Consumer Complaint: per Privacy Act of XXXX ( 5 U.S. Code 552a ) please apply these laws. per Family Educational Rights and Privacy Act ( XXXX ) The Family Educational Rights and Privacy Act ( XXXX ) is a federal law enacted in XXXX that protects the privacy of student education records. XXXX applies to any public or private elementary, secondary, or post-secondary school. 20 USC 1232g ( b ) 15 U.S. Code 1681- Congressional findings and statement of purpose consumers right to privacy. ( b ) Reasonable proceduresIt is the purpose of this subchapter to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this subchapter.Important Definitions from 15 U.S. Code 1681a - Definitions ; rules of construction The term consumer reporting agency means any person which, for monetary fees, dues, or on a cooperative nonprofit basis, regularly engages in whole or in part in the practice of assembling or evaluating consumer credit information or other information on consumers for the purpose of furnishing consumer reports to third parties, and which uses any means or facility of interstate commerce for the purpose of preparing or furnishing consumer reports. The term consumer means an individual. The term consumer report means any written, oral, or other communication of any information by a consumer reporting agency bearing on a consumers credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living ( 2 ) Exclusions ( A ) ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; Reporting Transaction history is illegal 12 CFR 1022.3 Definitions Identity theft means a fraud committed or attempted using the identifying information of another person without authority. Anything added to your report without your written consent could be considered Identity theft 15 U.S. Code 1681c2 - Block of information resulting from identity theft Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of ( 1 ) appropriate proof of the identity of the consumer ; ( 2 ) a copy of an identity theft report ; ( 3 ) the identification of such information by the consumer; and ( 4 ) a statement by the consumer that the information is not information relating to any transaction by the consumer. " ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and Experian do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, Experian, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and Experian are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

I have the right to make sure my private information is not shared which is back by 15 U.S. Code 6801 ( a ) It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. The U.S. Department of Education notified me that my application for Borrower Defense to Repayments discharge of my loans has been approved and that I will receive full relief. Discharging 100 % of the loans, as a result the loans have no remaining balance. According to The Fair Credit Reporting Act 602. Congressional findings and statement of purpose [ 15 U.S.C. 1681 ] ( a ) Accuracy and fairness of credit reporting. The Congress makes the following findings : ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. ( b ) Reasonable procedures. It is the purpose of this title to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this title. Consumer Complaint: There are several items that appear on my consumerreport from entities that I have never signed any contract/agreement with, done business with, and/or provided consent or authorization to furnish any information to a third-party. Under section 609, I have requested that this credit reporting agency provide the original documents that also contains my physical signature along with any other supportive information to conclude their dispute ; or remove the items from my credit report As stated in Section 609 ( a ) ( 1 ) ( A ) of the Fair Credit Reporting Act, you are legally obligated to verify the authenticity of all accounts posted on a credit report by physically verifying the original signed consumer contract. Otherwise, there is a risk of fraudulent accounts being submitted through fax, mail, or email by anyone utilizing their reporting services.Their failure to adequately verify these accounts has adversely affected my creditworthiness. According to the FCRA, any unverifiable accounts must be removed. If they are unable to furnish verifiable proof, they must eliminate the accounts specified in my dispute letters. In addition, I have requested a thorough and manual verification, including the date that they have contacted the furnisher, the name and address of the furnisher, the name of the agent, the method of communication, and most importantly if the furnisher provided my name, address, and/or dob. I have yet to receive any of this information! They are willfully being non-compliant. It is injurious to my credit report and has significantly impacted my financial well-being and credit score.
