Consumer Complaint: An account was opened in XX/XX/XXXX with a company called XXXX XXXX XXXX in amount of {$1600.00} in XX/XX/XXXX another company called Midland Funding purchased the account they put the account in collections in the amount of {$2100.00} I did not open this account. On XX/XX/XXXX Midland Funding brought me to small claims court. The Vermont XXXX XXXX in XXXX XXXX XXXX ordered the case be dimised without prejudice docket No. XXXX XXXX as of XXXX. XXXX XXXX Midland Funding and XXXX XXXX XXXX will not remove the account from the three credit bureaus even after disputing them with the all 3 credit Bureaus and providing the court documents to the credit Bureaus because of this I am not being able to refinance my current home because it is affecting my credit scores. I have been trying since XXXX of XXXX to get this removed. I know it falls under the fair credit reporting act.

Consumer Complaint: Midland Credit Management Inc is pulling my XXXX XXXX credit report for account reviews when they have no account to review for collection the account that they did have has been closed to all collections for being exempt from debt collection due to being on Social Security XXXX for life so they have no right to pull any of my credit reports for account review unless they are attempting to collect on exempt funds they closed the account and stop all further collections. they have no reason to review my reports for an account they can not ever collect on.

Second your send a copy of a letter from XXXX XXXX where says the acccount is sold to Midland Credit Managment the document that you sent me does not meet the Federal Trade Commissions guidelines of what constitutes proper debt validation. I want you cease and desist all collection activity from this account. Because I dont want Midland Credit Managment report invalidated information to major credit bureaus

Consumer Complaint: I received a letter from Midland Credit Management on XX/XX/2020 attempting to collect payment on a debt it identified as XXXX XXXX XXXX. I sent a letter ( attached ) asking Midland to provide certain documents and to validate the debt. In the letter, I ask that the materials be provided before I engage in further discussions about the debt According to the return receipt ( attached ), Midland received the letter on XX/XX/2020. I have not received any of the requested materials since sending the letter. However, on XX/XX/2020, I received a call from Midland and the gentleman advised that he was a debt collector and this was an attempt to collect a debt. I advised him that I sent a validation letter and had not yet received the requested materials. He simply kept replying " What letter? What kind of letter? '' At which point I ended the call. The Fair Debt Collection Practices Act provides that if I dispute the debt within 30 days of receiving the initial letter, and I did, that the collector stop collection efforts unless and until they provide documents validating the debt. Midland violated the FDCP in this instance and should be dealt with accordingly.

Midland Credit Management closed and stop all further collections on an account that they had last year due to the debt being Exempt from debt collection for being on Social Security XXXX for life. since they closed the account and stop all collections on this account they have no permission purpose under The Fair Credit Reporting Act ( FCRA ) to pull my credit report for account reviews when they have no account that is open to collections from me If you stop all further collection and closed the account you have no right to review my credit report on a closed account unless you are still trying to collect on exempt funds
