Consumer Complaint: I have a fraudulent account on my credit report, which I reported to DISCOVER FIN SVCS LLC, yet DISCOVER FIN SVCS LLC is not removing this fraudulent account. According to FCRA 605B ( 15 U.S.C. 1681C-2 ) consumer reporting agencies and creditor shall block the reporting of any information resulting from identity theft no later than 4 business days after date of receipt, yet DISCOVER FIN SVCS LLC has refused to do this. The following is the fraudulent account : DISCOVER FIN SVCS LLC XXXX which was opened at an address where I have never lived at and it has nothing to do with me.

Issue: Problem when making payments

Subissue: Problem during payment process

Consumer Complaint: It was bought to my attention on XX/XX/2023 that according to the Uniform Commercial Code I had other ways to tender payment besides federal reserve notes, which is the most commonly used payment method. According to UCC code 3-603. TENDER OF PAYMENT, and 3-602. PAYMENT, and 3-104. NEGOTIABLE INSTRUMENT. Discover has decided to acknowledge receipt of the Payment Coupon that was detached and returned to set off, remit, or discharge debt. As a result they have sent multiple requests for additional payment in Federal reserve notes. I have spoken with a manager who stated I just sent them a piece of paper although I sent certified mail an endorsed payment coupon. UCC code 3-206. RESTRICTIVE INDORSEMENT. They are also threatening to report late transactions to credit reporting agencies who are also violating the UCC codes. 603 - 15 U.S.C. 1681a ( 2 ) ( A ) ( i ) states that reports containing information solely as to transactions or experiences between the consumer and the person making the report ; should not be included. I have tried to contact customer service about the matter I also started a claim with Discover in regards to the matter. This is impacting me negatively as I have an expanding business and Discover is reflecting negative information on my credit report and denying a legal tender of payment. I have attached several supporting documents and would like this matter resolved urgently as the negative report is denying me access and creating a costly negative impact.

Issue: Problem with a purchase shown on your statement

Subissue: Credit card company isn't resolving a dispute about a purchase on your statement

Consumer Complaint: On XX/XX/2023, I purchased a salad at XXXX XXXX XXXX on XXXX XXXX XXXX in XXXX, GA. This salad made me ill. I complained to XXXX about it and they did nothing other than send me a Dear XXXX email and have the manager call up to say " it's only you '' and hang up. Then I disputed it with Discover. All of a sudden, they don't cover bad food. The sorry piece of XXXX that answered the phone named XXXX even said it's my fault for eating the food. The problem is food illnesses are not instantaneous. It took hours. What was I supposed to do, take them my XXXX and then request a refund? XXXX refuses to do the right thing and refund my money, Discover is now trying to hide and say they don't cover food purchases but that is not in the cardmember agreement. They have actually covered it before. I do not see what the problem is all of a sudden.

Issue: Took or threatened to take negative or legal action

Subissue: Threatened to sue you for very old debt

Consumer Complaint: Dear Consumer Financial Protection Bureau, I am writing to file a complaint against XXXX and XXXX for violations of the Fair Credit Reporting Act ( FCRA ) and other applicable laws. The agency has been pursuing an alleged debt from 2007 that I disputed and despite my requests for validation, they have failed to provide proper documentation. I have previously requested that the debt collection agency provide me with written proof of the validity of the debt, including documentation that shows the original creditor, the amount of the debt, and any interest or fees that have been added. To date, they have not provided me with this documentation, and I am concerned that they are continuing to pursue collection activities without proper validation. I believe that this behavior is in violation of my rights under the FCRA and other applicable laws. I am requesting that the Consumer Financial Protection Bureau investigate this matter and take appropriate action to ensure that the debt collection agency complies with all applicable laws and regulations. Specifically, I am requesting that the agency cease all collection activities related to this debt until they can provide proper validation. I am also requesting that any negative reporting related to this debt be removed from my credit report until the debt can be properly validated. I appreciate your attention to this matter and look forward to your response. Thank you for your time.
