Experian has unlawfully and willfully reported LATE payments and Utilization ( which are transactions and experiences ) to my credit and in accordance with the FCRA : 15 USC 1681a 2 ( A ) ( i ) : Exclusions - Except as provided in paragraph ( 3 ), the term consumer report DOES NOT INCLUDE - ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; 15 U.S. Code 1681s -2 Responsibilities of furnishers of information to consumer reporting agencies ( a ) Duty of furnishers of information to provide accurate information. ( XXXX ) Prohibition ( A ) Reporting information with actual knowledge of errors Because Late payments are considered TRANSACTIONS and utilization is considered an EXPERIENCE, in light of this I am confused as to why you EXPERIAN are reporting late payments and utilization from XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX when such an action is a clear violation of my consumer rights in accordance with the FCRA ACT! As a Consumer Reporting Agency, you hold a responsibility to report Consumer information to the best of your ability with Maximum Accuracy. That is your duty and as a consumer, I am protected under the FCRA ACT 15 U.S. Code 1681. If you EXPERIAN feel that said protection is not mine to have as a consumer, I will REQUIRE that you provide me with PROOF of an investigation into the accuracy of said late payments and utilization as well as statements showing that these payments were late, and documentation authorizing you EXPERIAN to report my utilization. If proof can't be provided, I demand these payments be updated to Paid on Time and NEVER late! And Utilization removed! Or remove it from my consumer report altogether.

Consumer Complaint: In accordance with the Fair Credit Reporting Act. The List of accounts below has violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. I told Experian, XXXX, and XXXX to reinvestigate these accounts ; letters are attached below. However, they stated everything was complete and accurate. But how is that possible if the open date, date of last activity and much more is incorrect. According to 15 USC 1681i ( 5 ), they are supposed to modify accounts that aren't reporting correctly. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.

Consumer Complaint: I looked at my credit report back on XX/XX/2023, and noticed some things that are incomplete and not accurate. I sent a letter to Experian XX/XX/2023 and asked them to investigate the completeness and accuracy of this. I received the results and noticed they did not fix anything. This is breaking Federal Law. According to 15 USC 1681e ( b ) it states this ( b ) Accuracy of report Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. According to 15 USC 1681i ( 5 ) it states ( 5 ) Treatment of inaccurate or unverifiable information ( A ) In general If, after any reinvestigation under paragraph ( 1 ) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall ( i ) promptly delete that item of information from the file of the consumer, or modify that item of information, as appropriate, based on the results of the reinvestigation; and ( ii ) promptly notify the furnisher of that information that the information has been modified or deleted from the file of the consumer. According to 15 USC 1681s-2 it states this A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ( B ) Reporting information after notice and confirmation of errors A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate; and ( ii ) the information is, in fact, inaccurate.

" According to the Fair Credit Reporting Act 15USC 1681 section 602 states " There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumer 's rights to privacy. '' XXXX, Experian, and XXXX are consumer reporting agencies and I am the XXXX. I have a right to make sure my private information is not shared. This is backed by 15USC 6801 which clearly states " It's in the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers ' non public personal information. " XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX these are all financial institutions by definition under that title, 15 USC 1681 SECTION 604 a section 2 states that " In general subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX these financial institutions and the consumer reporting agencies XXXX, XXXX, Experian do not have my consent to furnish this information and they certainly do not have my written consent. Any and all consent to XXXX, XXXX, Experian XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX. XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX. XXXX XXXXXXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states " Except as authorized under subsection ( b ). no consumer reporting agency may make any consumer report containing any of the following items of information any other adverse item information, other than records of convictions of crimes which antedates the report by more than seven years. " These accounts are reporting adverse items again without my permission which is against the law. 15U.S. Code 1681 s-2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states " Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishings of consumer reports to the purpose listed under section 1681b of this title '' XXXX, XXXX, Experian are not maintaining reasonable procedures.
