I discovered unauthorized and fraudulent transactions on my account. Since then, I have diligently reported the issue to your customer service department on multiple occasions. Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and Experian are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and Experian do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, Experian, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Consumer Complaint: I the consumer, have been violated of my consumer rights by Experian, XXXX, and XXXX. I have tried to settle these matters numerous of attempts ( Attached is Certified Receipts showing proof of disputes ) but these credit reporting agencies have not been following the laws placed by Congress and the United States. The law 15 USC 1681The congress makes the following findings : unfair credit reporting methods UNDERMINE THE PUBLIC CONFIDENCE which is essential to the continued functioning of the banking system. Meaning that these credit reporting agencies are working against the consumers instead of reporting fair, equitable, and accurate information. The purpose of 15 USC 1681 is to REQUIRE that consumer reporting agencies ( Experian, XXXX, XXXX ) adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is FAIR and EQUITABLE to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this code. I have given Experian, XXXX, and XXXX written and verbal instructions to remove inaccurate, unauthorized, unverifiable information off of my consumer report as I discovered 15 USC 1681b-any consumer reporting agency may furnish a consumer report under the following circumstances and no other : In accordance with the written instructions of the consumer to whom it relates. I have verbally and physically attempted to communicate with Experian to correct the city of my address on my consumer report numerous of times. Attached in this complaint is proof of inaccurate information still on my consumer report and certified mail receipts. Which clearly shows negligence of my request that has caused me damages. I have verbally and physically written to XXXX to remove the inaccurate employer off of my consumer report in multiple attempts on recorded lines and signature documents attached herein with certified mail receipts. Which shows XXXX negligence of my request. Information regarding inquiries Except as provided in section 15 USC 1681g ( a ) ( 5 ) of this title, a consumer reporting agency ( Experian, XXXX, and XXXX ) shall NOT furnish to any person a record of inquiries in connection with a credit or insurance transaction that is not initiated by a consumer. I have notice that my consumer report has been pulled impermissibly, so I reached out to XXXX verbally and spoken with representatives on a recorded line and physically written to XXXX to remove the unauthorized inquiry thats attached herein this complaint. XXXX has shown failure and negligence to my request which has caused me damages. Also Experian, XXXX, and XXXX failed to list the disputed debt accounts attached herein as disputed. I the consumer disputed multiple alleged debts to the credit reporting agencies thats on my consumer report and they do not state disputed by consumer on all three credit reporting agencies. By law it states that the CRAs must report the alleged debt as disputed on my consumer report. Also, since I disputed a debt to one of the three major credit reporting agencies ( Experian, XXXX, or XXXX ), that particular agency must notify the other two bureaus that I disputed the alleged debt. Failing to list the account as disputed, after a valid dispute has been sent to the credit reporting agency, is a violation of the FCRA. Which again shows negligence committed by Experian, XXXX, and XXXX. XXXX, Experian, XXXX, and the financial institutions violated my rights per 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information a financial institution may not, directly or through any affiliate, disclose to a NONAFFILIATED third parties ( Experian, XXXX, and XXXX ) any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. I HAVE NEVER GAVE NOR WAS I EVER GIVEN A NOTICE OF DISCLOSURE THAT HAD GIVEN ANY FINANCIAL INSTITUTION PERMISSION TO GIVE MY PERSONAL INFORMATION AWAY WITHOUT MY CONSENT AND PERMISSION. Which is a violation of my rights as a consumer. 15USC 1681a-The term consumer report does NOT INCLUDE report containing information solely as to TRANSACTIONS or experiences between the consumer and the person making the report. On my consumer report there is multiple transactions displayed that is violating my rights as a consumer which is causing me excessive stress and damages. Experian, XXXX, and XXXX has not been following rules and regulations to report fair, accurate, equitable information. The credit reporting agencies have different report dates, remarks, past dues, account balances, high balances, monthly balances thats interfering and violating my consumer report. Which shows negligence of each credit reporting agency. Experian, XXXX, and XXXX is a third party company that is not affiliated with financial institutions. The CRAs and Financial institutions violated my rights under the Privacy Act and under the terms and conditions that were granted to me at the time of the account opening. The FTC has brought legal actions against organizations that have violated consumers privacy rights, or misled them by failing to maintain security for sensitive consumer information, or caused substantial consumer injury. In many of these cases, the FTC has charged the defendants with violating Section 5 of the FTC Act, which bars unfair and deceptive acts and practices in or affecting commerce. In addition to the FTC Act, the agency also enforces other federal laws relating to consumers privacy and security.This shows that my right to have privacy has been compromised and violated by the credit reporting agencies ( Experian, XXXX, and XXXX ). Per 15 USC 1681 et seq., governs access to consumer credit report records and promotes accuracy, fairness, and the PRIVACY OF PERSONAL INFORMATION assembled by Credit Reporting Agencies ( CRAs ). Also as discovered XXXX XXXX XXXX agreed to pay at least {$570.00} XXXX, and potentially up to {$700.00} XXXX, as part of a global settlement with the Federal Trade Commission, the Consumer Financial Protection Bureau ( CFPB ), and 50 U.S. states and territories to settle allegations th at the credit reporting company 's failed to take reasonable steps to secure its network. Per 31 USC 3104- The charge off accounts thats reported on my consumer report needs to be updated as paid as agreed and never late. Per the law stating a charge off is a certificate of indebtedness which is now considered INCOME. Income can not be reported on a consumer credit report that is a violation of rights. Section ( a ) The Secretary of the Treasury may borrow on the credit of the United States Government amounts necessary for expenditures authorized by law and may buy, redeem, and make refunds under section 3111 of this title. ( B ) Requirements Relating to Reinsertion of Previously Deleted Material Certification of accuracy of information. If any information is deleted from a consumer 's file pursuant to subpara-graph ( A ), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. ( ii ) Notice to consumer. If any information that has been deleted from a consumer 's file pursuant to subparagraph ( A ) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency. I have been trying to fix this matter for the past six months this is my FINAL ATTEMPT TO ADDRESS THESE DAMAGES AND INACCURATE UNVERIFIED INFORMATION. I DO NOT CONSENT NOR GIVE THE CRAs AND FINANCIAL INSTITUTIONS PERMISSION TO SELL NOR SHARE MY INFORMATION WITHOUT MY PERMISSION AND WRITTEN CONSENT EFFECTIVE IMMEDIATELY AND INDEFINITELY. Consumer Complaint: The are stating that they don't have my credit history. I called and they instructed me to updated my address. I put in a request to have my address updated and provided supporting documents. I still am not able to see my current credit score. My credit score has not updated since XX/XX/2023.
