Consumer Complaint: Per previous complaint XXXX. Which was resolved, with conditions of GM Completing tasks to finalize my servicing needs. GM Financial has not upheld their original promise of removing the late reporting for XX/XX/2017 and XX/XX/2017. These 2 months still show as delinquent. GM financial should have removed these items given GM Financial was going through a chaotic system update which hindered my payments from being processed correctly. This is a violation of the fair debt collection act as creditors are supposed to allocate to principal a d interest before any late fees, GM Financial applied my payment to late fees and left my principal and interest still showing due. At the time I received a payoff {$250.00} excluding late fees in which I paid XXXX and again GM Financial violated the FDCA by applying that payment to late fees only. This needs to be rectified, as these erroneous late reporting have caused difficulties in obtaining new credit.

Consumer Complaint: I leased a new car through GM Financial about 2 years ago. I planned to make payments by auto pay from my checking account as I always do for repetitious payments. In order to set up auto pay, other companies have always asked me to send them a voided check. GM did not work that way and instead asked me to read to their representative the routing and account numbers from the bottom of my checks. Because I am not knowledgeable about the banking system, I mistakenly read ALL the numbers, INCLUDING THE CHECK NUMBER. The GM rep did not point out any error, I concluded the auto pay setup and the call. I assumed that all was set up and that my payments were being taken from my account monthly. Several months later, I received a late payment notice with late fees and an invoice for several months rental. I called and spoke with another GM rep and gave that person my check numbers again, and the same sequence of events occurred. This scenario continued throughout my entire 2 year lease. None of the reps mentioned that I had read them too many numbers or the fact that the last 4 digits were different each time I read them out ( since they were the check numbers ). The outcome of all of this is that GM sent a poor credit report to XXXX that lowered my credit score by about 300 points. I have always taken great pride in my high credit score and complained to GM that their poor report was not warranted because my intent was always to pay on time. The only problem, which should have been caught by the GM reps, was my lack of knowledge of the banking system and their refusal to take a voided check. When I appealed, they responded like robots, saying that, because they did not make an error, they would not withdraw the poor credit rating they had sent out.

Consumer Complaint: On XX/XX/2019, I wrote to XXXX, XXXX, and XXXX in regards to a fraud account which is reported on my credit report in the amount of {$3700.00}. I submitted enough information to show that this account was not valid, however, my status remained as is. On XX/XX/2019 I wrote to GM Financial in regards to the fraud account that was placed on my credit report. On XX/XX/2019, GM Finacial responded to my complaint stating that they would investigate the alleged fraud. I submitted the following documentation, police report, ID Theft Affidavit, and legible signatures. On XX/XX/2019 I received a letter from GM Financial without any regards to investigating the claim. However, as a result, GM Financial claimed that the request was based upon a misrepresentation of facts relevant to the request and that GM Financial will not be able to remove the account from my credit report. I now request that CFPB to investigate this account and I would like for you to to take action to protect my credit rating.

Consumer Complaint: On XX/XX/2019 I received an e-mail stating that my payment had not been received for my leased XXXX. As I had set up auto-pay in the past for the full amount due I worried that something had changed with my bank account. Upon logging in to their website I found that they claimed I owed money due to underpayments for the past two months. Those underpayments were now considered " overdue '' despite the fact that I had not received any notification that I was underpaying. When I called GM Financial their representative stated that I owed the amount I agreed to pay on my lease and made it clear that the website taking the wrong amount was not GM Financial 's problem. I never claimed to not want to pay the correct amount of my lease but rather that the website was taking the wrong amount out. At which point the representative informed me that the shortage was taxes owed on the lease. The issue here is that I told them to pull what ever I owed them from my bank account at a set time each month. Yes, I need to meet my contractual obligation to pay them but they also need to fix their site so that when I set up autopayment for the " amount due '' it takes out the correct amount. They also need to clean up their communication so that I get notified in a timely manner that my payment isn't sufficient to cover what I owe. Because in my mind I've already met that obligation by giving them my bank account and telling them to take what I owe them.

Consumer Complaint: GM Financial is claiming that I was late with making payments and have not had any late payments in the past 20 years. I did not receive any statements from GM Financial in 2018 but consistently made payments by logging into the mobile app. I later learned that GM Financial made a mistake on my account and did not send my statement to my address ( XXXX XXXX XXXX, XXXX XXXX NY XXXX ) but instead sent them to XXXX XXXX XXXX, XXXX XXXX NY XXXX ). Upon learning of this information I grew worried that my personal information was sent to someone I didn't know and they told me the statements were returned as unable to deliver. I then asked how come no one from GM Financial reached out to me to correct or why their internal controls did not discover the entry mistake as my address is correct on all the lease documents and they did not respond. Furthermore, unbeknownst to me, GM Financial 's web page was in beta throughout 2018 and would present an amount due of {$0.00} and without a due date. I still made my payments because I knew I had too and have made every single payment. However, there must have been some timing issues in receiving these payments as they are stating I was 30 days late from XX/XX/2018 - XX/XX/2018. GM Financial did not acknowledge that they had any fault and would like an investigation into why there internal controls did not identify that my address was not correct ( especially since they received return mail ) and why I was placed onto a beta web page without my consent. I would like the late payments removed from my account and an inquire be made with GM Financial. Thank you for you consideration in the matter.

Consumer Complaint: This is the same company I tried to get YOUR ( CFPB ) help on. You highly regulate my entire career so please help me when I need you. GM violated the FCRA by decimating my credit. If I reaffirmed the debt with them, they take payments for two years never late BUT REFUSE TO REPORT THE TIMELY PAYMENTS.. HOW CAN THEY LEGALLY LITERALLY BACKDATE LATE PAYMENTS.. This is a violation of the fair credit reporting act. I will contact the department of Justice with this if you do not resolve this matter.
