Consumer Complaint: On XX/XX/XXXX I sent a complaint via ( CFPB ) in reference to this alleged debt owed to XXXX XXXX in the amount of {$5800.00} from Midland Credit Management. I asked Midland Credit Management XX/XX/XXXX for legal validation of this alleged debt. Midland failed to validate this debt appropriately in accordance to federal law ( FCRA ) stating that this debt is just accurate. XX/XX/XXXX, I received letter from Midland Credit Management Legal Department in reference to the XXXX XXXX account. Midland Credit Management indicates in this letter that I have until XX/XX/XXXX to pay balance in full or face lawsuit. I currently have on standby legal counsel awaiting the alleged lawsuit to come from Midland Credit Management as they continue to break federal law and violate consumer rights.

Consumer Complaint: Please, I need help with repeated calls and them attempting forced payments from bank account prior to when funds will be available. Initially spoke with " XXXX XXXX '' not sure of real name. They use spoofing of phone numbers and name even though I am taking their calls. She was advised of my financial status XXXX XXXX the 4th week of the month ). I did advise I had no money at the time but will ( and did ) send a payment. This was not satisfactory then and even though they acknowledge receipt of TWO ON TIME PAYMENTS, multiple phone calls per day have not stopped. 1. I cant guarantee payment via the bank account used for the initial payment. It was used to keep my commitment of said payment and show commitment to resolving this debt. 2. Second payment was send via money order and received ON TIME by the company per " XXXX '' on XX/XX/28. Advised next payment would be sent to the address by the date provided by them on a payment schedule. 3. As of the writing and filing of this complaint, there are MULTIPLE calls daily regarding payment. I am constantly threatened with litigation even though I am attempting to satisfy this debt. I do admit losing my temper during the last two phone calls with them. In fairness, I do not expect repeated calls when I have clearly shown an attempt to pay and the THIRD due date is not here yet. Threatening litigation and garnishment of a XXXX check prior to a due date when TWO payments have been RECEIVED and ACKNOWLEDGED by Midland Credit Management XXXX Inc. is beyond excessive.

Consumer Complaint: Since XXXX of 2019, Midland Credit has been calling me repeatedly on my home/work phone ( I work from home ), interrupting conference calls, calling before XXXX XXXX EST, and even after XXXX XXXX EST. These calls range from every hour to every XXXX minutes, 7 days per week. Occasionally I take the call and encounter a foreign person with a poor connection, it is difficult for me to understand the accent, or to hear beyond the poor connection. I tried a few times to propose a settlement, and they will not work with me but they continue to call several times a day, seven days per week.

Consumer Complaint: Midland Credit Management continues and has violated my rights via phone and mail under section 15 US 1692 under the Fair Debt Practices Act. I have enclosed an invoice in the amount of {$3000.00} to be paid via check for 3 violations. I have included my affidavit of truth along with the exhibits that highlights these violations. I also have sent this affivdavit of truth along with invoice via certified mail to Midland Credit Management. This has caused me mental and physical distress. Consumer Complaint: I have a payment plan set up with midland credit for an old XXXX XXXX XXXX account I had. I set up a payment plan with them they emailed me on XX/XX/XXXX stating my next payment would come out on XXXX. Instead they removed the account offline so I can not continue to make payments on it even though they agreed to that amount. They keep threatening to take me to court which is why I set up the payment plan I did. I am a single mom on limited income due to covid and they should not honor a payment plan and then try to collect the debt in a different way.

Consumer Complaint: On XX/XX/2020 Midland funding LLC added a derogatory mark on my credit report per XXXX XXXX and XXXX. Upon further research this account was transferred/Sold and I am no longer responsible for this account. Midland Funding LLC did not verify this collection. Also there was NO written form of communication, contract or signature for this accused debt at all. A bill without a signature does not validate the debt and anyone can send a bill and say its mines. According to FCRA Midland Funding LLC has violated my rights as a consumer and Im requesting legal action to remove this account immediately.

They have indicated in my CFPB resolution that they stopped reporting the account to the 3 credit reporting agencies which is obviously not true based on the attached documentation showing them listed as a collection item on my XXXX credit bureau report. It seems as though there executive offices have issues understanding my complaint. I did not indicate I want the trade lines deleted but more so if they cant report them accurately to show them as included in my bankruptcy that they should delete the reporting as that they have indicated in there resolution contradicts what actually occurred on my consumer credit file.
