Consumer Complaint: I am listing accounts below that have been reported inaccurately on my credit report. In compliance with the Fair Credit Reporting Act and as a gesture of respect to the Federal Trade Commission Committee on accuracy and completeness of credit information I am formally writing in today to dispute negative information appearing on my credit. This incorrect information is greatly hindering me from getting the credit score I deserve and hopefully, this letter will resolve all the issues on my credit. I demand to see Verifiable Proof ( an original Consumer Contract with my Signature on it ) of the accounts listed below. Your failure to positively verify these accounts has hurt my ability to obtain credit.

Consumer Complaint: Per your reinvestigation, you did not provide me with any true and accurate information as to the results of your investigation of my consumer credit dispute. You are relying on the furnisher data to report the accuracy of data on my CRA report. You have not provided me ANY documentation of validation of debt nor have you provided me any relevant information from XXXX XXXX XXXX XXXX to support validation of this debt. You have not followed the law per 15 U.S.C 1681 ( i ). You have a vested interest with [ credit card company or bank ] and are receiving payment/dividends from XXXX XXXX XXXX XXXXXXXX in your contractual relationship with XXXX XXXX XXXX XXXXXXXX XXXX I previously submitted documented evidence of my payment for settlement of the above referenced account. You MUST delete and remove all errant report of this account from my consumer credit report. Please provide your description of procedures used to come to the conclusion that dispute was verified and validated by furnisher. What information did you use to base your modification of my consumer report?? Was it solely on the information provided the furnisher?? I provided you evidence and my firsthand affidavit of the account settlement if full. XXXX XXXX XXXXXXXX XXXX does not have ANY verifiable proof that they have obtained my permission either verbal or written that they have permission to report my consumer information to you in the first place. I have a right to privacy. I filed an identity theft report with the FTC XXXX XXXX XXXX XXXX stole my identity and furnished you with inaccurate information. You have a grave responsibility to fairness and impartiality with respect to my right to privacy. You are violation of 15 U.S.C 1682. XXXX XXXX XXXX XXXX refused my request of the name of original creditor, name address and phone of original Creditor. I sent you this information in my previous communication to you. You have it in your files. I have not been supplied proof per doctrine of estoppel by silence. Engelhardt V. Gravens ( mo ) 281 SW 715,719. I presume no evidence of the Alleged Debt therefore exists. You deleted XXXX From My credit report and added the account back but did not suply me information that you would reinsert the same disputed account before you placed back on my report. GRAMM-LEACH-BLILEY ACT SEC. 502. OBLIGATIONS <> WITH RESPECT TO DISCLOSURES OF PERSONAL INFORMATION. ( a ) Notice Requirements. -- Except as otherwise provided in this subtitle, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 503. ( b ) Opt Out. -- ( 1 ) In general. -- A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless -- ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 504, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. ( XXXX ) Exception. -- This subsection shall not prevent a financial institution from providing nonpublic personal information to a nonaffiliated third party to perform services for or functions on behalf of the financial institution, including marketing of the financial institution 's own products or services, or financial products or services offered pursuant to joint agreements between two or more financial institutions that comply with the requirements imposed by the regulations prescribed under section 504, if the financial institution fully discloses the providing of such information and enters into a contractual agreement with the third party that requires the third party to maintain the confidentiality of such information. ( c ) Limits on Reuse of Information. -- Except as otherwise provided in this subtitle, a nonaffiliated third party that receives from a financial institution nonpublic personal information under this section shall not, directly or through an affiliate of such receiving third party, disclose such information to any other person that is a nonaffiliated third party of both the financial institution and such receiving third party, unless such disclosure would be lawful if made directly to such other person by the financial institution. ( d ) Limitations on the Sharing of Account Number Information for Marketing Purposes. -- A financial institution [ [ Page 113 STAT. 1438 ] ] shall not disclose, other than to a consumer reporting agency, an account number or similar form of access number or access code for a credit card account, deposit account, or transaction account of a consumer to any nonaffiliated third party for use in telemarketing, direct mail marketing, or other marketing through electronic mail to the consumer. ( e ) General Exceptions. -- Subsections ( a ) and ( b ) shall not prohibit the disclosure of nonpublic personal information -- ( 1 ) as necessary to effect, administer, or enforce a transaction requested or authorized by the consumer, or in connection with -- ( A ) servicing or processing a financial product or service requested or authorized by the consumer ; ( B ) maintaining or servicing the consumer 's account with the financial institution, or with another entity as part of a private label credit card program or other extension of credit on behalf of such entity ; or ( C ) a proposed or actual securitization, secondary market sale ( including sales of servicing rights ), or similar transaction related to a transaction of the consumer ; ( 2 ) with the consent or at the direction of the consumer ; ( 3 ) ( A ) to protect the confidentiality or security of the financial institution 's records pertaining to the consumer, the service or product, or the transaction therein ; ( B ) to protect against or prevent actual or potential fraud, unauthorized transactions, claims, or other liability ; ( C ) for required institutional risk control, or for resolving customer disputes or inquiries ; ( D ) to persons holding a legal or beneficial interest relating to the consumer ; or ( E ) to persons acting in a fiduciary or representative capacity on behalf of the consumer ; ( 4 ) to provide information to insurance rate advisory organizations, guaranty funds or agencies, applicable rating agencies of the financial institution, persons assessing the institution 's compliance with industry standards, and the institution 's attorneys, accountants, and auditors ; ( 5 ) to the extent specifically permitted or required under other provisions of law and in accordance with the Right to Financial Privacy Act of 1978, to law enforcement agencies ( including a Federal functional regulator, the Secretary of the Treasury with respect to subchapter II of chapter 53 of title 31, United States Code, and chapter 2 of title I of Public Law 91-508 ( 12 U.S.C. 1951-1959 ), a State insurance authority, or the Federal Trade Commission ) , self-regulatory organizations, or for an investigation on a matter related to public safety ; ( 6 ) ( A ) to a consumer reporting agency in accordance with the Fair Credit Reporting Act, or ( B ) from a consumer report reported by a consumer reporting agency ; ( 7 ) in connection with a proposed or actual sale, merger, transfer, or exchange of all or a portion of a business or operating unit if the disclosure of nonpublic personal information concerns solely consumers of such business or unit ; or ( 8 ) to comply with Federal, State, or local laws, rules, and other applicable legal requirements ; to comply with a properly authorized civil, criminal, or regulatory investigation or subpoena or summons by Federal, State, or local authorities ; or to respond to judicial process or government regulatory [ [ Page 113 STAT. 1439 ] ] authorities having jurisdiction over the financial institution for examination, compliance, or other purposes as authorized by law. Consumer Complaint: Prior to the pandemic I opened accounts with XXXX and XXXX XXXX. When the pandemic occurred, I called both lenders and expressed my hardships along with making accommodations to pay and close the accounts. I recently viewed my credit report and both lenders are reporting late payments on closed accounts. This is in violation of FCRA law 15 USC 1681 S-2 ( F ). Not only were these payments covered under the CARES act, but I've paid as agreed and closed both accounts per my request. I reached out to both CRA ( Experian and XXXX ) via phone and mail requesting that this information be reported accurately. I have not gotten a response to my request. This information reporting inaccurately is severely affecting my ability obtain lines of credit.

Consumer Complaint: You stated that the accounts in question were reporting accurately when I have provided proof that you are reporting incorrect late payment status ( See enclosed letter from company ). This is my final notice to your company regarding the inaccurate information. I am demanding that Experian remove the late payments reporting XX/XX/2018 for the mentioned 5 accounts. XXXX and XXXX have since updated this information. If this is not updated within 7 days, I will be seeking litigation in small claims court. I am tired of trying to correct your incorrect reporting when I can just sue your company for defamation of character and gross misconduct. Please be aware that FCRA violations can be awarded up to XXXX per violation. The account that is extremely inaccurate is the account that is reporting a balance of {$4000.00} to Experian while {$3500.00} report to XXXX and XXXX. I will attach each account that is incorrect. Update EVERY account to paid as agreed never late immediately. I am also notifying my attorney just in case we have to go to court for your negligence. See the attached dispute letter, response letter, and credit report and update or remove the accounts.
