Issue: Getting a credit card

Subissue: Application denied

Consumer Complaint: Subject : Urgent Matter Application, XXXX XXXX XXXX XXXX XXXX Dear Discover Financial Services and Discover Bank, I hope this letter reaches you in good health. I am writing to bring to your attention a matter of significant concern regarding the handling of applications submitted to Discover Bank, which have been converted into securities and subsequently traded on the secondary market. It has come to my attention that my applications, in particular, have been utilized for this purpose, and I believe there are critical issues that require immediate attention and resolution. My applications were submitted to Discover Bank under the understanding that they would be processed in accordance with the terms outlined in our binding agreement, and that in return for the investment, I would receive the agreed-upon products and services. However, it has come to my knowledge that these applications have been transformed into securities for trading on the secondary market without my explicit consent. I would like to draw your attention to the following points : XXXX XXXX and XXXX XXXX : The conversion of applications into securities for trading on the secondary market is a practice that, according to my understanding, was not disclosed in our initial agreement. This has raised concerns about the potential misuse of my personal information and the financial benefits derived from these securities trading activities. XXXX XXXX : I have considered a forensic audit to expose XXXX numbers associated with the securities generated from my applications. This audit aims to determine the amount of money these securities have generated and whether this aligns with the terms of our binding agreement. Material Evidence : As outlined in Discover Financial Services and Discover Bank 's XXXX, XXXX, Prospectus, and Indenture Agreement Form, these documents serve as material evidence of the company 's objectives to attract investors and generate capital through various means, including the trading of securities. Tort Actions and Discrimination : The attempt to use non-public personal information without my explicit written consent for the purpose of discrimination and fraud is deeply troubling. These actions have caused harm to my personal well-being, reputation, and have resulted in the denial of my rights and titles to monthly bonds, interest payments, and proceeds. Upon a thorough review of the XXXX form which is accessible through the Securities Exchange Commission ( SEC ) website, it has become apparent that there are areas where both the parent company and its subsidiary may be at risk of noncompliance and legal ramifications. I believe that it is imperative that this matter be promptly presented to the Risk Committee and the Board of Directors to initiate a comprehensive review and take necessary actions to prevent further damage. The specific points of concern include : Noncompliance Risks : The XXXX form indicates potential areas of noncompliance that may expose both Discover Financial Services and Discover Bank to legal and regulatory risks. Legal Implications : Failure to address the identified noncompliance issues could result in legal implications, fines, and damage to the reputation of both entities. It is crucial to assess the severity of these risks and take corrective measures immediately. Responsibility of the Risk Committee : Given the nature of the risks outlined in the XXXX form, it is the responsibility of the Risk Committee to conduct a thorough analysis, assess the potential impact, and formulate strategies to mitigate these risks effectively. Board of Directors Oversight : The Board of Directors should be informed promptly about these compliance and legal risks to ensure transparency and to enable them to make informed decisions that safeguard the interests of the company and its stakeholders. Preventative Measures : Immediate action is necessary to implement preventative measures that align with regulatory requirements and ethical business practices. This will help in safeguarding the company 's integrity and protecting against further legal and compliance risks. I strongly recommend convening a special meeting of the Risk Committee and the Board of Directors to address these concerns. Timely and decisive action is crucial to protect the best interests of Discover Financial Services and Discover Bank. If the proper party is unwilling to provide a remedy for these actions within 21 business days from the receipt of this letter, I intend to use the findings from the forensic audit, along with the aforementioned forms and exhibits, as evidence to recollect all proceeds generated from the security investments. On or before XX/XX/2023, there will be a letter sent by registered mail to both the Parent Company and its Subsidiary ( Discover Bank ). This parcel will contain a medallion-stamped or notarized letter reiterating these concerns. I implore you to treat this matter with the urgency and seriousness it deserves to avoid further legal action. I look forward to a prompt and amicable resolution to this issue. Sincerely, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: Discover closed out CFPB complaints XXXX and XXXX claiming they are duplicates of CFPB complaint XXXX. Discover claims the account/tradeline is accurate and that it is the CRAs reporting inaccurate information. The payment history for the account has been horridly inaccurate and attempts to have it corrected by Discover and the CRAs has yielded results that continued to show false/misleading/inaccurate information for the account/tradeline. I am an indiidual with a XXXX XXXX XXXX. Given the strange payment histories reported for the months leading up to an alleged charge-off I have been unable to understand what exactly happened with this account. I have never been provided with a table that shows the number of days past-due alleged for the months within the XXXX of 150 days of alleged charge-off, and inspecting my credit reports generating the CRAs has not been of help because the data reported has included months with NO DATA followed by an alleged late payment that is less than the number of days at which Discover charges-off accounts it alleges are seriously delinquent.

Issue: Took or threatened to take negative or legal action

Subissue: Sued you without properly notifying you of lawsuit

Consumer Complaint: I received a letter in XX/XX/XXXX from XXXX XXXX XXXX regarding a debt for Discover. The letter indicated I could set up arrangements online so I did for the amount I could afford. The online system only allowed 6 months of arrangements. Due to a death in the family on XX/XX/XXXX, I did not extend the arrangements passed XX/XX/XXXX because I had too much in my mind. When I realized this in XXXX, I called and spoke to a representative of XXXX who advised legal action had been filed because my payments had not been enough even though I never received anything from XXXX advising this. The agent offered arrangements and a settlement that I could not afford. I studied all my finances and determined I could not afford what they were asking but I did set up a new arrangement on line that allowed again 6 months of payments. There was not a month of lapse in the 2 arrangements, however, they are still pursuing legal action against me. They have never advised the minimum they need to avoid suing. I am attempting to pay the debt and they are happily taking the funds from my account. How can they allow arrangements to be made online for whatever amount you enter but still sue? Also, they have blocked me from accessing my account online to change the payment or extend it.

Consumer Complaint: The debt Collector, DISCOVER Bank has engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. They furnished this account that we did not agree upon and I did not sign an agreement on. A legal contract is signed by two parties and I did not participate in any of it. More so they did not follow the proper 5 step validation procedure which make this unfair practices. According to the FDCPA I'm entitled to 1,000 dollars per violation and clearly they violated my rights.

Subissue: Problem with balance transfer

Consumer Complaint: I have a credit card with discover card which was expired on XX/XX/. This card was on my XXXX account ( this was the only recurring charge on my credit card ). After the expiration of the card I decided to not use my discover credit card again and I did not pay attention to the statements of the credit card but unfortunately XXXX did charge my card long after my card was expired. Now the problems are having a late payment on my credit history which I never had and also lowering my sister 's credit score who is about to apply for a house loan, because she was an authorized user on that card, there is also another problem which is the amount that I was charged and and the late fees I was charged which I think it's not fair. Thanks!

Consumer Complaint: I owed $ XXXX on my Discover Card. I got an offer from XXXX including balance transfer 0 % for 12 months and I opened the account. XXXX immediately showed that I owed them {$2300.00} and I got a physical mail saying that that was the highest amount they could transfer, but it did not show up on Discover for a week. I complained to XXXX that the debt was showing on both credit cards. They pulled the money back fto Discover and now this {$2300.00} shows as debt on both cards.

Consumer Complaint: Recently Discover Card reduced my credit limit, citing " no collateral. '' My monthly payment has never been late and I do not use the card any longer. I told the representative who took my complaint that I was effectively being punished for using my card and paying on time. This event has impacted my credit score which affects my financial well-being. As a senior citizen, I can not afford such egregious tactics.
