Consumer Complaint: XXXX XXXX XXXX, XXXX XXXX XXXX & Midland Funding is in violation of 15 U.S. Code 1692c - Communication in connection with debt collection ( a ) Communication with the consumer generally Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt ( b ) Communication with third parties Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a post judgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector. I the natural person Never gave XXXX XXXX XXXX, XXXX XXXX XXXX & Midland Funding consent to report anything to the credit reporting agancies nor do I have a contract to do business with them. XXXX XXXX XXXX, XXXX XXXX XXXX & Midland Funding Is in violation of 18U.S.Code 245-Federally protected activities ( a ) ( 1 ) Nothing in this section shall be construed as indicating an intent on the part of Congress to prevent any State, any possession or Commonwealth of the United States , or the District of Columbia , from exercising jurisdiction over any offense over which it would have jurisdiction in the absence of this section, nor shall anything in this section be construed as depriving State and local law enforcement authorities of responsibility for prosecuting acts that may be violations of this section and that are violations of State and local law. No prosecution of any offense described in this section shall be undertaken by the United States except upon the certification in writing of the Attorney General, the Deputy Attorney General, the Associate Attorney General, or any Assistant Attorney General specially designated by the Attorney General that in his judgment a prosecution by the United States is in the public interest and necessary to secure substantial justice, which function of certification may not be delegated. ( 2 ) Nothing in this subsection shall be construed to limit the authority of Federal officers, or a Federal grand jury, to investigate possible violations of this section. ( b ) Whoever, whether or not acting under color of law, by force or threat of force willfully injures, intimidates or interferes with, or attempts to injure, intimidate or interfere with ( 1 ) any person because he is or has been, or in order to intimidate such person or any other person or any class of persons from ( B ) participating in or enjoying any benefit, service, privilege, program, facility, or activity provided or administered by the United States ; XXXX XXXX XXXX, XXXX XXXX XXXX & Midland Funding has tired to intimidate by force willfully injuring me from enjoyment of benefits and services administered by the United States ; XXXX XXXX XXXX, XXXX XXXX XXXX & Midland Funding is in violation of 15 U.S. Code 1692d - Harassment or abuse A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : The use or threat of use of violence or other criminal means to harm the physical person, reputation, or property of any person. False or misleading representations A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 2 ) The false representation of ( A ) the character, amount, or legal status of any debt ; or 8 ) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed. Consumer Complaint: I notified XXXX XXXX of fraudulent charges charges to my card by XXXX rental car for vehicle I was renting at the time. At first they removed charges than somewhere the added them back without my knowledge. I explained that XXXX gave me permission to continue the rental than turned around and said they were going to arrest me if I didn't return car which I did. However they charged my card over 800 dollars and XXXX for fraudulent arrest warrant that I was never charged with. However at this point they charged off card was paid and sold to another company to collect debt I never owe, in an amount I never owed. Midland Bank. XXXX website wont allow me to request Debt Validation letter from Midland Bank.

Consumer Complaint: Opened up XXXX XXXX XXXX card Live in Idaho. Saw card was used in California - Called XXXX XXXX XXXX and disputed charges, told me they closed my account for fraud / identity theft. Then get notice I am being sued for " debt '' bought but Midland credit management for account that was closed for fraud. Process server for Midland credit came to home and threatened to notify neighbors, friends, family and work. ( Have on video via our XXXX camera ). Asked to please leave property and stop threatening us.

Consumer Complaint: I recently sent a letter requesting validation pursuant to 15 USC 1692g of the account with Midland Credit I'm allegedly obligated for that I do not believe is mine. I sent the following letter on XX/XX/2021 alongside a cease and desist, and received no response. I also sent it via certified mail ( which notified me it was received at the location ) with a return receipt and In the letter I stated " If your office fails to respond to this validation request within 30 days from the date of your receipt, all your references to this account must be deleted and completely removed from my credit file, and a copy of such deletion request shall be sent to me immediately. '' I noticed on my credit reports this account is also appearing false and misleading which is a violation of Section 807 of the FDCPA, the date the alleged account was opened and last reported is not the same on all three of my reports.

Consumer Complaint: This complaint is regarding account information below that has not been investigated and no information given. Its been over 2 months with no information given to me regarding these accounts. I have no knowledge of these companies and they shouldnt be reporting as I never gave permission for the reporting per Section 1681a -I sent correspondence to the Credit Bureaus regarding this. I was never notified in writing per 15 U.S.C 1692ag prior to accounts being on my credit report, within 5 days. Moreover, these accounts violate debt collections, abusive and unfair practices per section 1692f ( 1 ) adding additional amounts.

Consumer Complaint: I recently received a wage garnishment from midland funding through a default judgement. There are three issues with this action taken by midland funding which causes the filing of this complaint. 1 The debt was not mine, this can be proven with a police report i made back in 2017 that the credit card was being used without my consent. All midland funding statements reflect on my name because i did open that account, but was later used by my ex girlfriend. 2 The debt was charged off as bad debt, profit and loss write off this is reflected prior to the default judgement and reflected in my credit reports I possessand most importantly this is TAX FRAUD. 3 Midland funding knowingly filed documents in superior courts to obtain the default judgement and directed other entities to garnish my wages.

Consumer Complaint: Midland Credit Management has not submitted any documentation that according to the FCRA qualifies as debt validation! They are illegally furnishing data to my consumer reports!!!! They are in violation of 15 usc 1692g which outlines debt validation and they are also in violation of 15 usc 1681b which outline permissible purpose!!! They also have violated 15 usc 1692f which is considered by the FTC to be debt parking.
