Consumer Complaint: On XX/XX/XXXX, I received a notice of possible attorney review from Midland Credit Management ( Midland ) where they stated, " We are proceeding with an evaluation of your account and are considering forwarding this account to an attorney in your state for possible litigation. '' I had already asked Midland to provide evidence that I owed the debt because I am a victim of identity theft. Midland sent over a copy of billing statements, and nothing baring my signature. I submitted Midlands documents to my attorney who is working my identity theft case and he started working on the case. He advised Midland to not reach to me any more and to send all correspondences to his office. He also asked Midland to confirm that they have ceased collection actions against me and to also confirm that they have not put any negative marks on my credit profile. Midland sent a billing statement to my attorney also. After the second letter to Midland on XX/XX/XXXX we never heard anything back from Midland. On XX/XX/XXXX I noticed that Midland added their collection to my credit report as being past due.

This company refuse to remove this fraudulent information. I gave them everything they asked including the police report number. This company is harassing me with calls and letters.

Consumer Complaint: I had an account go delinquent with XXXX XXXX a couple years back. They ended up sending a bill with the option to settle for about {$200.00} less than what was owed ( if I sent the payment back in full for what they were asking ) so I decided to jump on it. It wasnt an easy decision seeing as how the pandemic was starting, and my partner and I just had a baby. I sent the payment back to credit one with a check. Never heard from them so I was assuming it was cool. I THEN ( about XX/XX/2020 ) get SERVED by a lawyer for MIDLAND CREDIT. I immediately contacted the lawyer listed and paid the remaining {$200.00} I owed, PLUS another {$100.00} because I thought I had to pay for court fees for midland filing! I got the letter from the lawyer ( on behalf of midland ) that the account was settled and closed. NOW I see a collection for {$600.00} pop up from midland on behalf on credit one! Im starting to think these businesses are in cohoots with each other and are taking money from VICTIMS during this pandemic. I have a lot on my plate and this MISHAP just set me back a million miles. I cant believe this.

Consumer Complaint: Midland credit is reporting a new collections account on my credit report. The account is from a credit one account that I SETTLED and CLOSED with lawyers hired directly by MIDLAND. Early XX/XX/2020 ( payment was deducted XX/XX/XXXX from my checking account ) I settled an account with a lawyer based out of Georgia that was HIRED by midland. I settled the account for WHAT WAS REQUESTED by the lawyer on BEHALF of their client midland ( XXXX ) and I have proof. The lawyer rep explained that the account was settled and there would be no other contact or collection efforts from midland or their office. Now, midland has reported a new collections account. I am furious that THEIR lawyers would lead me to believe I settled my account. I used the funds I BARELY had in the middle of a pandemic, and now they slap me in the face for {$120.00}? I attached the amount being deducted from my account, and on the day. Midland has access to see this, because they received the payment from the lawyer they HIRED. Scandalous and I will ensure I DONT let up about this. As a COMPLETELY XXXX veteran, Im definitely contacting my congresswoman.

Consumer Complaint: I acquired XXXX XXXX XXXX XXXX XXXX to consolidate all of my credit card debts on XX/XX/XXXX. I spoke with XXXX XXXX representative for Midland Credit Management on XX/XX/XXXX, and she stated that my previous payment plan was cancelled on XX/XX/XXXX. Also, XXXX stated that XXXX XXXX XXXX XXXX XXXX established a new payment plan for me, and that the first payment to Midland Credit Management will be XX/XX/XXXX. Since then, I have received several emails and statements from MCM harassing me about a payment. MCM is not supposed to contact me, but should be contacting XXXX XXXX XXXX XXXX XXXX regarding future payments on my behalf. I called MCM several times regarding them to stop contacting me and contact XXXX XXXX XXXX XXXX XXXX XXXX I kept being told that I needed to speak with a representative from a certain department, but no one was available to speak with me and that I should call back the next day.

Consumer Complaint: I have an account in collections on my credit report. Original credit was XXXX XXXX XXXX who turned it to collections thru Midland Funding. I never satisfied the debt and when I first called, possibly XXXX of 2020 ( not sure on exact date ) Midland Funding directed me to call XXXX XXXX XXXX XXXX XXXX and provided me their number. When I called in, the person on the phone told me my account was new and was locked, whatever that means. So I left my contact info hoping they would contact me. When I did not get a call, letter or email, I called back and was told the same thing. The lady on the phone understood my frustration but would not share a single detail of my account, answer any questions about why it was still locked and said I cant even pay on it. Yet again, still no contact from this law office that is supposedly in control of a debt on my credit report which is severely hurting my ability to get a simple loan or credit card. It is the only account in collections I have and they will not give me any options to move forward. I even submitted a settlement offer on their website hoping it would get things going but still ZERO contact from them. It is wrong for them to be able to negatively affect my credit report without ever sending me documentation as requested, not providing me any information, and failing to communicate with me. I was willing to pay but now I just want this removed from my credit report since they cant verify it or even unlock my file so I could pay on it.

Consumer Complaint: On XX/XX/2020 Midland Credit Management sent me a debt collection letter violating 6 federally protected consumer rights under 15 USC 1692. 1. Violation 15 USC 1692c ( a ) ( 1 ) - MCM has no consent orally or written to contact me. They have sent a letter to my home inconveniencing me and causing mental anguish. 2.Violation 15 USC 1692d ( 2 ) - The debt collector harassed me in the letter threatening to file a lawsuit against me for an alleged debt. Using obscene language by stating that I owe a debt. 3. Violation 15 USC 1692e ( 3 ) - Several times the debt collector has given the false representation that they are an attorney and that the communication is from an attorney. A company can not give power of attorney because the entity is not a natural person. 4.Violation 15 USC 1692e ( 5 ) - Threatening that they intend to file a lawsuit whenever they can not. Only a natural person can give power of attorney. They have no intent to sue me. 5. Violation 15 USC 1692j ( a ) - furnished a form causing false belief that the original creditor is involved in the debt collection. When in fact I am the original creditor. 6. Violation 1692e ( 2 ) ( a ) - supplied a false character amount of the alleged debt owed. Stated a positive balance instead of a negative balance. This is false representation. How could a consumer pay on a positive balance? I have attached the documents I sent to the violator.

Consumer Complaint: Midland is reporting in my credit file however it is inaccurate because it was said to be late, yet all the payments are OK. I do not think that this is mine. I did my research on what to do because it is affecting my scores to badly, I asked for documents, disclosure and where did the account come from but they failed to provide me, so I came online and researched. The plaintiff is asking the same thing that I wanted and at the end of it all the plaintiff won this case. I am talking about the Texas VS Midland Funding Case. I have learned that Midland claims to have a disclosure and an agreement that there is a Consumer Agreement for all who they are collecting from. I guarantee you that there is no such thing that I have agreed upon to.
