Consumer Complaint: As of XX/XX/XXXX I have learned that my identity has been stolen and used fraudulently. I have included several documents for evidence of proper reporting of the matter. I have mailed my complaints as well as attempted direct complaints with XXXX, XXXX, XXXX and Lexis Nexis, although XXXX did not provide an online option for my needs. There have been multiple instances of false personal information, addresses, hard and soft inquiries, phone numbers & email addresses. I have spent a great deal of time since my knowledge of the matter beginning in XXXX of XXXX, trying to clear all of the errors up. I filed disputes on XXXX of XXXX which remedied several items but not all and thus leading me to spend even more time and money to research remedies and to provide all of the additional documents ( included ). I have also found multiple instance of privacy violations which are addressed in the documents as well. I have since also froze all of those mentioned. As of this time, my home has incurred over {$50000.00} worth of loss and damages since XX/XX/XXXX.

XXXX XXXX has never contacted me in regards to sharing my personal information nor have they ever given me any information on how to opt out i have requested XXXX XXXX to remove the charge offs and the late payment information from my consumer report multiple times as that is personal information and they have yet to comply with anything i have asked of them but now i know they are directly violating my rights. Then remedy for this is for XXXX XXXX to remove all charge offs from my consumer report as well as all late payment information repossessions of any kind as it all falls under personal information

Consumer Complaint: In response to the the letter I received from LexisNexis about allowing me to opt out but there is still several federal violations according to the FCRA and also in pursuant to US Code. The first page of the LexisNexis letter states that Under the FCRA XXXX XXXX has the right to : Request a description of the procedure used to determine the accuracy and completeness of disputed information, including the business name and address, and telephone number if reasonably availability, of any finisher of information contacted. Add a statement to his file disputing the accuracy or completeness of information. The statement will remain on file and will be furnished to recipients of the file as the disputed information is still used ; and Request that LexisNexis furnish notification of the DELETION of disputed information. One of the main words that stood out was COMPLETENESS. The FCRA 604 ( 2 ) clearly explains what would make a consumer report accurate and COMPLETE.The FCRA prohibits ANY agency from furnishing a consumer report which may include credit information without written consent from the consumer in which it relates to. Per FCRA 604 ( 2 ) Permissible Purpose ; FCRA 604 ( 2 ) states as a disclosure to the consumer that a CLEAR and CONSPICUOUS disclosure be made in writing and also authorized with the consumers signature before any consumer nonpublic personal information can be disclosed. The term nonpublic personal information means personally identifiable financial information provided by a consumer to a financial institution ; resulting from any transaction with the consumer or any service performed for the consumer ; or otherwise obtained by the financial institution. Such term does not include publicly available information, as such term is defined by the regulations prescribed undersection 6804 of 15 USC 6809. Except as otherwise provided in 15 USC 6802 afinancial institutionmay not, directly or through anyaffiliate, disclose to anonaffiliated third partyanynonpublic personal information, unless suchfinancial institutionprovides or has provided to theconsumera notice that complies withsection 6803 of 15 USC 6803. Theconsumeris given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and theconsumeris given an explanation of how theconsumercan exercise that nondisclosure option. No such disclosure agreements exist so that would make each report that LexisNexis furnished was INCOMPLETE and INACCURATE. The letter from LexisNexis clearly states that I have the right to Request a description of the procedure used to determine the accuracy and completeness of disputed information, so Im requesting a copy of the disclosure as describe in FCRA 604 ( 2 ) to prove procedure and completeness ; Permissible Purpose. If Lexis Nexis can not produce said disclosure with my signature authorizing the use of my federally protected information, that is a direct violation of FCRA 604 ( 2 ) and all of Federal law. More importantly the would prove that LexisNexis does not have COMPLETENESS or followed procedure to obtain Permissible Purpose. The consumer reports that LexisNexis furnished in regards to me, XXXX XXXX has been a complete disaster to my life and financial situation from loan denials from XXXX XXXX, XXXX XXXX, XXXX XXXX as well several credit cards and auto loans. 15 USC 1681 ( A ) ( B ) ( b ) explains how each of these FEDERAL VIOLATIONS should be handled according and including each violation. Knowing LexisNexis is operating according to the Federal law, Im insured that LexisNexis will handle this issue accordingly. In pursuant to 15 USC 1681 ( i ) in the case of liability of a naturalpersonfor obtaining aconsumer reportunder false pretenses or knowingly without a permissible purpose, actual damages sustained by theconsumeras a result of the failure or {$1000.00}. Anypersonwho obtains aconsumer reportfrom aconsumer reporting agencyunder false pretenses or knowingly without a permissible purpose shall be liable to theconsumer reporting agencyfor actual damages sustained by theconsumer reporting agencyor {$1000.00}, whichever is greater.
