Issue: Incorrect information on your report
Subissue: Public record information inaccurate
Consumer Complaint: I've written to you in XXXX regarding these intentional violations by these for profit companies below and I'm now seeking monetary remedy. The receipts for those are XXXX for XXXX XXXX XXXX XXXX XXXX for XXXX, XXXX, for XXXX, XXXX, for XXXX XXXX and XXXX, for Equifax. I'm also looking for a consumer Attorney to go after these companies to collect for damages they've intentionally have caused me and continue to do. You already know the story of XXXX phishing or soliciting for my information to sell it for profit while financially crippling me. For XXXX years I've been unable to operate in commerce, unable to purchase a house and this past year, I've been unable to purchase myself an automobile because of this. Not once have any of these people who I've written notices to have legitimately responded with the law and what gives them the right to intentionally violate my rights and not one responded with such laws. The most recent times, I've written to these three companies regarding the removal of this unlawful bankruptcy that is harming my credit profile that I've never given any written consent for them to put on there, including the charges that I've charged them for these violations, and damages they've caused and continue to cause. Per tacit agreement they were also warned that they were going to be charged each day that they continue to report these harmful remarks on my report pursuant to the terms as they agreed upon per tacit agreement and acquiesce : XXXX Previous Affidavit Tracking # XXXX XXXX XXXX XXXX XXXX XXXX, Received on XX/XX/XXXX at XXXX Equifax- Previous Affidavit Tracking # XXXX XXXX XXXX XXXX XXXX XXXX, Received on XX/XX/XXXX XXXX XXXX XXXX- Previous Affidavit Tracking # XXXX XXXX XXXX XXXX XXXX XXXX, Received on XX/XX/XXXX at XXXX XXXX was the only one to delete it sometime around XX/XX/XXXX of XXXX, however I had to dispute it multiple times in order to get the damaging bankruptcy removed from my credit profile. According to : 15 U.S.C. 1681 section 602 A. States I have a right to privacy. These actions also violate my rights under the Privacy Act of 1974. According to : Office of Privacy and Civil Liberties, U.S. Department of Justice, under The " No Disclosure without Consent '' Rule : I have a right to privacy if I never gave them consent. If I did give them my consent, they must provide me with a certified copy, sworn and signed and notarized before a public notary of a county clerk officer. According to : 15 U.S.C. 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish an account without my written instructions. According to : 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S.C. section 603 section ( 3 ) ( E ) States ; The term " investigative consumer report '' means a consumer report or portion thereof in which information on a consumer 's character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with who he is acquainted or who may have knowledge concerning any such items of information. However, such information shall not include specific factual information on a consumer 's credit record obtained directly from a creditor of the consumer or from a consumer reporting agency when such information was obtained directly from a creditor of the consumer or from the consumer. These companies are the prime reason why consumers have their identities stolen each year by way of careless misuse of consumer 's private information. These companies should not have this type of control over consumers and should be shut down for good. You've already received from me the evidence regarding these facts. These Credit Reporting agencies willfully continue to cause me severe damages, XXXX XXXX XXXX to where I just want to give up on life, invasion of privacy, selling my private information to third parties, ruined my reputation, causing me tons of money in unnecessary fees in interest, causing me to be discriminated against due to unfair practices and continue to get denied my own credit, and unable to establish a sustainable living to support my family. I've been unable to use my credit to purchase another automobile due to the unlawful deceptive actions and the fraud perpetrated against me by XXXX representatives. Issue: Problem with a company's investigation into an existing problem
Subissue: Investigation took more than 30 days
Consumer Complaint: I received a response from XXXX XXXX Bank Manager " XXXX XXXX '' in relation to a billing error indicating 30 days late on my credit report. The company 's investigation after the response on ( XX/XX/XXXX ) has taken more than 30 days. I sent notice and ask the company of proof of the late payment or Notice of Late payment in relation to 12 CFR 1026 : Regulation Z 1. Creditor 's failure to comply with billing error provisions. Failure to comply with the error resolution procedures may result in the forfeiture of disputed amounts as prescribed in section 161 ( e ) of the Act. ( Any failure to comply may also be a violation subject to the liability provisions of section 130 of the Act. ) 2. Charges for error resolution. If a billing error occurred, whether as alleged or in a different amount or manner, the creditor may not impose a charge related to any aspect of the error resolution process ( including charges for documentation or investigation ) and must credit the consumer 's account if such a charge was assessed pending resolution. Since the Act grants the consumer error resolution rights, the creditor should avoid any chilling effect on the good faith assertion of errors that might result if charges are assessed when no billing error has occurred. In addition, Section 217 of FCRA specifies that an institution must provide the required notice to the customer prior to, or no later than 30 days after, furnishing the negative information to a nationwide consumer reporting agency As stated in my previous claim, the account was paid on-time through duration and closed XXXX XXXX. XXXX and Equifax are reporting " 30 Days Late '' in XXXX and showing the account closed in XXXX which is a result of a billing error. Again, the account was paid on-time and in full on XXXX XXXX
