I am agent for XXXX XXXX only. I do not use XXXX other name, nor have I used XXXX other name in the past or authorized any other name to be used. XXXX ACCOUNTS : Experian is reporting wrong dates and the following accounts as open which is not under FCRA Compliance. XXXX XXXX XXXX alleged account is not XXXX and more than XXXX no reporting until I disputed the charge. Experian refuses to investigate. Failed to provide contract or evidence requested. Both accts are actively engaged in ghost reporting to make it appear as though the accounts are active and open. My information was shared with these creditors in which I did not authorize. Provide me with the XXXX compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated '', let 's be clear that I am not asking you to validate or verify anything. This was a joint with my husband. XXXX has deleted this information from my husbands account. Please see attachment from my husband account. I have received a copy of my consumer reports and I notice you have furnished transactions on my consumer report that is excluded by law as per the FCRA XXXX5 USC 1681a 2Ai. ( 2 ) Exclusions-Except as provided in paragraph ( 3 ) the term consumer report does not include- ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; A consumers transactions are excluded from the consumer reports. FICO and or any other Risk score or algorithm that you use to calculate a consumers credit score is not a factor where the consumer report is concerned! Definition of what the consumer report means. Consumer report ( 1 ) In general- The term consumer report means any written, oral, or other communication of any information by a consumer reporting agency bearing on a consumers credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living which is used or expected to be used or collected in whole or in part for the purpose of serving as a factor in establishing the consumers eligibility for- ( A ) credit or insurance to be used primarily for personal, family, or household purposes : ( B ) employment purposes : or ( C ) any other purpose authorized under section 1681b of this title. FICO or none of its factors are not defined or included in the definition of the consumer report! Therefore, the reporting of transactions between the consumer Myself ( XXXX XXXX ) and XXXX XXXX XXXX is a violation of 15 USC 1681a the definition of the consumer report does not include FICO or Vantage which makes their factors or algorithm not a factor where the consumer report is concerned. You have furnished transaction information on the following accounts. XXXX XXXX XXXX Account # XXXX 15 USC 6801 It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. 15 USC 6802 A financial institution may not, directly or through any affiliate, disclose to a non-affiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803. Obligations with respect to disclosures of personal information. A. Before a financial institution report my information, they must ask for my permission. B. Before you report the information you must tell me, and I will give you a yes or no. C. If I say no they must now tell me what I need to do to ensure my information is not given. The information that I give to my financial institution is my personal information. It is confidential. They can not give access to my information without my permission. I did not give XXXX XXXX XXXX my permission to give out my personal information. XXXX XXXX XXXX has broken the law. XXXX XXXX XXXX has broken my trust and confidentiality. This goes against my rights as consumer under the Fair Act. XXXX XXXX XXXX has charged fraudulent late fees and in addition inserted late payments on my consumer report, all payments were made on time, all payments were exact, and all payments were made on their respective due date. CFPB Takes Action Against XXXX XXXX XXXX for Illegally Charging Junk Fees, Withholding Credit Card Rewards, and Opening Fake Accounts. XXXX XXXX XXXX will pay more than {$100.00} XXXX to harmed consumers, and {$150.00} XXXX in penalties to CFPB and Office of the Comptroller of the Currency XX/XX/2023. XXXX XXXX XXXX harmed hundreds of thousands of consumers over a period of several years and across multiple product lines and services. Specifically, XXXX XXXX XXXX : XXXX a double-dipping scheme to harvest junk fees : XXXX XXXX XXXX had a policy of charging customers {$35.00} after the bank declined a transaction because the customer did not have enough funds in their account. The CFPBs investigation found that XXXX XXXX XXXX double-dipped by allowing fees to be repeatedly charged for the same transaction. I have also sent over a certified notarized affidavit of truth upon sending my letters, I spoke with representatives at EXPERIAN XXXX XXXX XXXX DATA SOLUTIONS XXXX XXXX about the fraudulent accounts and information that is consistently been on my consumer report, their investigation fixed nothing these are the accounts of the violations via FCRA and California consumer privacy act. I have reached out to the BBB, the FTC, the XXXX and STATE ATTORNEY GENERAL AND XXXX consumer protection and innovation 15 USC 1681| ( A ) ( 1 ) ( A ) ( a ) REINVESTIGATIONS OF DISPUTED INFORMATION ( 1 ) REINVESTIGATION REQUIRED ( A ) In general Subject to subsection ( f ) and except as provided in subsection ( g ), if the completeness or accuracy of any item of information contained in a consumer 's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, the agency shall, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before end of the XXXX period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Per 16 CFR 313.7 ( f ) Continuing right to opt out. A consumer may exercise the right to opt out at any time. Per the Fair Credit Reporting Act as a federally protected consumer I am now opting out of XXXX and XXXX authorization, I the consumer my have given you written, unwritten, verbal, and non-verbal per 15 USC 6802 to 15 USC 6805.
