Consumer Complaint: I have an account that was with XXXX and sold to Midland credit. I filed for bankruptcy chapter XXXX case # XXXX on XX/XX/20. I filed a dispute through XXXX as Midland credit was still showing on my credit report. The information was initially deleted, but now has reappeared on my credit report as a collection item. Midland Credit has obviously failed to stop the re-polluting of inaccurate information to my credit bureau report with inaccurate information. Under FCRA, Data Furnishers are to report accurate information and if they can't the information is to be deleted. Please either update the reporting to reflect this account was included in bankruptcy, as outlined by the Consumer Data Industries guidance in the Credit Reporting Resource Guide or I will be pursuing legal ramifications for a directly violation of my consumer rights as this is a direction violation of the Fair Credit Reporting Act. This dispute is for another XXXX account your reporting for a balance of {$3500.00}

Consumer Complaint: Today, I got a phone call from " Unknown '' contact number obviously hiding the caller. I picked up the phone and one man was repeating my name. As the caller was blocked I presumed it may be a scam so I asked him who I am speaking to. Then he responded with his name from Midland Credit planning on law suit for the credit debt from XXXX-here, he indirectly confirmed that the company is not the original creditor and tried to make an attempt to threaten me with legal actions. XXXX 's the well-known XXXX has a credit line opened with XXXX XXXX which often work for many other corps for the credit line platform, so I tried to access my online account but I failed to log in. It almost seemed to me they closed the access entirely. So I called to XXXX and asked them why the credit debt balance was sold/transferred to the 3rd party collection company when I already requested the suspension of the payment for Covid-19. And the representative couldn't respond to any of the questions regarding the matter. Not to mention being blocked from my own information, XXXX XXXX didn't even inform me prior to the sudden closure of my accounts. Then this almost fraudulent action made by them, did lead to this unpleasant and threatening phone call that I received from Midland Credit. As per the information provided by XXXX, the Midland Credit took over the debt on XXXX of this year which is still during the pandemic.

Consumer Complaint: Midland Credit Management has much of our old credit card debt. I am an XXXX survivor with XXXX and sadly had to stop working after I ended up in a XXXX program for a major setback due to a triggering event at work regarding a member of the management team being arrested for XXXX XXXX XXXX of XXXX and yet still being allowed to work at the same establishment. In the last few years, we have sent countless letters sent by standard mail, certified mail, email and have had direct phone conversations with Midland Credit Management explaining that the only income acquired is our SSDI ( XXXX ) and that we can not pay the debt. Despite us following their instructions completely for the last two years, they have kept calling, sending letters and summoning us to court. As both my husband I and suffer extreme XXXX and XXXX XXXX this is adding quite a bit more to the already fragile situation we live in. We sent the documentation to the court and they do acknowledge that as SSDI recipients they can't collect, but the company does not stop the attempts.

Consumer Complaint: Midland Account Number XXXX I have an agreement with Midland Collection in the approximate amount {$4400.00}, with an original balance of approximately {$8200.00}. I have been asking them to send me something in writing to secure this arrangement for this amount and they refuse to so. I do not feel comfortable paying such a large amount of money over the phone with nothing to secure my settlement or protect the integrity of this negotiation. I have asked them on several occasions for there cooperation and they are just so difficult to work with.

So when I called to try to settle again the rep was very nasty to me and asked me if I couldn't pay the settlement offer then and there why would I be trying to fix my credit right now which was very disappointing to hear. she was just flat out XXXX to be a floor supervisor.. Then called today which is XX/XX/2020 came up with a settlement amount of XXXX agreed to that then the guy says if you can't pay it by XXXX of XX/XX/2020 then you have to pay the whole amount of XXXX if I needed 30 days. I then said to him agency 's usually give you 30 days to pay the settlement amount so you and them can get the agreement in written, he then said use your common sense " NOT EVERY AGENCY HAS THE SAME RULES '' I then said to him how unprofessional that was. He says if you need to XXXX XXXX you can't get the settlement you have to pay the full amount. I explained to him I don't need that long I just need 30 days from today which would be XX/XX/XXXX he said NO!

Consumer Complaint: After repeatedly explaining to Midland Credit Management Inc. employees that I was a victim of identity fraud, Midland Credit Management Inc. continued to engage in harassing phone calls and did not conduct an investigation in conjunction with the original creditor to find out if there was merit to my claims of identity fraud. The phone calls started coming in XXXX of 2019. The first one I received was from a gentleman who said that he was going to collect {$2900.00} On behalf of a credit debt I owed from a XXXX XXXX Credit Card and that he wanted to know how I would be paying off the debt. Since I could not remember ever obtaining a credit card from XXXX XXXX or running up a debt of {$2900.00} On a credit card, I said into the phone I had never taken out a credit card and let it go delinquent and that this was just a scam and hung up the phone. For the next few days, I received multiple phone calls every day from the same person saying that I owed {$2900.00}. I did not respond any more to these phone calls, but I started to wonder if something bad had happened because most scam artists do not keep calling. I went to check on my credit history and found that indeed someone had taken out a XXXX Credit Card in my name in XXXX of 2019, ran it up to the credit limit, and then let the payments slip into delinquency. Next, I reached out to an identity theft company called XXXX to help me figure out what was going on and what to do about it. Immediately, they helped me to find out how someone had stolen my identity. It turned out that someone had pretended to be me and simply used an old address of mine ( from over 10 years ago ) to obtain the credit card. XXXX is owned by XXXX and they quickly removed the hard inquiry from my credit history. They also helped me to get a fraud alert placed on all 3 major credit agencies. Finally, they told me to contact XXXX XXXX and Midland Credit Management Inc. and let them know what had happened. Consequently, I reached out to XXXX XXXX to let them know I had been a victim of identity theft. I told them that someone had used an old address of mine to obtain a XXXX Credit Card in my name and that they had run it up to the credit limit and not paid it off. The employee from XXXX XXXX asked me for my current address and then told me they would get back to me in 30 days with the results of their investigation. I also contacted Midland Credit Management Inc.to let them know I had been a victim of identity theft. They told me they would conduct their own investigation and would let me know the results within 90 days. They did not ask me for any information pertaining to my identity theft case. Just this past week, I received two letters. One from XXXX XXXX stating that they had conducted an investigation and found that I was indeed the victim of identity theft. They stated that they would be reaching out to the 3 major credit agencies to have them remove the XXXX Account tradeline from my credit report. The other letter was from Midland Credit Management Inc. stating that after reviewing the information you provided, our account notes, and information provided by the previous creditor we have concluded that our information is accurate. This was very strange to me since they had never asked for any information from me regarding my case of identity theft and if they had been working in conjunction with XXXX XXXX, then they would know that XXXX XXXX had ruled in my favor and that this was a case of identity theft. In this situation, Midland Credit Management Inc, has shown itself to be grossly incompetent. Even after letting them know that I am a victim of identity theft, they have made my already difficult situation as a citizen and consumer much worse by continuing to insist that they have conducted a thorough investigation and worked with the original creditor which is simply not true. By filing this complaint, I seek relief from a company ( Midland Credit Management Inc. ) that has demonstrated itself to be a harm to the consumer by automatically deeming them guilty in a case of identity theft and not adequately investigating the matter as it rightfully should be investigated so as to not make a very stressful and worrying situation exponentially more stressful and worrying.
