Consumer Complaint: I sent an administrative process to XXXX the loan servicer for XXXX XXXX XXXX XXXX letting them know that they have unlawfully and inaccurately reported information to third party companies known as EXPERIAN, XXXX, and XXXX which have ALL hindered me from better interests rates on other products and jobs. Please see the consumer protection laws that I am including in this letter to justify my case. Also please review my documents of XXXX has agreed to remove from ALL credit reporting agencies but NAVIENT HAS NOT. THERE ARE CIVIL PENALTIES THAT I CAN APPLY FOR NON-COMPLIANCE. 15 U.S. Code 1681n - Civil liability for willful noncompliance Per the Fair Credit Reporting Act ( 15 USC 1681 ), section 602 ( a ), it underscores the imperative to ensure that consumer reporting agencies carry out their crucial responsibilities with fairness, impartiality, and a commitment to the consumer 's right to privacy. As a consumer, I affirm my entitlement to safeguard my private information, a right fortified by 15 USC 6801, which enunciates Congress 's directive that financial institutions must actively and consistently uphold customer privacy. The term " Furnisher of information to credit agencies '' encompasses financial institutions under this title. In line with 15 USC 1681, section 604 ( a ) ( 2 ), a consumer reporting agency can only furnish a consumer report upon the written instructions of the concerned consumer. I explicitly deny consent to XXXX, Experian, and any furnisher of information to credit agencies, revoking any previous consent, whether verbal, non-verbal, written, implied, or otherwise. Referring to 15 USC 6802 ( b ) ( c ), a financial institution is barred from disclosing nonpublic personal information to a nonaffiliated third party without elucidating how the consumer can exercise the nondisclosure option. The furnisher of information to credit agencies failed to apprise me of my right to exercise this option. Additionally, as per 15 USC 1681C ( a ) ( 5 ), a consumer reporting agency is prohibited from including adverse information in a consumer report without authorization. The inclusion of adverse information without my permission constitutes a violation of the law. Moreover, 15 U.S. Code 1681s2 ( A ) ( 1 ) A mandates that no person shall furnish inaccurate information to a consumer reporting agency. XXXX and Experian are falling short in adhering to reasonable procedures, as stipulated by 15 U.S. Code 1681e. Finally, according to 12 CFR 1016.7, a consumer possesses the right to opt out of reporting services at any time. I am exercising my prerogative to opt out of your reporting services. { EXPERIAN, XXXX, XXXXXXXX XXXX XXXX XXXXXXXX, XXXX, XXXX, and XXXX XXXX XXXX XXXX PLEASE REMOVE XXXX and XXXX XXXX XXXX XXXX from ALL CREDIT REPORTING AGENCIES and the {$130000.00} balance as they have agreed from my credit reports immediately please.
