Consumer Complaint: Attention : XXXX XXXX XXXX XXXXXXXX and Experian I received a notice dated XX/XX/XXXX from XXXX XXXX saying an application for an apartment in my name was conditionally approved but that a credit check showed serious delinquencies & late payments. I am requesting XXXX XXXX explain why I was not contacted after they pulled my credit and saw the identity theft alert. I also need XXXX XXXX to send me a copy of their landlord tenant report ; along with the writtten consent for the credit check & the certification XXXX XXXX XXXXubmitted to the the primary credit reporting agencies ( XXXX XXXX XXXX Experian ). In XX/XX/XXXX, I filed an identity theft report online with the Federal Trade Commission a copy of which is attached. This same report was mailed via XXXX to XXXX XXXX XXXX Experian along with requests that an extended fraud alert be placed on my consumer credit file ( copies of which are also attached ). XXXX XXXX XXXX Experian acknowledged receipt of the FTC identity theft report & extended fraud alert request but did not place the extended fraud alert on my consumer file. I can only conclude that XXXX XXXX XXXX Experian are continuing their same practices of violating the credit reporting procedures as outlined in the attached article from XX/XX/XXXX. It was noted that these credit reporting agencies fail to validate accounts that are disputed & they discard customers ' evidence. In my case it seems clear that the credit reporting agencies have discarded my evidence and failed to validate the accounts identified as fraudulent. Since the extended fraud alert was not placed on the account, I called XXXX XXXX & they placed a temporary identity theft alert on my account & forwarded it to the other two major credit reporting agencies. Once the identity theft alert was placed on my file, & since I already submitted an identity theft alert the credit reporting agencies were supposed to immediately block the accounts identified in the FTC Identity Theft Report as fraudulent. According to Section 605B.Block of information resulting from identity theft [ 15 U.S.C. 1681c-2 ] ( a ) Block. Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of ( 1 ) appropriate proof of the identity of the consumer ; ( 2 ) a copy of an identity theft report ; ( 3 ) the identification of such information by the consumer; and ( 4 ) a statement by the consumer that the information is not information relating to any transaction by the consumer. In addition, I exercised my rights to place a temporary security freeze on my credit profile to give the credit reporting agencies an opportunity to do a fair investigation & remove the inaccurate, fraudulent accounts. Despite the previous investigations by the CFPB, the major credit reporting agencies still seem determined to vioIate consumers ' rights in having accurate information removed from their reports. It is hard enough to remedy the effects of identity theft and now XXXX XXXX XXXX Experian are intentionally defaming my character despite repeated proof that these negative accounts are inaccurate. XXXX XXXX XXXX Experian 's malicious actions have interfered with me being approved for housing which is a basic human right. XXXX XXXX XXXX Experian will therefore be held civilly liable to the fullest extent of the law. Furthermore, despite repeated requests neither the furnishers of these fraudulent accounts nor the credit reporting agencies have been able to prove that these fraudulent accounts are accurate. This is definitely corrupt & will not be tolerated. Finally XXXX XXXX should have seen the identity theft alert & security freeze & should have taken reasonable steps to inquire with me the consumer rather than assuming these fraudulent accounts were being reported accurately.
