With that being said The Fair Credit Reporting Act mandates accurate reporting though out the life of a debt, the FCRA requires creditors to report information that is as accurate as possible based on the information reasonably available. Sections 1681 ( b ) of the FCRA states that information must be as accurate as possible, This encompasses any changes in the debt status, including write-offs, adjustments, or offsets. When a Creditor receives a benefit, like a tax deduction, from writing off a debt, it creates an offset that necessitates adjusting reported debt amounts for accuracy. This generally involves informing the borrower and correcting the credit report and/or file to reflect the updated status. Pursuant to IRS publication 453, bad debt deductions. It states bad business debts are deductible on schedule C ( form 1040 ). This would mean that the business writing off an account as a bad business debt would result in said business receiving a benefit. That benefit would be considered an offset to that relatable debt. The list of examples of bad business debts are loans to clients, suppliers, distributors, and employees, credit sales to customers or XXXX loan guarantees. As I am aware that businesses are not required to inform borrowers that their debt has been written off/charged off, It is important to ensure that fair measures are actively being used to report accuracy of information on credit reports/files pursuant to the Fair Credit Reporting Act. To add to this, XXXX debt is in fact associated with contracts, this incorporates contract law into the matter. Contract law requires parties to operate in good faith, clean hands, and to communicate with XXXX another. In fact, the most basic fundamental principles of contract law is the parties have a duty to communicate with XXXX another. Now adding into consideration that when a business has received a benefit from XXXX XXXX a debt, the business can not under the law of the fair credit reporting act, allow the original report to remain unchanged. The benefit operates as an offset and or set off, whether its called a charge-off or write off, it stills operate as a benefit offsetting the negative because the benefit operates as a positive. Since most businesses use accrual method of accounting the offset is mandatory as result of the businesses reporting practices. Failing to report the adjustment of the account resulting from the benefit received means that you are inaccurately reporting, resulting said account ( XXXX ) not being accurately verified, and validated, and the law requires accurate reporting of accounts being validated, verified and accurate in regard to reporting debts, and creditors must do so for the duration of the reporting of the debt. The federal law requires those XXXX issues to be addressed by every single creditor. As a result of this information, I am demanding the Creditors show the adjustment of all XXXX XXXX accounts to reflect the balance change. XXXX ) : This case found that a creditor violated FCRA by failing to update a consumers credit report to reflect that a debt had been XXXX in XXXX. Consumer Complaint: Subject : Inaccurate Flagging of New Derogatory Marks on Credit Reports Post-XXXX XXXX Bankruptcy Complaint Details : In XX/XX/XXXX, I filed for XXXX XXXX bankruptcy due to significant XXXX XXXX XXXX XXXX leading to a loss of income. Since the filing, I have adhered strictly to the bankruptcy plan without incurring any new derogatory credit activity. I am facing a critical issue with my credit reports maintained by XXXX, Equifax, and XXXX, following my XX/XX/XXXX filing date. There has been no new derogatory activity on my accounts since the filing ; however, recent updates have led to misleading reports of new derogatory activity on all accounts. Issue with Credit Bureaus ( XXXX, Equifax, XXXX ) : Inaccurate Reporting of New Derogatory Marks : My student loan, originally with the US Department of Education and subsequently transferred to XXXX, was consistently paid on time and never incurred any late payments. However, in XX/XX/XXXX, it was reported with a " petition for XXXX XXXX bankruptcy '' status update. This update, along with the Date of Last Activity ( DOLA ) marked as XX/XX/XXXX, erroneously portrayed the account as having a new derogatory mark. It's important to note that there has been no new activity on this account since my XXXX XXXX bankruptcy filing in XX/XX/XXXX. To accurately reflect my payment history, the status update or DOLA should be amended to XX/XX/XXXX. Alternatively, the account status could be adjusted to 'open and paid as agreed, ' considering that I have consistently made timely payments and the account is currently deferred due to my enrollment in school. Errors Resulting from XXXX Disputes : In XX/XX/XXXX, I noticed that XXXX had erroneously marked several of my accounts as " 90 days late, '' despite this being incorrect for the majority of them. Upon contacting an XXXX representative for rectification, he initiated disputes for all my accounts, including those that were reporting correctly and did not require a dispute. This action inadvertently triggered updates across all three credit bureaus ( XXXX, Equifax, and XXXX ) on several accounts, leading to status updates and Date of Last Activity ( DOLA ) inaccurately marked between XX/XX/XXXX and XX/XX/XXXX. Consequently, these updates have been mistakenly interpreted as multiple new derogatory marks, despite the fact that the actual last activity on these accounts dates back to XX/XX/XXXX, and they have been consistently paid as agreed per the XXXX XXXX plan. Impact : The inaccurate reporting by the credit bureaus has caused a sudden and drastic decline in my credit scores, leading to a significant misrepresentation of my creditworthiness. Despite the absence of any new financial activity on these accounts since my XXXX XXXX bankruptcy filing in XX/XX/XXXX, they are erroneously being reported as new financial activity and as new derogatory marks. This mischaracterization has led to immediate and substantial financial repercussions. Most critically, it has jeopardized the closure of a pending mortgage, thereby placing essential financial opportunities in jeopardy. These inaccuracies have not only distorted the true picture of my financial history but also threaten to upend vital steps in my financial recovery and stability, particularly my plans to purchase a home.

Yet XXXX is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) i ) on a consumer report is a clear violation of XXXX compliance. Provide me with the XXXX compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated '', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time.
