Consumer Complaint: Midland credit has filed a law suite and was awarded judgement over a debt I knew nothing about. This debt is well over XXXX years old and is against the fair debt collection act. I answered to the complaint in XXXX XXXX court on line and no new court date was issued. I was not aware of the court at that time. I was served with a garnishment on this debt that is very much over XXXX XXXX XXXX that I did not cause. Again this has past a statue of limitation per Georgia law. The collection agency Midland Credit only had XXXX years by Georgia law and now causing to infringe on the fair debt collect act. Something needs to be done on judges in XXXX XXXX for not enforcing these laws. I would like to file a suite against midland credit XXXX XXXX and XXXX XXXX ga for infringing on my rights to the fair debt collection act.

Consumer Complaint: Refer to CFPB Case Number : XXXX, On XX/XX/XXXX, I wrote letters to Midland Credit Manangement , LLC spoke with XXXX XXXX , in the Concern dept @ XXXX asking for an update on my Identity theft account # XXXX. Midland Credit XXXX had an attorney office XXXX XXXX @ XXXX, filed for wage Garnishments without my knowledge. I was notified through my Employer back in XX/XX/XXXX. I immediately went to work on XX/XX/XXXX with all three Credit Bureaus disputing each account. Midland Credit Manangement had three accounts under my name however only two of these fraud accounts were closed. The third account XXXX, that went to XXXX XXXX a Identity Fraud packet was not applied & caused the Garnishments. After several attempts contacting Midland Credit Manangement, LLC XXXX XXXX, told me back on XX/XX/XXXX, that they needed to recall the account from the law firm. Ive now received a paid in full letter from the law firm & now awaiting a refund since XXXX XXXX confirmed receiving my fraud packet on XX/XX/XXXX, for the third time. XXXX, XXXX, XXXX XXXX XXXX, sent Midland Credit Manangement a fraud packet in XX/XX/XXXX, and To the XXXX XXXX back in XX/XX/XXXX, while in the middle of my paychecks being Garnished. Midland Credit Manangement had time to processed MCM # XXXX & MCM # XXXX as fraud accounts on XX/XX/XXXX, but failed to processed MCM # XXXX. XXXX XXXX, in Consumer Support dept advised me on XX/XX/XXXX, while being Garnished that she would recall my account from XXXX XXXX to review my account. XXXX XXXX confirmed on XX/XX/XXXX receiving my Fraud Packet, that fax to her number XXXX. I continue calling Midland Credit Manangement & XXXX XXXX XXXX making sure the Garnishments stopped. Afterwards I contacted XX/XX/XXXX, XXXX XXXX ( XXXX, ph : XXXX, with XXXX employed by Midland Credit Manangement explaining the Garnishment issue to her. I emailed XXXX XXXX showing that Midland Credit Manangement had already processed the fraud packets for two MCM # XXXX & XXXX accounts listed above, the third account MCM # XXXX not yet processed. XXXX received those letters I emailed that Midland Credit Closed both accounts. XXXX contacted Midland Credit Manangement and the Garnishment stopped immediately. Midland Credit Manangement stated that I paid the account # XXXX, in full although XXXX XXXX said, a balance of $ XXXX dollars was accruing interest daily. This is Unacceptable. Midland Credit Manangement refused to refund my Garnished wages knowingly that the fraud packet was received while the Garnishments was active. I've requested a refund of {$2700.00} however Midland Credit Manangement, claimed they received the fraud packet after the Account was placed with the Lawfirm. Under the FCRA law, you are not allowed to keep my wages if you processed the fraud packet for two accounts listed above, then refused to issue a refund, in your recent response to complaint number XXXX. I will attach documentation for supporting my claim.

Despite multiple attempts to address this matter directly with the company, they have failed to provide the necessary documentation and have violated several provisions of the Fair Debt Collection Practices Act ( FDCPA ) and the Fair Credit Reporting Act ( FCRA ). The details of my complaint are as follows : Failure to Provide Validation : I have repeatedly requested comprehensive validation of the alleged debt, including signed documents establishing my direct ownership. Midland Credit Management , Inc. has failed to provide this information within the requested timeframe, violating my rights under the FDCPA. Unlawful Reporting of Disputed Information : Despite the ongoing dispute and lack of validation, Midland Credit Management , Inc. continues to report the alleged debt to credit bureaus. This is a direct violation of the FCRA, which requires accurate reporting and the cessation of reporting during a dispute. Refusal to Cooperate : The company has demonstrated a deliberate refusal to cooperate with my requests, ignoring the urgency of the matter and violating their obligations under federal law. Potential Violations of Identity Fraud Protection : Midland Credit Management , Inc. 's failure to adequately verify the legitimacy of the alleged debt may constitute negligent enablement of identity fraud, exposing consumers to potential harm. I have made the company aware of my intention to seek legal action, including potential small claims proceedings, and have provided them with a final opportunity to address the matter amicably. However, their continued non-compliance necessitates the involvement of the Consumer Financial Protection Bureau to ensure the protection of consumer rights. Enclosed with this complaint, please find copies of all relevant correspondence, including the letters sent to Midland Credit Management , Inc., highlighting my attempts to resolve this matter directly. I kindly request that the Consumer Financial Protection Bureau investigate this complaint thoroughly and take appropriate actions to ensure compliance with federal consumer protection laws. States I have the right to privacy. 15 U.S.C 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish a account without my written instructions 15 U.S.C 1681c. ( a ) ( 5 ) Section States : no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. I requested debt validation from agency and received a partial copy of a statement or just a confirmation that it was validated through a third party. I have sent multiple letters. Im requesting that these accounts be removed.
