Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and Experian are consumer reporting agencies and I am the XXXX. I have the right to make sure my private information isn't shared which is backed by XXXX XXXX XXXX which states '' It is the policy of the XXXX that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. XXXX XXXX XXXX section XXXX a section XXXX states that " In general Subject to subsection ( c ), any consumer reporting agency XXXX furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the XXXX XXXX and the XXXX reporting agencies XXXX and Experian do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, Experian, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Equifax and Experian are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

Identity theft has been recorded with social security, federal trade commission, attorney general, etc. As a victim, the agency is required to instantly blocked transactions within 4 days ( 15 USC 1681 ( C ) ( 2 ) ) and 5 days ( 15USC 169 ( G ) ( A ) ) to validate debt with proof. It has been over six months dealing with this fraud on consumer report. All communication must be USPS no phone calls will be taken.

I dont recognize the account number, I dont recognize the account status, I dont recognize the account high balance, or the late payments that are associated with it. Everything here reported does not meet the FCRA Requirement. Account numbers XXXX XXXX XXXX 15 USC 1692g refers to a section of the Fair Debt Collection Practices Act ( FDCPA ) that requires debt collectors to send consumers a written validation notice about the debt within 5 days of initial contact. Specifically, 15 USC 1692g states that the written notice must contain : 1. A copy of the original contract or original purchase agreement that created the alleged debt. it must include signatures for all parties. Any agreement sent must be with the original creditor and must include the original terms and conditions of the agreement that created the alleged debt, including all addendums and riders. 2. Also include a full accounting history from the original creditor including the date and amount of each payment and the Date of First Delinquency leading to the collection status 3. In addition please send me proof of chain of ownership the alleged debt and included proof of assignment for of each change of ownership If any interest or fees have accrued or been added a the balance, please send proof that such fees are lawful ai. agreed upon in the original purchase agreement. 4. Proof that you are legally allowed to collect on alleged debts in the state of California, including your Third-Part Debt Collection Bond 5. Also send proof that you sent the legally required notices to me before reporting this alleged debt to any consumer reporting agencies, including copies of the original notice and any letter tracking your firm maintains. Consumer Complaint: On XXXX XXXX XXXX XXXX, I sent a letter to XXXX, Experian, XXXX, and XXXX XXXX regarding numerous violations of the Fair Credit Reporting Act in which the aforementioned Credit Reporting Agencies failed in their grave responsibilities to exercise fairness, impartiality, and respect for the consumer 's right to privacy. Per 15 USC 1681b the CRA may furnish a consumer report in accordance with written instructions of the consumer to whom it relates. As the consumer, I did not give them written. Also, I believe that they have also violated the Privacy Act of 1974 by disclosing a record without my written consent. I requested that the CRAs mentioned above discontinue reporting account status, payment history, and derogatory remarks as it is a violation according to 15 USC 1681a ( 2 ) ( A ) ( I ) but they failed to abide by my request or abide by my request to opt out of this reporting per 12 CFR 1016.7. These violations have caused me irreparable harm, and adverse actions, and have affected my livelihood. Congress has put into place legislation to protect the consumer from these inaccuracies and methods to undermine public confidence in the banking system. My privacy has been breached by these aforementioned CRAs and they must be held accountable for their willful noncompliance.

I am extremely frustrated with this situation, as I was promised that this issue would be resolved within 10 days. It has now been 65 days and the issue is still impacting my credit score, which is preventing me from moving forward on a loan. This is causing me a great deal of emotional and physical distress, and I am at my wit 's end.
