Consumer Complaint: I was laid off due to the pandemic and called XXXX XXXX to make accommodations to ensure my credit would not be impacted because due to my hardship. I recently check my credit report in XX/XX/XXXX. I called XXXX and was assured the late payments were in error and would be updated and removed. I checked my report again XXXX and XXXX and seen the payments still being reported. I contacted Experian and XXXX and requested verification of me being late. I have not received a response and this is severly impacting my payment history. Reporting inaccurate late payments to my profile is in violation of 15 USC 1681 s-2 ( f ), those payments were covered under CARES ACT. After calling to ensure the LATE PAYMENTS ( XXXX, and XX/XX/XXXX ) reporting was in error, this further violates 15 USC 1666B.

Consumer Complaint: I have done everything by the book with disputing these accounts. Ive contacted the bank in regards to this matter. They claimed its been resolved. Ive contact the law enforcement agency and filed a report and affidavit. They claim they identity theft report is valid. And lastly, Im contact the credit reporting agencies. Both XXXX and XXXX have removed the accounts per legal requirement. But for some weird reason Experian feels Im not following all the steps. I know the consumer laws and the courts are very lenient with the banks and credit reporting agencies so filing a lawsuit is a waste of energy. Seeing Ive submitted my claim with Experian for over 6 months, Im at wits end. This is the 6th complaint Ive filed against them and every time I get the same ridiculous response. They make some absurd claim that the documents Ive submitted are not valid. Id like the CFPB to honestly look closely at this case because it seems this is a lack of their legal requirement to process the identity theft report. I have filed it with a law enforcement agency. Identitytheft.gov is a federal law enforcement agency. Id like to see this matter handled properly. All this grief of identity theft and not having any access to my credit is creating a ton of emotional and physical distress. Its cause a great deal of strain in my work and personal lives. Consumer Complaint: I am writing to express my dissatisfaction and frustration regarding the XXXX XXXX attempts to correct the late opening of my account and removal of public record with Credit Bureaus. My account was expected to be opened, but despite my persistent efforts to rectify the situation, it remains unresolved. Despite these efforts, the late opening of my account has caused inconvenience and frustration. I have patiently cooperated with your representatives, but the lack of resolution is unacceptable. I understand that errors can occur, but the repeated assurances without tangible results are disappointing. As a customer, I expect a higher level of service and a XXXX resolution to such matters. I kindly request the following actions : XXXX investigation into the root cause of the issue. XXXX communication regarding the steps being taken to resolve the problem. Later looking at it, I found that the information you are stating on some items contains not only invalid and inadequate data, but both inaccurate and incorrect data as well.This data is hurtin me since it is affecting the interest rates that I am able to get and limits my credit capacity. I am distressed that you failed to keep up reasonable methods to assure the most extreme possible legitimate completeness, accurateness and correctness in the credit reports that you give to creditors. This letter is a formal complaint that you are reporting invalid and incomplete account data as well as both inaccurate and incorrect account information. After being informed I heard that there are Federal Laws to ensure credit reporting bureaus such as yours must only report 100 % valid, complete, accurate and correct information on my credit report to potential creditors. Therefore, Pursuant to 15 U.S.C section 1681 ( e ) of the Fair Credit Reporting Act. They did not reply with what they are supposed to respond with. Please also tell the subscribers who reported these items within 5 days after receiving these disputes, and verify that the person has my full name, address, date of birth, social security number, account number, status, date of last activity, balance, high balance, and amount as applicable. If these disputed data are found to be invalid, incomplete, inaccurate or incorrect, then the entire items must be deleted from my credit report within thirty days. If the validity, completeness, accuracy and correctness can not be verified, you are obligated by law not to change or update the information, but to erase the item permanently from my credit report. Please know that if your response to my request contains any remark such as changed, updated or new information below rather than deleted you are in violation of Federal Law, I will be forced to take further action against you as the Federal Law clearly states that the item must be deleted. When you complete your investigation Pursuant to 15 U.S.C. section 1681 ( i ) ( 7 ) whereby a consumer reporting agency shall provide to a consumer the requested detailed description referred to in paragraph and section ( 6 ) ( B ) ( iii ) by not later than 15 days after receiving a request from a consumer for that description, of the method of verification used and the name of the person at the source you contacted, the furnishers business name, address, phone number and date this verification has transacted. If you can not provide a detailed description of the method of verification and the contact information of the furnisher then you are in violation of procedure and must delete the item. If you dont abide by this request or give an insufficient or incomplete response I will have no other choice but to contact my State Congressional Representative, who will forward this matter quickly to the State Attorney General and Federal Trade Commission for urgent attention and please understand that this letter of dispute is now time stamped. In the event that you continue to list the disputed item on my credit report I will find it necessary to file suit against your company for actual damages and punitive damages under the Fair Credit Reporting Act. Because the Fair Credit. Reporting Act provides concurrent jurisdiction in federal and state courts, I shall elect to use my residency county and state as jurisdiction to bring appropriate action against your company. While I prefer not to file lawsuit, I will utilize the courts as needed to enforce my rights under the FCRA. Also, at the very end of this letter you will see my correct personal data.
