Consumer Complaint: 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) clearly states that transactions between the consumer and the Person/Corporation making the report is NOT included on the consumer reports. Yet Experian is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. Experian and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer reports are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. If this derogatory account information is not deleted from my consumer reports within 30 days, I will be forced to officially file IRS form 3949A : Information Referral AND IRS form 211 : Application For Award For Original Information Overview with the Internal Revenue Service against ALL entities involved.

Consumer Complaint: Experian Credit Bureau continues to commit fraud by reporting inaccurate information on my credit report. The Fair Credit Reporting Act and the Fair Debt Collection Practices Act prohibits creditors from reporting and collecting debt that has been settled, discharged, or is no longer collectable. It stands to reason that creditors may not make credit reports or collect debt after that debt is reported on an IRS form 1099C. Per the FCRA, as a Federally protected consumer I'm now opting out of any and all authorization I the consumer may have given you written or unwritten, verbal or nonverbal per 15 U.S.C. 6802. The law says it's illegal to report transaction history on my credit report per H.R. 4120-Comprehensive Credit Act of 2021. A charge-off is considered a certificate of indebtedness which means it's considered income and income can not be reported on my credit report. According to 15 U.S.C. 6508 I have a right to opt out of the inaccurate information on my credit report. Experian Credit Bureau is in violation of 16 CFR Sec. 433.2 Preservation of consumer claims and defenses unfair or deceptive acts or practices. Experian Credit Bureau also violated the Privacy Act of 1974. The inquires on my credit report is in violation of 15 U.S.C. 1681 of the FCRA-Permissible Purposes. Also Experian Credit Bureau is in violation of the Family and Educational Privacy Act of 1974 by reporting student loan history. When I signed up for a student loan, I signed a privacy act form that said the school will not provide transaction history to any third-party companies. If my credit report isn't adjusted, I will be forced to file a lawsuit in Federal District Court.

Consumer Complaint: Dear Consumer Financial Protection Bureau, I am writing to bring to your attention significant concerns and apparent violations of the Fair Credit Reporting Act ( FCRA ) by consumer reporting agencies, XXXX and Experian, and the furnisher of information to credit agencies. My intention is to seek your assistance in addressing these issues and ensuring the proper enforcement of my rights under the FCRA. As mandated by 15 USC 1681 section 602 ( a ), the FCRA emphasizes the critical need for consumer reporting agencies to fulfill their duties with fairness, impartiality, and a profound respect for consumers ' right to privacy. XXXX and Experian, as consumer reporting agencies, are subject to these obligations under the FCRA. Furthermore, my rights to privacy and protection of nonpublic personal information are reinforced by 15 USC 6801, which establishes the affirmative and continuing obligation of financial institutions to safeguard their customers ' privacy. The furnisher of information to credit agencies falls within the definition of a financial institution under this title. I would like to draw your attention to 15 USC 1681 section 604 ( a ) ( 2 ), which explicitly states that a consumer reporting agency may furnish a consumer report only in accordance with the written instructions of the consumer to whom it relates. Despite this, both the furnisher of information to credit agencies and the consumer reporting agencies, XXXX and Experian, lack my explicit written consent to furnish my private information. I hereby revoke any and all consent, whether verbal, non-verbal, written, implied, or otherwise, granted to XXXX, Experian, and the furnisher of information to credit agencies. Additionally, in accordance with 15 USC 6802 ( b ) ( c ), a financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is provided an explanation of how they can exercise their nondisclosure option. Regrettably, the furnisher of information to credit agencies failed to inform me of my right to exercise this option, a clear violation of the aforementioned statute. Furthermore, 15 USC 1681C ( a ) ( 5 ) expressly prohibits consumer reporting agencies from including adverse items of information in a consumer report without the consumer 's explicit authorization, except as authorized under subsection ( b ). The reporting of adverse information without my permission, as witnessed in the case of the mentioned account, constitutes a violation of the law. According to 15 U.S. Code 1681s2 ( a ) ( 1 ) A, a person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. XXXX and Experian 's reporting practices may be in contravention of this provision. Moreover, 15 U.S. Code 1681e mandates that every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c and to limit the furnishing of consumer reports to the purposes listed under section 1681b. It appears that XXXX and Experian may not be adhering to these reasonable procedures. Finally, as outlined in 12 CFR 1016.7, I am formally exercising my right to opt out of the reporting services provided by XXXX and Experian. In light of the aforementioned concerns and apparent violations of the FCRA, I kindly request that the Consumer Financial Protection Bureau conducts a thorough investigation into these matters. I seek your assistance in ensuring that XXXX, Experian, and the furnisher of information to credit agencies adhere to the statutory requirements, rectify any non-compliance promptly, and provide written confirmation of the resolution. Thank you for your prompt attention to this matter. I trust that your intervention will lead to a fair and just resolution of these issues.
