According to the Fair Credit Reporting Act ( FCRA ), the term person is defined broadly, including entities such as XXXX XXXX. Reference : 15 USC 1681a ( 2 ) ( A ) ( i ) Explanation : This section establishes the broad definition of person under the FCRA, encompassing entities like XXXX XXXX. It serves as the foundation for disputing the reporting of late payments by such entities. Furthermore, under 15 USC 1681a ( 2 ) ( A ) ( i ), a consumer report excludes information about transactions solely between the consumer and the reporting entity, subject to section 1681s3 of the FCRA. As such, reporting late payments as transactions is a violation. Reference : 15 USC 1681s3 Explanation : This section outlines the responsibilities of furnishers of information to consumer reporting agencies, emphasizing the requirement for accuracy. It supports the argument that transactions solely between the consumer and the reporting entity should not be reported under this section. In accordance with SC Code Ann. 39-5-10 et seq., which prohibits unfair or deceptive practices and acts, the illegal reporting of late payments corresponds with this law. I am ordering XXXXXXXX XXXX, XXXX, and Equifax to cease reporting late payments for this account and update it to Paid as Agreed, Never Late. By the way I hope that this does not hinder my ability to obtain employment due to this inaccurate information showing. Consumer Complaint: There appears to be unauthorized disclosed financial information being reported on my credit reports. I have reached out to each company to no avail. Equifax, XXXX, XXXX, and the named furnishing financial institutions have violated my federally protected privacy rights as a consumer by the disclosure of my nonpublic personal information, per 16 CFR 313.3 ( n ) ( 1 ) ( i ). Disclosure of my personally identifiable financial information would include, but not limited to, payment history, account balances, account numbers, and transaction history. Please see the attached documentation that was mailed to each furnishing financial institution. At the date of this letter, XX/XX/scrub>XXXX XXXX I have yet to receive any correspondence or updates from Equifax, XXXX, XXXX, any financial institutions, or any other third-party nonaffiliated company. According to the Fair Credit Reporting Act 15 USC 1681 ( a ) ( 4 ) states There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' Equifax, XXXX, and XXXX are consumer reporting agencies, and I am the Consumer. I have the right to make sure my private information isn't shared, which is backed by 15 USC 6801 ( a ) which states It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' The outlined companies in my report are financial institutions by definition under that title. 15 USC 1681 Section 604 ( a ) Section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' The financial institutions, and the consumer reporting agencies Equifax, XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to the outlined financial institutions whether it be verbal, non-verbal, written, implied or otherwise is revoked per 16 CFR 313.7 ( f ). 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' The outlined financial institutions reporting to Equifax, XXXX, and XXXX never informed me of my right to exercise my nondisclosure option. 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information ; Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' These accounts are adverse items reporting without my permission which, again, is against the law. 15 USC 1681C ( a ) ( 4 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information ; Accounts placed for collection or charged to profit and loss which antedate the report by more than seven years. The reporting and disclosing of my personally identifiable financial information without my consent on my credit reports by XXXX, Equifax, XXXX, and the outlined furnishing financial institutions, has drastically impacted me from acquiring loans, obtaining extensions of credit, having substantially higher interest rates, missed job opportunities, and being unable to provide for my family at times.
