Consumer Complaint: I was laid off due to the pandemic and called XXXX XXXX to make accommodations to ensure my credit would not be impacted because due to my hardship. I recently check my credit report in XX/XX/XXXX. I called XXXX and was assured the late payments were in error and would be updated and removed. I checked my report again XXXX and XXXX and seen the payments still being reported. I contacted Experian and XXXX and requested verification of me being late. I have not received a response and this is severly impacting my payment history. Reporting inaccurate late payments to my profile is in violation of 15 USC 1681 s-2 ( f ), those payments were covered under CARES ACT. After calling to ensure the LATE PAYMENTS ( XXXX, and XX/XX/XXXX ) reporting was in error, this further violates 15 USC 1666B.

Consumer Complaint: I have done everything by the book with disputing these accounts. Ive contacted the bank in regards to this matter. They claimed its been resolved. Ive contact the law enforcement agency and filed a report and affidavit. They claim they identity theft report is valid. And lastly, Im contact the credit reporting agencies. Both XXXX and XXXX have removed the accounts per legal requirement. But for some weird reason Experian feels Im not following all the steps. I know the consumer laws and the courts are very lenient with the banks and credit reporting agencies so filing a lawsuit is a waste of energy. Seeing Ive submitted my claim with Experian for over 6 months, Im at wits end. This is the 6th complaint Ive filed against them and every time I get the same ridiculous response. They make some absurd claim that the documents Ive submitted are not valid. Id like the CFPB to honestly look closely at this case because it seems this is a lack of their legal requirement to process the identity theft report. I have filed it with a law enforcement agency. Identitytheft.gov is a federal law enforcement agency. Id like to see this matter handled properly. All this grief of identity theft and not having any access to my credit is creating a ton of emotional and physical distress. Its cause a great deal of strain in my work and personal lives.
