Consumer Complaint: On XX/XX/2023, @ XXXX XXXX., I obtained a copy of my credit report from Experian. During my review, I noticed quite a few discrepancies, mainly with my personal information. I have contacted the bureau numerous times and sat countlessly on hold for hours of my life I can not get back. I sent them a certified letter requesting them to fix the incorrect information. The tracking number is : XXXX I advised them about the incorrect information and was rudely told that " they are a data reporting agency ; any data received by the creditor is stated and can not be changed or deleted by them.

Consumer Complaint: Experian has violated my rights. According to the Privacy Act of 1974 and Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and respect for the consumers right to privacy. I am the Consumer and I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution and its affiliates has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' In which they disclosed transactions history which is very much illegal ( 15 USC 1681 exclusions ) to third party companies. 15 U.S. Code 1681b - Permissible purposes of consumer reports Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other ( 2 ) In accordance with the written instructions of the consumer to whom it relates. I never gave written, verbal or electronic consent for any transaction history to be disclosed.

I Informed the company in writing that an Charge- off is an Certificate of indebtedness and a Certificate of indebtedness is income and that income can not be reported on my credit report. I have also in writing that having these accounts that's reporting income on my report are in violation of The Privacy Act of 1974. For these violations I asked in writing for these accounts to be deleted. The List of accounts below are the ones that require action. I made a police report right after and was advised to place a fraud alert on my credit. I recently obtained a copy of my credit profile and noticed an account and credit inquiries that I have no affiliation with or knowledge of. I reached out to the XXXX XXXX XXXX requesting verification and that these inaccuracies be removed from my credit profile. Furnishing this account and information to my profile is in violation of 15 USC 1681, not only have I not given any permission or written consent, but fraudulent accounts are being reported on my profile due to identity theft. The impact this account is having on my credit profile is preventing me from accessing new line of credit. The creditor that I have no knowledge of that's reporting to my profile is, XXXX XXXX. Consumer Complaint: 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) clearly states that transactions between the consumer and the Person/Corporation making the report is NOT included on the consumer reports. Yet Experian is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. Experian and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer reports are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. If this derogatory account information is not deleted from my consumer reports within 30 days, I will be forced to officially file IRS form 3949A : Information Referral AND IRS form 211 : Application For Award For Original Information Overview with the Internal Revenue Service against ALL entities involved.
