Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: MCM # : XXXX Original Creditor : XXXX XXXX XXXX Account # : XXXX XXXX : XXXX I filed for bankruptcy on XX/XX/2020 and listed Midland Credit on my bankruptcy petition. Midland Credit deleted the trade lines from my credit reporting file after my bankruptcy was filed. However ; the following month they re-reported this information to XXXX showing it as an open collection item although they were clearly listed in my bankruptcy petition. They have indicated in my CFPB resolution that they stopped reporting the account to the 3 credit reporting agencies which is obviously not true based on the attached documentation showing them listed as a collection item on my XXXX credit bureau report. It seems as though there executive offices have issues understanding my complaint. I did not indicate I want the trade lines deleted but more so if they cant report them accurately to show them as included in my bankruptcy that they should delete the reporting as that they have indicated in there resolution contradicts what actually occurred on my consumer credit file.

Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: Midland Credit has sued me for a credit card debt of {$4500.00}. I have asked them to validate the debt. I have sent multiple letters asking for validation per 1692g of the FDCPA. I have not received a valid response from Midland Credit. I have received a response from their lawyers, saying that my request for validation is irrelevant, immaterial, cumbersome confidential, and attorney-client privilege. I have been requesting validation of this debt for the past 60 days and am not getting the information needed to verify the debt.

Consumer Complaint: Contacted Midland funding XX/XX/20 and attempted to pay a bill owed to a credit card company XXXX XXXX XXXX. I paid XXXX for the bill receipt XXXX. I advised them my employment was lessened by covid 19 and that I might be filing for bankruptcy. They stated, " you have another bill that is 15-20 years old. '' I advised them I was not aware of the bill but that it was over 7 years old. Company " removed '' the bill that I paid as opposed to listing it as paid. Credit report shows total debt owed decrease by XXXX dollars bill is still showing as unpaid. Advised me that they would mail a receipt. I never received a receipt. I requested the receipt be faxed several weeks later and was advised it would take an additional 7-15 days I am a covid victim and have enough to deal with and believe this to be inappropriate.

Consumer Complaint: A second part of my original complaint : Midland threatened to contact my employer/ Supervisor and manager. This company also failed to provide me with documentation to validate this alleged debt and I have not had a delinquent CC debt for 3-5 years so this may be an old debt that is passed the allotted time frame. Ive sent a second request to validate this alleged debt even though I didn't receive a response from them within the 30 days as required by law. Original Complaint # XXXX

Consumer Complaint: I returned a call to the collections agent, XXXX ( XXXX I believe is the last name ), the agent handling the account that he called me about. While on the phone with XXXX, he said that I would be taken to court and sued and that a summons would be delivered to my supervisor or manager at my job. After we went back and forth for a bit, I explained to XXXX that he would never find my supervisor or manager so he said that he would forward this case for litigation and we disconnected the call. I wanted to report him and his behavior to his manager. I called back and the switchboard operator said that she did not know who his supervisor or manager was so I called XXXX and asked that he connect me to whoever he reports to. He said that he was the supervisor and the manager. I asked him if he owned the company but he said no because if he was, he would obviously not be working. I told him that since he was not the owner of the company that there was someone that he reported to. After about 5 minutes of me explaining to XXXX that he must report to someone, he placed me on hold, said that he was getting a supervisor but came back to the line after about 10 minutes to say that there was not a supervisor available.

Consumer Complaint: Midland Credit Management pulled two payments from my account, although somehow had no record of the first payment. On XX/XX/2020 they pulled {$30.00} On XX/XX/2020 they pulled {$34.00} When I contacted them on XX/XX/2020, they insisted they only pulled one payment for {$34.00}, and had no record of the payment on XX/XX/2020. They then asked me to send my personal bank statements as proof.

Consumer Complaint: I, XXXX XXXX believes in the credit reporting system as the most important element to the success of the commercial banking system. I am also a proponent of the Consumer Financial Protection Bureau ( CFPB ) as a tool to streamline issues on credit reports that may be dragging down my overall scores. Accordingly, I address each particular issue directly with the creditor in question, before submitting any complaint to the credit bureaus if necessary. Therefore, I desire the following reinvestigation as follows : 1 ) On accounts where late payments are posted, I respectfully request a review of the past payment history and to ascertain if certain payments could actually have been posted late because of an overlap on the 30-days grace period. I realize that this may happen on occasion, and I request only a summary review internally, and do not require any documentation. 2 ) On any account that falls within the 84-month negative reporting timeline, I respectfully request either the deletion of the account if said account was closed, or the elimination of the prior payment if the account it is still active, this is well within the Fair Credit Reporting Act ( FCRA ) guidelines pertaining to obsolete information. 3 ) Any collections must be proved if either a direct collection and/or debt purchase. In either event I request that a true original copy of right to pursue collection be established with each respective credit reporting agency, and if a debt purchase the guidelines proving transfer of ownership must be submitted to all credit bureaus as well as me personally to validate ownership and the right to collect. I am well within my rights requesting proper documentation as administered through the Fair Debt Collection Practices Act ( FDCPA ), the Consumer Financial Protection Bureau ( CFPB ) and the Federal Trade Commission ( FTC ), in addition to the even stricter guidelines enforced by the office of attorney general in my state of domicile. I respectfully request each investigation to be reported to XXXX, XXXX and XXXX XXXX within a reasonable time period, hopefully 30-days. I realize that the current Covid-19 crisis could cause delays, so the best efforts of each financial institution and collection agency will be appreciated under the current circumstances. XXXX XXXX
