Consumer Complaint: Subject : Formal Complaint Regarding Violations of Consumer Protection Laws Dear CFPB Representative, I trust this communication finds you well. I am writing to formally report what I believe to be violations of consumer protection laws by Equifax, XXXX, and XXXX, which are consumer reporting agencies. In accordance with the Fair Credit Reporting Act ( FCRA ) 602 [ 15 U.S. Code 1681 ], it is imperative that consumer reporting agencies exercise their responsibilities with fairness, impartiality, and a profound respect for the consumer 's right to privacy. I am the consumer in question and, as such, I wish to ensure the safeguarding of my private information, a right explicitly supported by 15 U.S. Code 6801. I would like to draw your attention to the following key points and alleged violations : 1. Lack of Consumer Consent : Under 604 [ U.S. Code 1681b ], any consumer reporting agency must furnish a consumer report only in accordance with the written instructions of the consumer. At no point have I provided written consent for the furnishing of my information to credit agencies, and any presumed consent is hereby revoked. 2. Failure to Inform of Nondisclosure Options : Pursuant to 15 U.S. Code 6802, a financial institution must inform the consumer of their right to exercise a nondisclosure option. I assert that the furnisher of information to credit agencies failed to apprise me of this right. 3. Reporting Adverse Items Without Consent : Under 15 U.S. Code 1681, no consumer reporting agency may include adverse items of information without explicit authorization. I contend that Equifax, XXXX, and XXXX are reporting adverse items without my consent, which is a clear violation. 4. Inaccurate Reporting : As per 15 U.S. Code 1681s2, information must not be furnished to a consumer reporting agency if it is known or reasonably believed to be inaccurate. I believe that inaccurate information is being reported about me. 5. Failure to Maintain Reasonable Procedures : According to 15 U.S. Code 1681, consumer reporting agencies must maintain reasonable procedures. I assert that Equifax, XXXX, and XXXX, as furnishers of information as credit agencies, are not upholding these standards. 6. Right to Opt Out : Pursuant to 12 CFR 1016.7, I am exercising my right to opt out of these reporting services, and I request the cessation of such reporting immediately. I have taken proactive measures to address these issues. Certified mail letters were sent to each of the aforementioned credit agencies, requesting rectification. Attached to this complaint, you will find the relevant documents. Equifax, despite receiving the letter on XX/XX/year>, has failed to remedy the situation or acknowledge the violations altogether. A report pulled today, XX/XX/year>, indicates that Equifax has not taken appropriate actions to rectify the identified issues. Furthermore, XXXX, being a furnisher of information to XXXX, Equifax, and XXXX, received my Opt Out notice. While they initially indicated compliance, I have evidence that they are still in violation. Reports pulled today clearly show that they continue to provide information to these credit reporting agencies, contrary to my explicit request to opt out. I kindly request that the Consumer Financial Protection Bureau ( CFPB ) investigate these matters thoroughly and take appropriate action to address these alleged violations. Your attention to this serious issue is crucial, and I anticipate a prompt and comprehensive resolution. Thank you for your time and consideration.
