Consumer Complaint: Every month I have paid my Discover Credit Card bill. I paid it in full on time, if not before, sometimes even multiple times a month. However, this past month I paid the minimum amount FOR THE FIRST TIME, when it was due. I have since called Discover to make sure I have never been late or missed a payment, in which they responded that is correct. I I received an email a few days ago from XXXX XXXX that said, Discover had closed my account and it took a hit to my credit. I called Discover in which their response was there was unusual payment activity. Basically what happened, this past month I was stretch thin so I was nearing my credit limit and my XXXX put their monthly charge through, it was declined because it went over my limit. Which is fine. My XXXX pushed it again, which was declined. Again, no problem. At this time I had paid the minimum so I was still in good standing with Discover. I received three ( 3 ) separate emails from Discover : One ( 1 ) saying they have stopped reoccurring charges. Two ( 2 ) saying they had declined payments from my XXXX. Three ( 3 ) there was a message in a secure inbox to check ; which said they were closing my account due to unusual payment activity. Discover never called me to verify those were my charges or anything for that matter. They simply wrongly and falsely closed my account when I had been in good standing as far as payments go, which in turn took a hit to my credit. I have tried to right this wrong with Discover in which they have said there is nothing they can do once the account is closed and the decision is final. This is scary because I can not be the only consumer they are doing this to right now, its wrong.

Consumer Complaint: I have previously disputed this company and asked that they send the consumer a LEGAL BINDING CONTRACT that has both legible signatures ( from myself and the company entity stating that there is a contractual agreement between both parties. What the consumer received was anything but. The consumer specifically asks for the entity to produce legalities that the alleged account indeed belongs to the consumer. Yet they have chosen over and over again to send the consumer what they feel is needed, which is UNACCEPTABLE. This game that the company is playing should be pointed out that if they are unable to produce the legality of the alleged account then the account should be REMOVED IMMEDIATELY. THE COMPANY IS CONSISTENTLY VIOLATING LAWS. I will upload the latest letter that was sent to the consumer about the matter.

Consumer Complaint: I have contacted Discover card multiple times regarding an account that they are reporting on my credit report. I let them know that the account does not belong to me in several conversations. I have sent in requests to Discover asking for verification of the accounts per FCRA laws. They sent me a bunch of statements claiming to be mine. I have contacted the credit bureaus on this matter and they continue to say that Discover has verified the account to be mine. I was a victim of identity theft and I provided Discover with the police report I had filed several years ago on this. They are still refusing to remove the fraudulent accounts from my credit report. I am requesting that the account be removed immediately. Discover continues to update my credit report monthly which is against FCRA and increases the amount of time that this will stay on my report. This account needs to be removed. Please see a copy of my credit report.

Consumer Complaint: I have a credit card account with Discover Bank. I have had it for over XXXX years. I have perfect credit history with no a single missed payment in the past XXXX years. I had set up auto pay on the account years ago, and have been making payments on the account proactively ever since I have had it. I stopped using the card months ago due to issues with the website ; however, it appears a couple of transactions came through unexpectedly and triggered a payment for {$80.00}. Since I had set up auto pay years ago ( probably over a decade ago ) I expected any transactions that come through to be paid automatically. However, it seems that feature had somehow turned off, and I didn't receive any sort of notifications on my updated email to indicate the payment is late. In fact, I only found out after it hit my credit report and XXXX XXXX alerted me to a change on my profile. The bank had reported the transaction as late XXXX days. I contacted the bank to no avail, as no one was willing to even entertain the thought of helping. I of course made a payment immediately to pay it off since it was an insignificant amount, but the bank refused to remove the derogatory hit, event though this was the result of a banking error since the auto pay was somehow removed from my account. I request for the bank to remove the reporting of the XXXX days late from my credit reports.

I PUT DOWN A SECURED {$400.00} for CREDIT CARD AND NEVER RECEIVED A DEPOSIT BACK AFTER 6 MONTHS, ALSO DISCOVER HAS REVERSED THE ACCOUT INTO A NEGATIVE BALANCE OF {$830.00} DOLLARS. DISCOVER BANK IS PRACTICING UNLAWFUL ABUSIVE BEHAVIOR TOWARDS ME AS A CONSUMER ACCORDING TO 1026.11 - Treatment of Credit Balances ; Account Termination Paragraph 11 ( a ) ( 3 ) 1. Good faith effort to refund. The creditor must take positive steps to return any credit balance that has remained in the account for over 6 months. This includes, if necessary, attempts to trace the consumer through the consumer 's last known address or telephone number, or both. 2. Good faith effort unsuccessful. Section 1026.11 imposes no further duties on the creditor if a good faith effort to return the balance is unsuccessful. The ultimate disposition of the credit balance ( or any credit balance of {$1.00} or less ) is to be determined under other applicable law. 11 ( b ) Account Termination Paragraph 11 ( b ) ( 1 ) 1. Expiration date. The credit agreement determines whether or not an open-end plan has a stated expiration ( maturity ) date. By fighting back against this injustice, I am ensuring that the information on my credit report is accurate and reliable.I have every right to challenge any inaccuracies in a manner compliant with federal law when they are negatively affecting me financially because of their accuracy or completeness. This is just an allegation. There's no proof that I'm delinquent or derogatory, so how can you report this? With all due respect, the claims within my report are wrong! You have to follow proper procedures if these claims are in your system and to be used in my credit reports! I challenge the accuracy and fairness of your findings by demanding evidence before you make any claims and take such drastic measures against my reputation.I know that you cant just decide which rules apply to your organization, so I won't let anyone report any false claims. it's important to make sure all of your claims are accurate and reported in the correct format- this is required by law ( FCRA ) as well as XXXX XXXX standards.For any negative account I demand documentation / proof proving why your company considers it delinquent or derogatory. You have yet to provide me records documenting how your company verified and validated these accounts/ claims. Your proof of each negative claim you placed on my credit report should also include proof of a permissible purpose for any inquiry into the account.It 's time for me to get my life back! I need you to send over some physical proof of what has been done and an updated credit report. Either confirm that this matter has been reported correctly or remove it from the report immediately. I am giving you 30 days to investigate.These allegations are without merit. Please provide accurate and verified information for each claim. If any of these claims are not true, please delete them immediately so I can restore my good name.

Under 15 U.S. Code 1666b ( a ) a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. I have disputed this several times in attempt to correct the inaccurate information that is being report, however Discover has yet to correct the account which violates 12 CFR 1026.13 ( d ) ( 2 ) that states the creditor or its agent shall not ( directly or indirectly ) make or threaten to make an adverse report to any person about the consumer 's credit standing, or report that an amount or account is delinquent, because the consumer failed to pay the disputed amount or related finance or other charges.
