The Bureau notes that disclaimers will not cure a failure to have a reason to believe that a user has a permissible purpose for a consumer report provided pursuant to FCRA section 604 ( a ) ( 3 ). This advisory opinion also reminds consumer report users that FCRA section 604 ( f ) strictly prohibits a person who uses or obtains a consumer report from doing so without a permissible purpose.

Consumer Complaint: I have disputed an XXXX account/tradeline on dozens of occasions with Equifax ( see : XXXX ). IN particular I have disputed a date of first delinquency that reports two ( 2 ) years AFTER the date it should. While the subject of this dispute is no the unlawful charge-off of the account, it should be noted that the Date of Default alleged by XXXX was on or around XX/XX/XXXX and the account was alleged to have been charged-off on XXXX XX/XX/XXXX. Yet, Equifax continues to report the Date of First Delinquency ( DoFD ), aka the date of default, as XX/XX/XXXX. This is a non-causal date as the DoFD must precede the charge-off. Clearly, it does not. I have disputed an unrelated account with Equifax ( see : CFPB Complaint XXXX ). I have observed that in disputing the account the latest response from XXXX states " THE FOLLOWING FIELDS HAVE BEEN MODIFIED : BALANCE, PAST DUE, [... ], DATE OF LAST ACTIVITY/DATE OF FIRST DELINQUENCY, [... ], ACCOUNT HISTORY '' So it is not the case hat Equifax is incapable of transmitting disputes involving the DoFD, it's that they will not do it for the XXXX account. It's pretty clear Equifax is neither implementing reasonable meausres in response to disputes, nor is conducting reinvestigations that ensure maximum possible accuracy. The Date of First Delinquency reported for the account is PATENTLY INCORRECT.

This is an infringement upon my identity, privacy, protection, and rights. The Privacy Act of 1974 provides protections to individuals in three primary ways.
