Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, Experian and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX DEPT OF EDUCATIONXXXX XXXX XXXX XXXX XXXX are a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, DEPT OF EDUCATIONXXXX XXXX XXXX XXXX XXXX the financial institution and the Consumer reporting agencies XXXX, Experian and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, Experian, XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX DEPT OF EDUCATIONXXXX XXXX XXXX XXXX XXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, DEPT OF EDUCATION/XXXX XXXX XXXX XXXX XXXX never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information, any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' These account XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX DEPT OF EDUCATION/XXXX XXXX XXXX XXXX XXXX is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, Experian and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting Services. Effective immediately. I have exercised my rights multiple times about these adverse accounts and nothing has happened. XXXX, XXXX and Experian have XXXX days to remove these adverse accounts off my credit. After the XXXX days allotted I will seek civil damages in a Wisconsin court.

Consumer Complaint: XXXX assumed mortgage from XXXX effective XXXX. We immediately made our payment through our XXXX bill pay. XXXX sent the payment to the XXXX headquarters, in XXXX, N.C. We heard nothing until a month had passed. Then the payment was returned because the address was incorrect. Payments were to be sent to XXXX XXXX XXXX office. We immediately sent the payment to XXXX, and also sent the XXXX payment to XXXX. We have continued to make our payment, on time, but XXXX continues to deny receipt of the XXXX payment. We have spent countless hour in phone calls, sent emails and a letter to the President. All with no result, after 3 months.

Consumer Complaint: Experian and XXXX along with OTHER 3rd party businesses, or affiliates currently show negative, inaccurate derogatory information reporting from XXXX XXXX XXXX XXXX. The issue is I never had an open revolving visa cash rewards credit card with a balance pending in the amount of {$100.00} or more with a limit of {$5000.00}. I had a cash rewards visa but that was paid off limit amount {$3500.00}. I have never consulted nor consented for XXXX to sell my name email to any mutual insurance or investors. In addition my mortgage and other personal loans are not being posted accurately by these 3 bureaus from XXXX XXXX XXXX. There has not been a lag period more than 30 days. Why is XXXX reporting to Experian after paid and closed $ XXXX but updates highest balance $ XXXX? Just a lot of inaccuracies not doing me any favors. Instead things appear as though they are not in my case late, delayed, or hurting characterized in payments. However I have no delays no deficiencies pending w/any lenders mortgage payments or XXXX XXXX all in good standing. The current mortgage value is not $ XXXX it's below. And XXXX leads what other lenders are seeing on my report.

I've spoke with them and different attorneys ( but not represented ) which advised me to dispute the action with supporting documentation reflecting that this is not my debt or property. I disputed the action twice with Experian and XXXX, however recently this debt has appeared on my XXXX account as well. I've made it very clear with supporting document showing that I did not purchase, nor do I own this Resort at any time in my life. I have never purchase nor sign any documents to purchase this or any other Resort at any time however I do have a ex-wife ( owner ) who already owned this Resort years before our meeting, and this is where we spent the honeymoon in XXXX XXXX XXXX but I did not sign or co-sign with her or for her, for purchase or upgrade. During the divorce we verbally agreed that we would finalize any and all finical obligation between us with no interruptions however I did have her signed a agreement prior to our divorce concerning the XXXX XXXX Account because they started calling me sometime in XXXX, after our legal separation. Again, XXXX XXXX was bought by my ex-wife before I meet her sometime in XXXX or XXXX and she ( or the company ) upgraded the account in XXXX. Never has this Company obtain a Credit Report from me ( by my permission ) for my own purchase nor to add me to the financial obligation or deed. This account was not reported on my Credit Report in the year of XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and for XXXX or XXXX of the months in XXXX. Then XXXX years ( and more ) after the opening of this XXXX XXXX XXXX Account ending in XXXX, it suddenly appears on my XXXX, Experian and now XXXX Credit Reports. This account number that was associated with my e name and Social Security Number ( as reflected with the legal IRS Form 1098 ) mysteriously in XXXX, suddenly reflects my name and SSN ( with the same XXXX Account Number ending in XXXX ). I believe that my identity has been illegal used and signature has been forged in order to put this in my name to release the original owner of the debt and relationship with XXXX XXXX XXXX XXXX. This is a false and forged action not only by signatures but also by residential address. At least XXXX address were used as well and listed on my Credit Report in which I've never known about or seen until their appearance on my credit report. XXXX XXXX XXXX has never sent me mail or certified mail at any of my actual address concerning this manner. Since the year of XXXX XXXX XXXX XXXX has harassed me by phone and email concerning this debt, in which I referred them to the owner. They did continue to call me but I did not answer. They did email me trying to convince me to sign documents agreeing to owning or selling to release myself from the debt but I told them Im not the owner. This has been going on since XXXX and I've been fighting with XXXX XXXX XXXX for almost XXXX years and Credit Bureaus for close to XXXX years. This XXXX XXXX XXXX XXXX has now been foreclose in my name on XXXX XXXX XXXX. I've attempted to resolve these issue in many different direction with you being the last along with a few other agencies to insure that the correct actions take place and are finalized and reported.

Myself along with the other guests reported the incident to local authorities on site. Furnishing accounts to my report in direct relation to identity theft is in violation of 15 USC 1681c-2. I've sent two letters requesting an update and verification with no formal response. I also noticed credit inquiries on my report that I have not authorized. Furnishing information to my profile without my written consent or permission is in violation of 15 USC 1681.
