Consumer Complaint: DELETE IMMEDIATELY XXXX XXXX XXXX XXXX XXXX XXXX Per the FCRA as a federally protected consumer. I am now opting- out of any all authorization. Any and all verbal, nonverbal, written and unwritten authorization I the consumer XXXX XXXX may have given to provide my personal information to XXXX, XXXX, EXPERIAN. Per 15 USC 6802-6805. EFFECTIVE IMMEDIATELY AND INDEFINITELY. I can OPT-OUT of any account being reported on my credit file or credit report. On XXXX XXXX XXXX XXXX XXXX XXXX XXXX responded saying that XXXX XXXX sold my account to them while XXXX XXXXXXXX was still being reported on my credit report. My debt was illegally sold to a third party debt collector that I XXXX XXXX never agreed to. When XXXX received my letter I clearly stated that I am revoking and any and all authorization to use my nonpersonal/personal data and report any information on MY CREDIT FILE OR REPORT. I NEVER GAVE XXXX XXXX XXXX XXXX XXXX ANY CONSENT. XXXX DOESNT NOT UNDERSTAND THE LAW. XXXX has told the CFPB THAT THEY DONT HAVE THIS ACCOUNT REPORTING. I have disputed it and XXXX AND XXXX XXXX has violated my privacy rights ( THE PPRIVACY RIGHTS ACT OF 1974 ) and sold my account to them a year ago. This account is to be deleted on all of the credit reporting agencies XXXX, XXXX, EXPERIAN NOW. I SENT XXXX XXXX XXXX, XXXX A CEASIT AND DESIST LETTER ALREADY ON XX/XX/XXXX. I HAVE SENT XXXX MY OPT- OUT LETTER AND INVESTIGATION LETTER OF HOW AND WHEN THEY PURCHASED MY ACCOUNT FROM XXXX XXXXXXXX. per The PRIVACY ACT OF 1974 THIS IS ILLEGAL AND A VIOLATION OF MY RIGHTS UNDER THIS ACT WHICH IS A FEDERAL LAW MY PRIVACY IS PROTECTED AND GOVERNS THE COLLECTION OF MY PERSONAL INFORMATION BEING SOLD TO ANY CORPORATION/COMPANY AND MY PERSONAL INFORMATION SUCH AS MY NAME, ADDRESS, SOCIAL SECURITY NUMBER, PHONE NUMBER, ACCOUNT NUMBERS, BEING SHARED WITH. 5 U.S. Code 552a - Records maintained on individuals states that my social security number is only suppose to be shared with government agencies. Unless I XXXX XXXX chooses to release my social security number to XXXX XXXX XXXX. XXXX which I did not. The privacy rights act of 1974 and 5 usc 552a also states that I XXXX XXXX MUST give permission to any company to disclose my non personal or personal information to them. An individuals name and address may not be sold or rented by an agency unless such action is specifically authorized by law. This provision shall not be construed to require the withholding of names and addresses otherwise permitted to be made public. Both laws protect the nature disclosures. XXXX XXXX XXXX XXXX is not a government agency. They have no PERMISSION OF MINES TO BUY, PURCHASE, OR SELL MY INFORMATION FROM XXXX XXXX XXXX. XXXX CFR 29.518 - Reporting delinquent debts to credit bureaus. Privacy Act considerations. A delinquent debt may not be reported under this section unless a notice issued pursuant to the Privacy Act, 5 U.S.C. 552a ( e ) ( 4 ), authorizes the disclosure of information about the debtor to a credit bureau or XXXX XXXX XXXX XXXX XXXX is saying that they hold the rights to my non personal and personal information and can disclose this information if they wanted to per their last letter which was XXXX response to me here on the CFPB WHEN I QUESTIONED WHY IS THIS ACCOUNT BEING REPORTED DUE TO IT BEING SOLD WITHOUT MY KNOWLEDGE OR CONSENT. That sounds like they are stealing my social security number, name, address, account information and doing what they would like with it. Because of an alleged owed debt and they are NOT the ORGINAL creditor of this debt. XXXX nor XXXXXXXX XXXX XXXX never sent me any NOTICE in the mail stating how the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and the consumer is given an explanation of how the consumer can exercise that nondisclosure option. such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party. My nonpersonal and personal information is suppose to be safeguarded to insure the security and confidentiality of customer records and information to protect against unauthorized access to or use of such records or information which could result in substantial harm or inconvenience to any customer. Per the LAW 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information. This account is not with XXXX XXXX XXXX anymore they have sold the account to a collection agency XXXX XXXX XXXX XXXX XXXX Account # XXXX ) WITHOUT MY KNOWLEDGE OR PERMISSION. This account is being reported incorrectly across all credit reporting agencies Experian, XXXX XXXX, XXXX with dates and balances as well as the consistent monthly reporting of the account. These inconsistencies and false and misleading reporting of my account does a great disservice to me as a consumer, Experian is at fault for the discrepancies that is being reported with this account on my credit profile. DELETE IMMEDIATLEY DUE TO 15 U.S. Code 1692e - False or misleading representations- 2 ) The false representation of ( A ) the character, amount, or legal status of any debt. ( 10 ) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.12 ) The false representation or implication that accounts have been turned over to innocent purchasers for value. FROM MY CFPB DISPUTE IN XX/XX/XXXX. DELETE IMMEDIATELY - XXXX XXXX XXXX XXXX XXXX XXXX THESE OPT-OUT LAWS THAT I HAVE AS A FEDERALLY PROTECTED CONSUMER THAT XXXXXXXX XXXX XXXX HAS ILLEGALLY WENT OUT A BOUGHT MY INFORMATION TO FURNISH AND THIS ALLEGED DEBT. The consumer is allowed to exercise the opt-out within a reasonable period of time and in the same manner as the opt-out under that privacy notice. 12 CFR 1016.7 - Form of opt out notice to consumers ; opt out methods.- ( 1 ) Form of opt out notice you must provide a clear and conspicuous notice to each of your consumers that accurately explains the right to opt out under that section. Consumer Complaint: Hello { Experian / AL State Attorney General, and CFPB I recently received a response to a dispute that I made under FCRA 611 ( a ) regarding a few erroneous items on my credit report. I was beyond appalled to learn that you somehow verified the disputed items in question somehow and they are still on my credit report, despite multiple previous written requests, which is now a violation of federal law. According to the FCRA, you all have an obligation to have a copy of the original creditors documentation on file to verify that this information is mine and additionally, that it is reporting accurately. In the results of your initial and subsequent reinvestigation, you all simply stated in writing that you verified that these items are reported correctly, to which I ask the following question : Who verified these accounts? And how? I demand that you show me XXXX Form that allows you to share my public information that is signed by me. I ask because I am extremely interested in learning how you all arrived at this erroneous conclusion? I would like a complete list of all documents and any correspondence that came about in these alleged investigations. These lists should also include the names and contact information of anyone you spoke with as part of this investigation. Despite my request, you all have FAILED to provide me a copy of any ORIGINAL documentation ( a consumer contract with MY signature ON THE CONTRACT ) which is REQUIRED under Section 609 ( a ) ( 1 ) ( A ). Not only that, but you have also failed to provide me with the method of verification as required under Section 611 ( a ) ( 7 ). If you were actually familiar with and lawfully abiding by the FCRA, you would know that under Section 611 ( 5 ) ( A ), you are REQUIRED to ... promptly DELETE all information which can not be verified as the law is written. This is extremely clear and clearly indicates both the civil liability and the remedy available to me ( please see Sections 616 & 617 ) if you fail to comply with Federal Law. Had you actually conducted a thorough investigation properly as opposed to using your e-Oscar system you would have known that these items listed below should have been removed. XXXXXXXX XXXX XXXXXXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I have conducted my own research in this instance and learned throughout doing so that in the case of XXXX XXXX XXXX, XXXX XXXX XXXX, and XXXX XXXX XXXX, XXXX, XXXX al, the courts ruled in each and every instance throughout those cases that the Credit Reporting Agencies absolutely can not parrot information from creditors and collection agencies. In those rulings, it has been ruled that you all are REQUIRED to conduct an independent REASONABLE investigation to ensure the validity of the debt and the honesty/integrity of the creditor/collection. agency in question. Sending out a generic form through the e-Oscar system that does not even contain my reasons for the dispute is not deemed reasonable! Please be aware that I am a litigious consumer and in the process of pursuing litigation in this matter to enforce my consumer rights pursuant to the FCRA in its entirety. I expect to receive a response within 15 days of receipt of this letter containing all of the information requested above, or I will expect to see the items in question permanently removed from all records. . I have supplied all required documents multiple times establishing my identity; there is zero need for your fake games to attempt to buy time for lack of effort on your end by saying you need further information and documentation when you have everything you need as does my representation, the CFPB and my states attorneys office. Consumer Complaint: Summary : Consumer Credit Reporting Agencies ( credit bureaus ) XXXX, Experian and XXXX have overwhelmingly and repeatedly violated my right to privacy as a consumer and have not protected my nonpublic personal information as required by Title VI of the Consumer Credit Protection Act ( Fair Credit Reporting Act 15 USC 1681 et seq. ), and have also committed identity theft under 12 CFR 1022.3 - fraud committed or attempted using the identifying information of another person without authority ; aside from the FCRA violations, I believe that requesting, selling, obtaining and adding nonpublic personal financial information to my credit report constitutes as identity fraud. Explanations : " 602. Congressional findings and statement of purpose [ 15 U.S.C. 1681 ] ( a ) Accuracy and fairness of credit reporting. The Congress makes the following findings : 3 ) Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers. ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. ( b ) Reasonable procedures. It is the purpose of this title to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this title. '' 15 USC 6801 ( a ) Privacy obligation policy states : " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' Furnishers of information ( credit bureaus ) to credit agencies are by definition under that title,1 5 USC 6801, financial institutions. 604. Permissible purposes of consumer reports [ 15 U.S.C. 1681b ] states that : " ( a ) In general. Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 1 ) In response to the order of a court having jurisdiction to issue such an order, or a subpoena issued in connection with proceedings before a Federal grand jury. ( 2 ) In accordance with the written instructions of the consumer to whom it relates. Obtaining expressed written consent to report nonpublic personal information to a credit report constitutes as a reasonable procedure. Conclusion : The three Consumer Credit Reporting Agencies ( credit bureaus ), the furnishers of information to credit agencies, XXXX, Experian and XXXX have repeatedly, blatantly and brazenly defied the law as written in Fair Credit Reporting Act and Code of Federal Regulations, and have violated my rights under those laws which are written to protect my rights to privacy as a consumer. This is not a small offense, this is an egregious overstepping and acting above the law ; and it was in no way fair or equitable to me as a consumer. Had I done such a thing, I would without a doubt receive a severe fine or worse, a prison sentence. Why are these credit bureaus allowed to act outside the law, and with that destroy my financial opportunities, quality of life and cause me severe emotional distress and financial damages?

Consumer Complaint: My information has been stolen and used whom ever stolen my information they have use it illegally to apply for credit card acts with many financial institutions. : These is all unauthorized inquiries : XXXX XXXX XXXX XXXX XXXX Federal XXXX XXXX XXXX Union XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX illegal inquiries is reported illegally on my XXXX report Experian, XXXX, and XXXX reports and must be removed asap. also my XXXX report has many errors including a date of hirth of XX/XX/1984 which is inaccurate and must be deleted because my Correct dob is XX/XX/1984. also my XXXX has many addresses which is all inaccurate. my only correct address is XXXX XXXX XXXX XXXX XXXX XXXX Minnesota XXXX this illegal information must be inaccurate and must be deleted because my Correct dob is XX/XX/1984. also my XXXX has many addresses which is all inaccurate. my only correct address is XXXX XXXX XXXX XXXX XXXX XXXX Minnesota XXXX this illegal information must be deleted from my credit report under section XXXX XXXX XXXX XXXX XXXX ( B ) or the fair credit reporting act. pursuant to section XXXX XXXX Code XXXX ( B ) of the Fair Credit Reporting Act, Stating Information alleged to result from identity theft If a consumer submits an identity theft report to a person who furnishes information to a consumer reporting agency at the address specified by that person for receiving such reports stating that information maintained by such person that purports to relate to the consumer resulted from identity theft, the person XXXX not furnish such information that purports to relate to the consumer to any consumer reporting agency, unless the person subsequently knows or is informed by the consumer that the information is correct. And and send the required notifications to all furnishers of this information.
