Consumer Complaint: On XX/XX/XXXX at XXXX XXXX. I received a phone call from Midland Credit regarding an old debt from XXXX. I explained to the representative that I had recently lost my job due to the impact of COVID-19 and was unable to pay anything today, but would like a letter sent to my mailing address and I can look into the debt at that time. The representative became aggravated that I was unable to complete any sort of arrangement or payment today and began threatening me that they will take me to court and I could have my property seized, my checks garnished, and my bank account taken if I did not set something up. I actually believe that this debt may be beyond the statue of limitations, or very close to it since it was from so long ago. I asked the representative to give me the last day that I made a payment and he stated XXXX, but I dont remember making any sort of payment at that time. I asked to speak with a manager, he stated that his manager was on another call and unable to speak with me. He continued asking what he said that made me upset, and I repeatedly told him that I no longer want to speak with him and would like to speak with a manager instead. After telling me that any manager was not available, he declined to have a manager give me a call back and proceeded to tell me that he is putting in a recommendation to have me taken me court for not making any sort of payment or arrangement with him and ended the phone call.

Consumer Complaint: In XX/XX/XXXX, Midland Funding, LLC. filed suit against me in the XXXX XXXX XXXX for the XXXX XXXX XXXX for an alleged {$4600.00} debt. I hired an attorney and we filed a Peremptory Exception of No Right of Action. In court the Plaintiff failed to produce documents between the defendant and original creditor and a complete chain of title of the account beginning with the original creditor. On XX/XX/XXXX the court issued a Judgement on behalf of the defendant and against the plaintiff with prejudice. On XX/XX/XXXX, I filed a dispute with all three credit reporting agencies and provided copies of the Final Judgement as well as other court documents. Around 30 days later I received responses from all three credit reporting agencies stating that Midland Funding LLC, had verified the reporting of the debt. I don't understand how Midland Funding LLC can sue me in court, loose and still verify a debt that the court has ruled does not exist.

Consumer Complaint: There are two accounts on my credit report from MIDLAND FUNDING LLC, one account XXXX, and the other account XXXX. These were unauthorized accounts opened. I did not open these account. I have 0 knowledge of them. Its states one was opened XX/XX/XXXX and the other XX/XX/XXXX. I did not open an account in XX/XX/XXXX. I have tried disputing these via credit bureau debt validation. They never respond via mail. They keep reporting on my credit these account are past due and they are not. This is grounds for violation. Not to mention I have lived in Texas since XX/XX/XXXX years. Statue of limitations in Texas is 4 years. Therefore Midland Funding is violating the Fair Debt Collection Practices Act. In XX/XX/XXXX, this company attempted to sue me for a debt in another state. This needs to end. They do not validate their debt, I have never owned them or whom they represent. I would appreciate this accounts with balances of {$950.00} and {$530.00} to be removed permanently from my credit report. This is unlawful and it causes me stress knowing they keep doing this when its unauthorized Accounts. These account are past statue of limitations.

Consumer Complaint: This debt was paid over the phone and received correspondence by mail that the payment was received on XX/XX/XXXX. Per the conversation this debt was to be completely removed from my credit report ( I recorded my conversation with the rep and manager in case of a situation such as this ). This debt is still sitting on my credit report and there last update to all bureaus was XX/XX/XXXX. Based on there typical updates each month this should have been updated no later than XX/XX/XXXX and that has yet to happen. However I received another notice on Monday that it was paid and I have the emails sent from earlier in XXXX that the payment posted. Please let me kno how to submit the mp4 of recording and where to forward emails. I can take pics of the mail correspondence but will not be uploading until I receive the response.

Consumer Complaint: Midland is reporting in my credit file however it is inaccurate because it was said to be late, yet all the payments are OK. I do not think that this is mine. I did my research on what to do because it is affecting my scores to badly, I asked for documents, disclosure and where did the account come from but they failed to provide me, so I came online and researched. The plaintiff is asking the same thing that I wanted and at the end of it all the plaintiff won this case. I am talking about the Texas VS Midland Funding Case. I have learned that Midland claims to have a disclosure and an agreement that there is a Consumer Agreement for all who they are collecting from. I guarantee you that there is no such thing that I have agreed upon to.

Consumer Complaint: Midland Funding filed a lawsuit against me on XX/XX/XXXX in XXXX XXXX, Alabama. I was never duly served with the complaint and a default judgement was entered against me on XX/XX/XXXX. I did not learn of the lawsuit or default judgement until my employer was served with a garnishment order on XX/XX/XXXX. I filed a motion with the court to set aside the default judgement to allow me to answer the complaint. XXXX XXXX set aside the default judgement on XX/XX/XXXX. The attorney for Midland did not have any evidence at the hearing to argue the case, so the judge set a hearing for XX/XX/XXXX. On XX/XX/XXXX, the judge set a trial for XX/XX/XXXX. On the date of the trial XXXX XX/XX/XXXX XXXX, the plaintiff ( Midland ) did not present any evidence to the court showing that I owed the debt or that they were the owners of the debt. The evidence entered was unsatisfactory to the court, as it had absolutely nothing to do with me. The attorney requested a continuance on the case to allow him time to gather evidence. The judge, reluctantly granted the motion, but stated that he would not allow any more continuances on this case and expressed his displeasure with the attorney for coming to court with no substantial evidence and stated that with his granting of this motion that the plaintiff better come back with evidence. After the trail on XX/XX/XXXX, the defendant filed a motion with the court to dismiss the case ( Apparently they had no sufficient evidence ). On XX/XX/XXXX, the judge entered an order ; dismissing the case in my favor. I have since then filed disputes with XXXX, XXXX and XXXX to have all traces of Midland removed from my credit. XXXX is the only credit reporting agency that has adhered to the judge 's order and removed this information. Midland should have themselves removed this information, yet they have made me jump through even more hoops to remove something from my credit that I do not owe them. This just substantiates the further harassment by Midland and their cronies.
