Consumer Complaint: I am a XXXX veteran who co signed on an auto loan with my XXXX XXXX veteran brother who has XXXX. Complaint # 1 I was not informed that late payments would be reported to my credit report because the Dealership nor G.M.Financial Corp.did not provide a seperate co-signer notice as stated below by CFPB Regulations, until I received a phone call from G.M. Financial on XXXX-19 after payments was 3 months passed due. After the call I immediately checked my credit score and was devastated to see that my score had decreased each month by a huge decreased amount and now below 600 fica score. G.M. Financial and the Dealership must be held legally accountable and correct this illegal act. CFPB Regulation as follows : As co-signer, you should receive a separate notice by the lender prior to signing the agreement. The notice will contain the following information : You are being asked to guarantee this debt. Think carefully before you do. If the borrower doesnt pay the debt, you will have to. Be sure you can afford to pay if you have to, and that you want to accept this responsibility. You may have to pay up to the full amount of the debt if the borrower does not pay. You may also have to pay late fees or collection costs, which increase this amount. The creditor can collect this debt from you without first trying to collect from the borrower. The creditor can use the same collection methods against you that can be used against the borrower, such as suing you, garnishing your wages, etc. If this debt is ever in default, that fact may become a part of your credit record. Complaint # 2 During the phone call mentioned above on XXXX-19. I informed G.M. Financial that my brother was having XXXX Behavior episodes and that I as the co-signer which to surrender the vehicle that is in default because I didn't know the each late payment would be reported monthly on my credit report. I was informed that it was an option and my right. Then I was told that I had to find the vehicle and have it in my possession even though I am the co-signer and don't have a tracker on the vehicle as G.M. Financial does and I don't know the location of the vehicle. G.M. Financial must be held legally accountable and correct this illegal act.

Consumer Complaint: GM Financial over the lst six years has fought me on what my accurate account history is. I had a co-signed loan that was also reported to the co-signers credit. The information this company reported, has reported, and continues to report to both of our credit files is different. They refused to acknowledged the fact that the payments they claimed were late were in fact not late until years after the loan was paid off and the account closed. At that time after submitted over a dozen disputes that were denied they came back in agree-ance that the payments were not late.

Consumer Complaint: When I first got the lease I signed up for autopay " recurring lease payments '' via instructions from GM Financial. I never cancelled the recurring payments so assumed they had continued like they had for the previous 2.5 years. However, I found out that in XX/XX/2019 the auto payments had stopped ( I hadn't done anything to stop them ) and XXXX XXXX lease hadn't been paid so I quickly jumped on-line and made both XXXX and XXXX payments. I then re-set up auto payments and received confirmation on XX/XX/XXXX that the recurring lease payments would continue like they had the first 2.5 years of the lease with no problems. Well then again on XX/XX/XXXX I was notified that the payment was 40 days late and the recurring lease payments I had set up according to GM Financials instructions didn't take my payment so that day I jumped on line and paid the amount that was showing outstanding. When I called GM financial they said they had made a mistake and that my credit shouldn't have been marked with a 30 day late and they would do a credit correction and to call back in 1 week to confirm. When I called back in to follow up someone on the phone said they wouldn't help me and they wouldn't correct the mistake. I have spent the last 10 years building my credit and paying my bills on time. I specifically set up autopay so that this wouldn't happen, I am extremely frustrated and feel like a victim as the immediate drop in my credit score from no fault of mine will prove to be very expensive.

Consumer Complaint: Around XX/XX/XXXX, GM Financial illegally repossessed XXXX XXXX XXXX Account # XXXX. This issue was resolved a few days later. They returned the vehicle. However, it took months for them to remove the 30, 60, 90 day late payment. After it has been resolved, couple of months later, around XX/XX/XXXX ( last year ), their billing department sent me inaccurate bill showing months of unpaid monthly payment. Around XX/XX/XXXX, I contacted GM Financial about fraudulent charges/inaccurate billing and credit reporting for 2 XXXX lease accounts that I had with them : Account # XXXX ( XXXX XXXX XXXX VIN # XXXX ) and Account # XXXX ( XXXX XXXX XXXX VIN # XXXX ). I sent them an email dispute and it appears as if they again corrected the wrong bill for this account. When I made all the disputes, I made it clear to GM Financial that both accounts were being paid at the same time. I provided them bank statements and even conferenced them with XXXX XXXX representative over the phone. XXXX even confirmed to me that the amounts were being paid to GM Financial by them on my behalf every time a payment is made through my XXXX XXXX account. For the record, both these accounts were on automatic billing and payment directly with GM Financial. I never knew that GM Financial took me off of the auto pay around XXXX XXXX. Since I have enrolled on auto pay, I only open mails when I have time to file and organize. Around XXXX XXXX, I found out that I am being paper billed and that according to them I owe 2 months. And because I saw how undependable GM Financial 's online payment system is, I decided to start paying them directly from my XXXX XXXX account. Around XX/XX/XXXX, I spoke with XXXX of GM Financial - I was told that she would be putting notes regarding the 30 day late for Account # XXXX for research. Around XX/XX/XXXX, I spoke with XXXX and XXXX of GM Financial - I was told that I would be receiving a letter from GM Financial indicating no late payment record for Account # XXXX and that it would take few weeks before it is reflected in my credit report. Today, XX/XX/XXXX, I spoke with XXXX of GM Financial - I was told that Account # XXXX is still showing the 30-day late. Records will show that I always pay my GM leases on time except for the month that their system abruptly and without notice stopped processing my auto pay. Records will also show that I always pay these 2 accounts timely and responsibly. Records will also show that I always pay these 2 accounts AT THE SAME TIME! Since I am paying both accounts at the same time, and they have removed the late payments in Account # XXXX, why have they not done the same with Account # XXXX? Both accounts should not show any late payments. I have been suffering because of this negligence. I have either been declined credit or been offered higher interest rates because of this inaccurate information being reported on my credit. Please see attached documents for reference.

Consumer Complaint: I had been storing my car at a small storage facility in XXXX, S.C. XXXX XXXX XXXX XXXX, XXXX for approximately 2 years. Originally, I did not believe there was a written agreement ; however, after contacting my mother, who had power of attorney, she provided me with a written agreement which was signed by his father, who also had power of attorney authority. I had spoken to someone who worked at the storage facility on multiple occasions and the person that I spoke to stated that I could pay the payments monthly, every six months or yearly. I believed I owed 2-3 months ' fees, I previously paid sometimes monthly, sometimes 6 months ' at a time, it varied. Without notifying me, the storage facility decided to repossess my car. It is my understanding that the storage facility called my lender, GM Financial, for the loan that is still on his car to tell the loan company that I hadn't been paying and to come get the car. To date, the storage facility has not notified me that I was late on payments, has not notified me that they intended to repossess the car, and never gave me an opportunity to come up-to-date on my payments. It is my understanding that the car was repossessed without a court order on XX/XX/XXXX, I believe that the lender repossessed the car, without notifying me, and it was brought to an impound lot. I then received a notice, on XX/XX/XXXX, dated XX/XX/XXXX giving me an amount to pay the car off including repossession fees. At this point, I have the name of the impound lot, but I can not get in touch with them. My car is going to be auctioned off on XX/XX/XXXX. I believe that the storage facility violated Section 3958 of the SCRA and several other state and federal laws and that GM Financial also violated section 3952 of the SCRA. GM Financial refused to provide me information on where my vehicle was located or any information about the repossession until XX/XX/XXXX stating that I had not " applied '' for my SCRA rights.

I purchased on XX/XX/XXXX a excess wear and tear addendum with my lease agreement for {$7500.00}, I wrote them back to get detailed information on what exactly they did to the car if I had the addendum protection and I havent heard from them, this situation affected me by 151 point on my credit score already. Consumer Complaint: During the course of the lease in question, I, the customer, consistently paid on my account early and in excess of the minimum amount due. When the lease had ended, I returned the vehicle in pristine condition. GM Financial had agreed, but had charged $XXXX in over-mileage charges, with the final payment due on XX/XX/2019. I am not disputing this charge, I want to pay it. GM Financial offered only ONE method of payment for their final bill, via check and using a slip attached to the final bill. On XX/XX/2019, a payment for $XXXX in the form of check (from my account, check #XXXX) along with the final bill slip was sent via USPS to the address provided by GM Financial: XXXX. XXXX XXXX, XXXX, AZ XXXX as instructed by the final bill sent by GM Financial.I have not heard from GM Financial directly since. However, GM Financial, without indication, warning, or otherwise, reported to XXXX a serious delinquency on my account. The only way I found out about this was through a credit monitoring service. GM Financial lost my check. GM Financial did not send any additional notices. A dispute from XXXX confirmed what was stated in my initial paragraph: I, the customer, consistently paid on my account early and in excess of the minimum amount due. However, the end result of the dispute was inconclusive. When reaching out to GM Financial to see what the problem was, they simply refused to help or even look into the matter further. The date, time, and person I spoke to from GM Financial was recorded for reference.
