Consumer Complaint: To whom this may concern : I would like to state that according to 15 U.S.C. 1681 ( a ) Accuracy and fairness of credit reporting The Congress makes the following findings : ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Your company is blatantly violating federal law ( 15 U.S. Code 1611- Criminal liability for willful and knowing violation Whoever willfully and knowingly ( 1 ) gives false or inaccurate information can be held liable ). I noticed unauthorized accounts on my consumer report. I have not signed any documents authorizing your organization to report any accounts on my consumer report therefore, your reporting of accounts on my consumer report violates the Fair Credit Reporting Act. I am requesting that your company blocks and remove all disputed fraudulent accounts from my consumer report pursuant to [ 15 U.S.C. 1681c-2 ] ( a ) Block Except as otherwise provided in this section, a consumer reporting agency SHALL block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt. I have not supplied proof under the doctrine of estoppel by silence, Engelhardt v. Gravens ( mo ) 281 SW 715, 719, I may presume that no proof of the alleged debt, nor therefore any such debt, in fact exists. 15 U.S. Code 1681b ( a ) In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the written instructions of the consumer to whom it relates. Consumer Complaint: On XX/XX/2023, Midland Credit Management, XXXX XXXX XXXX, contacted my husband via phone and gave him all account information even though not listed on the account. He was given credit card company names, amounts owed and told that if I do not contact them that they would sue me and garnish my wages. I write this complaint because the law states : " Collection agencies and other debt collectors may only call or write to you on a reasonable schedule. Constant phone calls and mailings are considered harassing under FDCPA stipulations. Likewise, debt collectors can only contact friends, family members, or employers once, and only then if it is an effort to verify contact information or to verify employment. Collectors that contact a third party, like a friend, family member, or employer, can not share any information about the debt with that third party. This includes restrictions that prevent debt collectors to disclose any information that informs the third party that the communication is related to debt collection efforts. "
