Consumer Complaint: I mailed out letters to the Credit Reporting Agencies ; Equifax, XXXX and XXXX to delete the following information from my credit reports. They still have not done so. XXXX was asked to delete the 8 inquiries listed on my consumer credit report, they are also reporting 3 derogatory accounts that have been sold to 3rd party debt collectors, I asked for this to be deleted, they are also reporting 2 late payments, I asked for this to be deleted, they still have not done so. Equifax was asked to delete the 17 hard inquiries from my credit profile, the 1 late payment they are reporting, the 3 derogatory items sold to 3rd party debt collectors, and they still have not done so. XXXX was asked to delete the late payments they are reporting on my consumer credit report, the 7 inquiries, the 3 derogatory accounts that have been sold to 3rd party debt collectors and the closed account for XXXX XXXX XXXX, a repossession from a debt collector. 15 U.S.C. 5802, I never received disclosures to opt out, I need that to be done as well. ( b ) Opt out ( 1 ) In general A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. FCRA 15 USC 1681 accuracy and fairness of credit reporting ; the congress finds the following findings : An elaborate mechanism has been developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. This is the law that governs my consumer reports/credit reports. Proof that your Credit Reporting Agency is the information highlighted on my credit report. Accuracy means all values are deemed correct, so accuracy is a measure of value. Value can only be determined by a human being/living being/natural person. So when congress references accuracy, they are leaving it up to me to determine whether my credit reports are of any value to me. Fairness is no one person is taking unjust advantage of another. So when congress references fairness, they are asking you me to decide whether my reports are just and if someone is taking an unjust advantage of you. Equifax, XXXX and XXXX have all been notified. They are in violation of PRIVACY ACT OF 1974 : No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains [ subject to 12 exceptions ]. 5 U.S.C. 552a ( b ). I NEVER gave you, Equifax, XXXX or XXXX any written instructions to furnish any information on my consumer report which is a violation of 15 USC 1681b. Equifax has caused severe stress and anxiety due to the abusive and unfair practices. No one is allowed to have or purchase my information without my consent. This is an infringement upon a consumers right to privacy. 15 USC 1692 it references individual privacy fall under abusive practices. 15 USC 1692d The use or threat of use of violence or other criminal means to harm, the physical person, reputation, or property of any person. According to the FCRA it's {$1000.00} per violation. I want to be compensated along with compensation for Emotional Damage and Humiliation. According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' Equifax and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies Equifax, XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to Equifax, XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information .Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Equifax, XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. Inquires, payment history, credit utilization are fall under transactions, which are excluded from consumer reports.

Issue: Problem with a company's investigation into an existing problem

Consumer Complaint: I sent a letter regarding inaccurate and unknown things on my credit report. To this day over 30 days later I have not received a response yet. I feel like I'm being taken advantage of and being ignored of my disputes. Section 611 ( a ), it is plainly stated that a failure to investigate these items within 30 days gives a reason to immediately remove those items from my credit report it has been over 30 days so they should be deleted promptly. I demand these accounts be deleted immediately or I will file for litigation due to the stress you caused me. My information was also impacted by the Equifax, XXXX and XXXX data breach and XXXX have got into the hands of the wrong person.

Consumer Complaint: i sent multiple 609 letters and 623 letters requesting the false information be removed, or proven true, and that all information used to support the false inquires be sent to me by way of USPS mail as well as email, i received nothing from either of the three companies XXXX, Equifax or XXXX except letters stating that all information was true, nothing showing who or what information they used to show any of the inquires was true or accurate. just letters stating they wouldnt change anything because they believed it to be accurate. they still havent removed the false inquires from my report yet. they keep re-reporting them as new and accurate each month, year after year.

Consumer Complaint: It is illegal to report transaction history. Pursuant to the Privacy Act of 1974, codified 15 U.S. Code 522a, subsection b states : No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains, unless disclosure of the record would beto a recipient who has provided the agency with advance adequate written assurance that the record will be used solely as a statistical research or reporting record, and the record is to be transferred in a form that is not individually identifiable. Additionally, the Fair Credit Reporting Act, codified 15 U.S. Code 1681, section 602 ( a ) the legislature states : " There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, Equifax, and XXXX are consumer reporting agencies, and I am the Consumer. I have the right to make sure my private information isn't shared unfairly and isnt in a matter that would reflect prejudice or biased treatment in public, which is supported by 15 U.S. Code 6801, stating : " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX XXXX is a financial institution by definition under that title. 15 U.S. Code 1681, section 604 ( a ), section 2 states that : " In general, Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' XXXXXXXX XXXX XXXX the financial institution, and the consumer reporting agencies XXXX, Equifax, and XXXX do not have my consent to furnish this information in the fashion currently presented in the public, and they surely do not have my written consent. Effective immediately any and all consent to XXXX, Equifax, and XXXX, XXXX XXXXXXXX XXXX whether it be verbal, non-verbal, written, implied or otherwise is now revoked. 15 U.S. Code 6802 ( b ) ( c ) states that : " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unlessthe consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXXXXXX XXXX never informed me of my right to exercise my nondisclosure option. Not only that, my right to make sure my private information isn't shared unfairly and in a matter that would reflect prejudice or biased treatment in public is further supported by 15 U.S. Code 1681C ( a ) ( 5 ) stating : " Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission, which is reflecting prejudice or biased treatment. 15 U.S. Code 1666 ( b ) ( a ) states : A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. 15 U.S. Code 1666 ( d ) states : Whenever a credit balance in excess of {$1.00} is created in connection with a consumer credit transaction through ( 1 ) transmittal of funds to a creditor in excess of the total balance due on an account, ( 2 ) rebates of unearned finance charges or insurance premiums, or ( 3 ) amounts otherwise owed to or held for the benefit of an obligor, the creditor shall ( A ) credit the amount of the credit balance to the consumer 's account ; ( B ) refund any part of the amount of the remaining credit balance, upon request of the consumer ; and ( C ) make a good faith effort to refund to the consumer by cash, check, or money order any part of the amount of the credit balance remaining in the account for more than six months, except that no further action is required in any case in which the consumer 's current location is not known by the creditor and can not be traced through the consumer 's last known address or telephone number. XXXX XXXXXXXX XXXX as the creditor and card issuer, is instead illegally reporting to the consumer reporting agencies inaccurate transaction information. All information not provided and verified as accurate from me the consumer is reasonable cause to believe that the information is inaccurate pursuant to 15 U.S. Code 1681s2 ( A ) ( 1 ) A which states : " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. '' 15 U.S. Code 1681e states : " Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. '' XXXX, Equifax, and XXXX are not maintaining reasonable procedures because of the abovementioned laws.
