Consumer Complaint: A charge off is considered a certificate of indebtedness which means it is income and must be removed from consumer profile. XXXX XXXX Experian XXXX Account # : XXXX XXXX XXXX ( Privacy Act of 1974 ) The law says that it is illegal to report transaction history. In accordance with the written instructions of the consumer to whom it relates. ( 3 ) To a person which it has reason to believe ( A ) intends to use the information in connection with a credit transaction involving the consumer on whom the information is to be furnished and involving the extension of credit to, or review or collection of an account of, the consumer ; Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. These procedures shall require that prospective users of the information identify themselves, certify the purposes for which the information is sought, and certify that the information will be used for no other purpose. Every consumer reporting agency shall make a reasonable effort to verify the identity of a new prospective user and the uses certified by such prospective user prior to furnishing such user a consumer report. No consumer reporting agency may furnish a consumer report to any person if it has reasonable grounds for believing that the consumer report will not be used for a purpose listed in section 1681b of this title. ( b ) Accuracy of report Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Consumer Complaint: I value your efforts in addressing some of the fraudulent items in my file resulting from an alleged identity theft. However, there are remaining items that require removal. Upon reviewing my records, I observed that several fraudulent entries, not associated with me, persist despite previous correspondence. This marks my 11th communication on this matter. According to Section 605B of the FCRA, it is a legal obligation to promptly remove fraudulent items opened due to identity theft. The disputed items are not linked to my identity. Consumer Complaint: I previously disputed with Experian directly as well as thru the CFPB website, regarding inaccurate information regarding my XXXX XXXX XXXX XXXX. I had returned my XXXX XXXX XXXX at the end of XX/XX/XXXX, purchased a XXXX XXXX, and the remainder of the lease was paid in full. My obligation per my lease agreement was satisfied. The balance that was owed to XXXX was for excess Mileage and taxes. I received a Statement from XXXX in XX/XX/XXXX, made 2 payments to XXXX. I called XXXX late XX/XX/XXXX or early XX/XX/XXXX to discuss payment options on Balance. An agreement was made for me to pay {$1000.00} and the account would be closed. Which is what I did. There was Never a Late or Missed Payment. My Experian Credit Report as well as my Credit Score, and my online Experian all indicated that I made late payments 30 + days & 60 + days, that my last late payment was XX/XX/XXXX, and I have Serious Delinquency. Experian verified with XXXX that I never made a Late payment, my Credit Report was updated to Reflect that. I thought by Experian making the changes on my Credit Report everything would automatically update, this Did Not Happen.

Consumer Complaint: The following companies have violated my rights and the Fair Credit Reporting Act by reporting incorrect information on my credit report. Recently I checked my credit report and noticed multiple billing errors under 15 U.S. Code 1666 ( b ) billing error - ( 4 ) The creditor 's failure to reflect properly on a statement a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. As I know the creditor didn't notify me 21 days before with a statement so there should be no late payments on these accounts. I demanded to see hard solid proof from the creditor bank account that I didn't pay and was marked late because this was clearly a billing error. The items below should all be updated as agreed on my consumer report. also, The Consumer reporting agency has published defamatory and false statements of alleged facts to my consumer reports, and Doing so has caused and will continue to harm me and my standing. The information reported entails private personal information which they have no right to communicate or convey to anyone without my written consent pursuant to 15 USC 1692c ( a ). Consumer Complaint: I filed a dispute with the credit reporting agencies in regards to inaccurate information reporting to my credit reports. I never received any notifications in regards to the investigation results.It Has now been over 30 days I filed a 30 day demand to comply with credit bureaus and still have yet to receive a response. According to 15usc 1681 there should not be any damages on my report and this inaccurate information is defamation of my character.

Consumer Complaint: According to the Fair Credit Reporting Act FCRA 15 USC 1681 section 602a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumer 's right to privacy. '' Experian, XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isnt shared which is backed by 15 USC 6801 which states It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. XXXX XXXX XXXX XXXX is a financial institution by definition stated in 15 U.S. Code 6827 ( 4 ) ( a ) The term financial institution means any institution engaged in the business of providing financial services to customers who maintain a credit, deposit, trust, or other financial account or relationship with the institution. Gramm Leach Bliley Act section 501 ( b ) ( 1 ) states that an agency or authority need to to insure the security and confidentiality of customer records and information and section 502 ( a ) states Except as otherwise provided in this subtitle, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 503. XXXX XXXX XXXX XXXX may not disclose my transactions and credit utilization to any nonaffiliated third party, such as and including Experian, XXXX, and XXXX. 15 USC 1681 section 604 a section 2 states that In general subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. XXXX XXXX XXXX XXXX and the consumer reporting agencies Experian, XXXX and XXXX do not have my consent to furnish non public information of my credit transactions and credit utilization and they surely do not have my written consent. Any and all consent to XXXX XXXX XXXX XXXX, Experian, XXXX, and XXXX whether it be verbal, non-verbal, written, implied, non written or otherwise is revoked. In 16 CRF 313, which is under the authority of 15 USC 6801, part 313.6 ( a ) ( 6 ) it states that privacy notices must include An explanation of the consumer 's right under 313.10 ( a ) to opt out of the disclosure of nonpublic personal information to nonaffiliated third parties, including the method ( s ) by which the consumer may exercise that right at that time ;. With that, 12 CFR 1016.1 also requires that the financial institution Provides a method for consumers to prevent a financial institution from disclosing that information to most nonaffiliated third parties by opting out of that disclosure, subject to the exceptions in 1016.13, 1016.14, and 1016.15. XXXX XXXX XXXX XXXX did not provide an adequate or reasonable opt out notice to me to opt out of nonpublic personal information pertaining to my transactions and credit utilization to non affiliated third parties. I am exercising my right to opt out of any nonpublic personal information XXXX XXXX XXXX XXXX is disclosing to nonaffiliated third parties pertaining to transaction details of monthly payments, effective immediately and back dating to XX/XX/XXXX. There will be an opt out letter attached in supporting documents. 15 USC 6802 ( b ) ( c ) states that A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless- the consumer is given an explanation of how the consumer can exercise that nondisclosure option. XXXX XXXX XXXX XXXX never informed me of my right to exercise my nondisclosure option. In addition, 15 USC 1681c ( a ) ( 5 ) states Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information. Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. This transaction information and credit utilization is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s-2 ( A ) ( 1 ) A states A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681 e states Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishings of consumer reports to the purposes listed under section 1681b of this title. Experian, XXXX and XXXX are not maintaining reasonable procedures. Not only have these listed agencies violated the Fair Credit Reporting Act, but also the Privacy Act of XXXX 5 USC 552a, and the Gramm Leach Bliley Act as these grievances fall under these Acts as well.
