Consumer Complaint: I used to work for MCM but left the company over a year ago. While I was working for them, they changed software and I was a supervisor during this time. The software didnt work correctly so I had to use my personal cell phone to get the credit cards to work at times. When this occured, my cell phone number became attached to each account that it was used on. Before I left the company, I made sure to go through and search all accounts that my number had been linked to and disable the number. Not long after I left, I started getting calls looking for people from those accounts. I informed them at that time to make sure they werent reenabling my number because it was not a good number for any of these people. Now, I am again getting calls. I have had at least 10 calls in the last week for at least 3 different people. I again told them to disable my number and explained to them why it was on the accounts to begin with. They are not disabling it at all because I am continuing to get calls for the same consumer. One of them, I have now told them 3 times that this is not a good number, but the calls continue.

Consumer Complaint: In XXXX - XXXX I acquired a medical credit card to have some medical procedures done. With a debt of about 5,000. I was later unable to pay back the debt after a year or so from opening the account. Since I was unable to pay due to lack of work and as time had moved on, I had not heard from this company in almost twenty years ( 20 years ). This past week on XX/XX/XXXX, I received a " Notice of Garnishment '' from my employer stating a company, Midland Funding LLC based in XXXX XXXX CA was taking action to garnish my wages to a total of {$9000.00}. I was surprised and very concerned as I had never worked with, spoken to or ever had any agreement with Midland Funding so I was not sure why and how this garnishment came to be. The debt they are collecting is twenty ( 20 ) years old and I have never spoken to this company or agreed to pay them anything. I am very concerned as to how they received this judgement without notifying me ( service of complaint ) giving me the opportunity to defend my rights in court. In addition, they filed this complaint in Small Claims located in XXXX CA which is 40 miles away from my work and home. My complaint is how this company managed to obtain a judgment without my knowledge, Midland Funding has never provided any proof of my debt from original company therefore I do not every know why they are collecting on a debt I do not owe them as I have never done any business, nor spoken to anyone or agreed to pay any funds to Midland Funding. This debt is twenty years old and has exceeded the Statute of limitation so I want to know how this is legal as I have not been given any opportunities to defend my right s as a consumer and know this company has violated many codes of conduct and collection practices and laws. Midland Funding has obtained this order under false pretenses, unlawful conduct and practices and should not be able to conduct business in this matter. Since the prescribed time permitted by law has passed this should have never been filed in court as per the rules set forth by our legislative body. In addition, this was filed in small claims court but yet Midland is being represented by multiple attorneys. You can not file in small claims with representation as it leaves the defense to a disadvantage as the defendant would not have an attorney present due to the small claims rules of " no attorneys ''. Also, no claimant ( natural person or legal entity ) may file more than two small claims court actions for more than {$2500.00} anywhere in the state during any calendar year which Midland funding has therefore is violating California rules of court ( Small Claims ).

Consumer Complaint: Midland is reporting in my credit file however it is inaccurate because it was said to be late, yet all the payments are OK. I do not think that this is mine. I did my research on what to do because it is affecting my scores to badly, I asked for documents, disclosure and where did the account come from but they failed to provide me, so I came online and researched. The plaintiff is asking the same thing that I wanted and at the end of it all the plaintiff won this case. I am talking about the Texas VS Midland Funding Case. I have learned that Midland claims to have a disclosure and an agreement that there is a Consumer Agreement for all who they are collecting from. I guarantee you that there is no such thing that I have agreed upon to.
