Better Business Bureau, and Federal Trade Commission.
