Consumer Complaint: To whom it may concern Re : Violations of the Fair Credit Reporting Act ( FCRA ) and the Gramm-Leach-Bliley Act ( GLBA ) To Whom It May Concern, I am writing to bring to your attention multiple violations of federal laws committed by XXXX, Experian, and XXXX that have resulted in unauthorized and inaccurate reporting of my personal information. These violations are in direct contravention of the Fair Credit Reporting Act ( FCRA ), 15 USC 1681, the Gramm-Leach-Bliley Act ( GLBA ), 15 USC 6801, and associated regulations, particularly 12 CFR 1016.7. * Unauthorized Sharing of Personal Information According to 15 USC 6801, it is the policy of Congress that each financial institution, which includes Furnisher of Information to Credit Agencies, has an obligation to respect the privacy of its customers and protect the confidentiality of their nonpublic personal information. Despite this, neither [ Furnisher of Information to Credit Agencies ], nor XXXX and Experian, obtained my written consent to furnish my personal information. Furthermore, 15 USC 1681 section 604 ( a ) ( 2 ) unequivocally states that a consumer reporting agency may furnish a consumer report only in accordance with the written instructions of the consumer to whom it relates. As such, any consent provided, whether implicit or otherwise, is hereby revoked. Relevant USC and CFR codes : 15 USC 6801, 15 USC 1681 section 604 ( a ) ( 2 ), 12 CFR 1016.7 * Failure to Inform of Nondisclosure Option 15 USC 6802 ( b ) ( c ) dictates that a financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how to exercise their nondisclosure option. XXXX, XXXX, experian failed to inform me of my right to exercise this option, thereby breaching this legal requirement. Relevant USC and CFR codes : 15 USC 6802 ( b ) ( c ) * Reporting of Unauthorized Adverse Item Per 15 USC 1681c ( a ) ( 5 ), no consumer reporting agency may include adverse information in a consumer report without authorization, unless it falls under specific exceptions, which do not apply in this case. XXXX and Experian, XXXX are reporting adverse information without my permission, a clear violation of the law. Relevant USC code : 15 USC 1681c ( a ) ( 5 ) * Failure to Maintain Reasonable Procedures 15 U.S. Code 1681s2 ( A ) ( 1 ) explicitly states that a person shall not furnish information to a consumer reporting agency if they know or have reasonable cause to believe that the information is inaccurate. XXXX and Experian are in breach of this provision by furnishing inaccurate information. Furthermore, 15 U.S. Code 1681e mandates that consumer reporting agencies must maintain reasonable procedures to avoid violations of FCRA. XXXX and Experian, XXXX have failed to maintain such procedures. Relevant USC codes : 15 U.S. Code 1681s2 ( A ) ( 1 ), 15 U.S. Code 1681e In light of these serious violations of federal law, I demand immediate action to rectify these issues and ensure that my personal information is not inaccurately reported and shared without my explicit written consent. I am seeking the maximum penalty of {$1000.00} per violation, as allowed by law. Per the fcra as a federally protection consumer I am now opting out of any and all authorization I the consumer may have given you written unwritten verbal non verbal per 15 usc 6802 I am also invoking my right under 12 CFR 1016.7 to opt out of your reporting services with immediate effect. been trying to solve this problem for some time with your agency and the corporations and debt collectors you allowed to put fraudulent inaccurate items on my credit report without permissible purpose. Consumer Complaint: XXXX XXXX XXXX ( Original Creditor : XXXX XXXX BANK XXXX XXXX. ) XXXX. I am writing to dispute the account referenced above. I have disputed this account information as inaccurate with you, and you have come back to me and stated you were able to verify this debt. How is this possible? Under the laws of the FDCPA, I have contacted the collection agency myself and have been unable to get them to verify that this is indeed my debt. I enclose copies of the account with the original creditor which show XXXX completely different balances. Furthermore, the original creditor stated that the account was sold to the Recoveries dept. This debt you are claiming on my credit report is not mine and I was given no evidence of my obligation to pay this debt to this collection agency named XXXX. The FCRA requires you to verify the validity of the item within 30 days in which you failed. If the validity can not be verified, you are obligated by law to remove the item. There is a clear case of unverified debt here, and I urge you to remove this item before I am forced to take legal action. In the event that you can not verify the item pursuant to the FCRA, and you continue to list the disputed item on my credit report, I will find it necessary to sue you for actual damages and declaratory relief under the FCRA. According to this regulation, I may sue you in any qualified state or federal court, including small claims court in my area.
